g This refers to your letters of January 5,1982, in response to the Notice of Violation and Proposed Imposition of Civil Penalties sent to you with our letter of December 1,1981. Our December 1 letter concerned violations found 3
during our inspection conducted on August 25 and 26, 1981 of activities at the H. B. Robinson Steam Electric Plant, Unit No. 2.
After careful consideration of your response, we have concluded for the reasons given in the enclosed Order that violation Items A and C occurred.
Item A of the Notice has been amended in the Appendix to the Order to reflect the input provided by the licensee. Additionally, for Item B in the Notice, IE agrees i
with your argument that adequate surveys were performed but that the overex-posure did occur. Accordingly, the civil penalty for Item B has been mitigated to $5,000. We have also given careful consideration to your request for miti-gation of all of the proposed penalties and have concluded for the reasons given in the enclosed Order that the bases for mitigation were insufficient for two of the violations specified above. Accordingly, we hereby serve the enclosed Order on Carolina Power and Light Company, imposing civil penalties in the cumu-lative amount of Forty Thousand Dollars.
You are also requested to reexamine your radiation control program for identi-fication of the underlying causes of its failure during this incident. We find.

your assertion that the exposed worker's failure to follow procedures was the root cause of this incident to be unsupported by the facts. The cause of the worker's failure to follow procedures appears to have been the cumulative effect of several shortcomings, including the failure to instruct the worker in the requirements of the appropriate procedures, the failure of the health physics l
technician to give him oral instruction, and the failure of the individual who l
prepared the RWP to specify proper location of personnel dosimetry and to pro-l hibit steam generator entry.
