This refers to the routine sai'ety. inspection conducted by Mr. R. L. Nimitz

of this office on August 31_-! September.4,1981 and Septenber 28 - October

2,1981 of activitics authorized by NRC License No. DPR-35 at the Pilgrim

Nuclear Power Station, Plymouth, Massachusetts and to the discussions of

our findings held by Mr. Nimitz with Mr. R. D. Machon androther members of

your staff at the conclusion.of the inspection.

Areas examined during this inspection are described in the NRC Region I

Inspection Report which is enclosed with this letter. Within these areas,

the inspection consisted of selective examinations of procedures and re-

presentative records, interviews with personnel,. measurements made by the

inspector, and observations by the inspector..

In addition, our inspector e'xitmined those activities conducted under.your.

license relating to the subjects covered in our letters to you dated February

10, 1981 and July 27, 1981 from Mr. B. II. Grier, then Director of NRC

Region I.

Regarding our July.27,1981 letter, your implementation of the

revised sampling procedures discussed therein.will be reviewed during a

subsequent inspection of your_ licensed program..

Our inspector also verified the steps you.have taken to correct the items

of noncompliance brought to.your attention in the enclosure to our. letter

,

dated July 22, 1980. We have.no further questions regarding the steps you

took to correct Items A.3 and_B.

However with regard to Items A.1 and 2

of the July 22 letter, these items have recurred. During the current

inspection an example of failure to post a high radiation area was identified.

Items A.1 and 2 in the July.22,1980 letter involved two examples of the

same violation.

Based on the results of this inspection, it appears that certain of your

activities were not conducted in fully compliance with URC requirements as

set forth in the Notice of Violation, enclosed herewith as Appendix A.

are required to respond to this letter and in preparing your response, you

should follow the instructions in Appendix A.

Item A in Appendix A was identified during a previous inspection of your

licensed activities on February 5, 1980, and, as discussed above, was brought

to your att2ntion in our letter of iluly 22, 1980. Your letter to this office

dated August 29, 1980 stated that high radiation areas would be posted in a

more permanent fashion. From our Septcmber 28, 1981 inspection it appears that

the stated corrective actions were not effective since this item has recurred.

Recurrent and uncorrected items of noncompliance are given additional weight

in the consideration and selection of appropriate enforcement action. Therefore,

in your response to this letter, you should give particular attention to those

actions taken or planned to ensure that identified items of noncompliance will

be completely corrected and will not recur.

In accordance with 10 CFR 2.790 (a) of the Comission's regulations, a copy

of this letter and the enclosures will be placed in the tiRC Public Document

Room unicss you notify this office, by telephone, within ten days of the

date of this letter and submit written applicatio.1 to withhold information

contained therein within thirty days of the date of this letter. Such

application must be consistent with the requirements of 2.730 (b)(1).

The responses directed by this letter are not sutyject to the clearance

procedures of the Office of Management and Budget as required by the Paperwork

Reduction Act of 1980, PL 96-511.
