Subject: Inspecthn 50-334/81-25

This refers to the routine safety inspection conducted by Mr. D. A. Beckman of this

office on September 8 - October 13, 1981 at the Beaver Valley Power Station, Shipping-

port, Pennsylvania of activities authorized by NRC License No. DPR-66 and to the dis-

cussions of our findings held by Mr. Beckman with Mr. H. Williams and other members

of your staff at the conclusion of the inspection.

Areas examined during this inspection are described in the Office of Inspection and

Enforcement Inspection Report which is enclosed with this letter. Within these areas,

the inspection consisted of selective examinations of procedures and representative

records, interviews with personnel, measurements made by the inspector, and observa-

tions by the inspector.

Based on the results of this inspection, it appears that certain of your activities

were not conducted in full compliance with flRC requirements, as set forth in the

Notice of Violation, enclosed herewith as Appendix A.

These items of noncompliance

have been categorized into the levels described in the Federal Register Notice (45 FR 66754) dated October 7, 1980. You are required to respond to this letter and in

preparing your response, you should follow the instructions in Appendix A.

With respect to Appendix A, we note that you have corrected Item No.

E., and there-

fore you need not address yourself to this matter in your response.

Item E. described in the enclosed Hotice of Violation is classified as a Severity

Level III violation in recordance with the Interim Enforcement Policy. As stated

in Section IV.B of this policy, monetary civil penalties are normally assessed for

Severity Level III violations. After careful consideration of this specific viola-

tion, we have determined that a civil penalty is not appropriate. This determina-

tion was based on the fact that (1) the surveillance scheduling system was promptly

strengthened, (2) a tagging system was implemented to prevent untested components

from being returned to service prior to demonstrating operability, and (3) you

reported this event as required. We also note that the surveillance test conducted

after discovery of this event reconfinned operability.

security measures for physical protection are deemed to be corrrnercial or financial

information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclo-

sure only in accordance with the provisions of 10 CFR 9.12; therefore, the pertin-

ent section(s) of the enclosed inspection report will not be placed in the Public

Document Room and will receive lin.ited distribution. X3ifitionally, in accordance

with Section 2.790 of the fiRC's " Rules of Practice," Part 2, Title 10 Code of

Federal Regulations, a copy of this letter and the sections of the enclosure that

do not contain 2.790(d) information will be placed in the NRC's Public Document

Room.

If this report contains any infomation that you (or your contractors)

believe to be exempt from disclosure under 10 CFR 9.5(a)(4), it is necessary that

you (a) notify this office by telephone within ten (10) days from the date of this

letter of your intention to file a request for withholding; and (b) submit within

25 days from the date of this letter a written application to this office to with-

hold such information. Consistent with section 2.790(b)(1), any such application

must be accompanied by an affidavit executed by the owner of the infomation, which

identified the document or part sought to be withheld, and which contains a full

statement of the reasons on the basis which it is claimed that the information

should be withheld from public disclosure. This section furthor requires the state-

ment to address with specificity the considerations listed in 10 CFR 2.790(b)(4).

The information sought to be withheld shall be incorporated as far as possible into

a separate part of the affidavit.

If we do not hear from you in this regard within

the specified period, these sections of the report will be placed in the Public Docu-

ment Room. Telephone notification of your intent to request withholding, or any
