PETITION TO INSTITUTE A PROCEEDING TO SHOW CAUSE WHY THE SEABROOK CONSTRUCTION PERMITS SHOULD NOT BE REV0KED OR SUSPENDED FOR LACK 0F FINANCIAL QUALIFICATIONS By petition dated February 5,1982, Robert' Backus, on behalf of the Seacoast Anti-Pollution League, requested'that the Director of Nuclear Reactor Regulation immediately institute a proceeding to show cause why the Seabrook construction permits should not be revoked or suspended due l
to the lack of financial qualification of the lead applicant, Public-Service Company of New Hampshire, in the present circumstances.
It should be noted that this is the second petition filed by Mr. Backus concerning financial qualification issues. The earlier petition was filed March 12, 1979 and was eventually denied. See, Public Service Company of New Hampshire (Seabrook Station),10 NRC 703 (1979).
The February 5,1982 petition should be treated pursuant to 10 CFR 2.206 of the Comission's regulations. This office will work with your Staff to develop an appropriate response. Enclosed for your u'se are drafts of:
1.
A letter of acknowledgment to Mr. Backus; 1
2.
A letter of transmittal to the licensee; and i

A notice of receipt of the petition for publication in the Federal Register.
