s Summary of Weekly information Report Week Ending January 23, 1980 Low-level Radicactive Waste Permit from Coooer Nuclear Station to Beatty, Nevaca, Storage Site Suscended The bottom of a box carrying low-level radioactive waste fell out while it was being unloaded from a truck. As a result of this incident, Cooper's low-level waste permit was indefinitely suspended from Beatty pending a review of the Q/A and Q/C aspects of shipments by the licensee and a review of the proposed corrective actions by the Region IV I&E office.
Jamescort Units 1 and 2 On January 15, 1981, the Appeal Bo~ard issued a Memorandum and Order which dis-missed the proceedings before the Appeal Board, vacated Licensing Board decisions authorizing construction of the Jamesport facility, terminated the construction permit proceedings, and directed the Director of NRR to revoke the outstanding construction permits.
EPA Federal Guidance on Occupational Radiation Protection EPA inforned the staff that the EPA proposed guidance will be published in the Federal Register for public comment on January 23, 1981. Dates, times and addresses for the joint EPA /NRC/ OSHA hearings will be announced in a later Notice but are expected to be held early in April.
Humboldt Decommissioning Conference The Redwood Alliance Educational Collective, a public interest group, sponsored the 2nd Annual Humboldt Decommissioning Conference in Arcata, California, on January 10 and 11 to provide a data base for the public in the area of nuclear reactor decommissioning and to discuss issues arising from the possible decommissioning of the Humboldt nuclear reactor, which is currently inoperative.
There was a good degree of information exchange and an encouraging level of interest on major issues.
Diablo Canyon On January 18, 1981, the California State Democratic Committee at its annual State convention voted to oppose the operation of the Diablo Canyon nuclear power plant.

AID TO THE HAf;DICAPPED The Telecommunications Branch, Division of Facilities and Operations Support, has purchased three portable teletypewriter machines for use by an NRC Engineer with a hearing impairment. The machines are micro-processor controlled and have a moving visual display, which will enable her to " converse" with her legal advisor at-MNBB and with her licensing case worker in New York State over voice telephone lines.

0FFICE OF NUCLEAR REACTOR REGULATION DAILY HIGHLfGHTS WEEK JANUARY 19 - 23, 1981 PEACH BOTTOM UNIT 2 On January 16, 1981 the staff issued an amendment for a temporari change to the Technical Specifications for Peach Bottom Atomic Power Sittion Unit No. 2.
The change involved an increase in the trip level setging for ghe main steam line tunnel exhaust duct high temperature from 200 F to 250 F for a period of 5 minutes. This trip would isolate the main steam line isolation valves in the event of a main steam line break. The change was authorized to minimize the possibility of an inadvertent transient on the unit during the period of time that tne tunnel ventilation system was being returned from an isolated to its normal operating condition.
The staff authorized the temporary change based on judgement that (1) the
. steam tunnel exhaust air temperature could increase to the trip level for reasons other than a stean line break, (2) there are 2 other diverse sig-nals (steam flow and radiation) which provide the same protection and (3) the licensee agreed to compensatory measures whereby an operator in the control room monitors the temperatures and is able to manually initiate isolation during the time of the temporary change.
LOW LEVEL RADI0 ACTIVE WASTE PERMIT FROM COOPER NUCLEAR STATION TO BEATTY, NEVADA STORAGE SITE INDEFINITELY SUSPENDED Based on preliminary information received from the licensee it was learned that two truckloads of low level radioactive waste were sent to the Beatty Nevada site for disposal. As the first box on the second truckload was being unloaded the bottom of the box fell out. The contents of the box (approx. weight 1000 lbs) is unknown at this time, but is thought to be piping that was cut out during plant modifications. As a result of this incident Cooper's low level waste permit has been indefinitely suspended.

Safeouards Vulnerability Analysis Programs (SVAP) l l
Lawrence Livermore National Laboratory (LLNL) and S feguards, Fuel Cycle and Environmental Research (SAFER) has establikhed a three day training workshcp that will give NRC participanth a practical, working knowledge of how to apply SVAP. The workshop will begin on Monday, February 2, at 9:00 a.m. and close on Wednesday, February 4, at 1:00 p.m.
Each workshop session will be held at the Del Ray Building in Bethesda in Suite 402.

OFFICE OF STANDARDS DEVELOPMENT IMPORTANT EVENTS FOR THE WEEK ENDING JANUARY 23, 1981 2nd Annual Humboldt Decomissionino Conference

A representative of the NRC, Carl Feldman of the decommissionino staff, participated in conducting a workshop on decommissioning regulations at the 2nd Annual Humboldt Decommissioning Conference at Arcata, California, on January 10 and 11 The conference +as sponsored by a public interest group, the Redwood Alliance Educational Collective, and was intended to provide a data base for the public in the area of nuclear reactor decommissioning.
Other invited speakers were Dale Bridenbaugh, a consultant involved with procedures at TMI; R. I. Smith,' Battelle PNL; Vince Schevent of the California Energy Commission; Hal Rubin, a public spokesman on nuclear issues; Philip Greenberg, advisor to Governor Brown of California on nuclear energy; and Barry Hagar, a representative of Senator Moffett of Connecticut, who is on the Congressional Subcommittee on Energy, Environment and Natural Resources.
The keynote speaker was Ralph Nader.
The major reason for having this conference was to discuss issues arising from the possible decommissioning of the Humboldt nuclear reactor, which is currently inoperative. The presentation of the NRC representative on the NRC decommissioning policy reevaluation program was well received. Unanswered questions regarding the possibility of an NRC forced decommissioning of the Humboldt reactor, which many conference attendees felt was a necessary health and safety requirement, as well as the question of final waste disposal, were very intensive issues. Moreover, many attendees felt that more regulatory concern should have been given to decommissioning at a much earlier time and they expressed dissatisfaction with a " history of government irresponsibility" in dealing with serious nuclear issues.
While many of the attendees were anti-nuclear in attitude, they maiatained reasonable objectivity when presented with arguments drawing on appropriate technical data bases.
In general, there was a good degree of information exchange and an encouraging level of interest on major issues.
It was felt that participation by the NRC at this conference was worthwhile in that it provided necessary communication with the public and indicated our degree of responsibility in dealing with nuclear issues that are of major public concern.

Withdrawal of Proposed Class Exemotion 2.
On January 16, 1981, a notice was published in the Federal Register withdrawing a notice of proposed rulemaking published in the Federal Register on April 1,1971, in which the AEC solicited connents on proposed amenceer.ts of its regulations which would establish a class exemption from licensing aquirements for the possession and use of tritium, krypton-SS, or polonium-21C in static elimination devices and ion generating tubes. This action removes the April 1,1971 proposed rule from the Commission's report, " Status of Proposed Rules", but does not preclude the Commission from issuing similar notices in the future or commit the Commission to any course of action with regard to the static elimination and ion generating devices.

, EPA Federal Guidance on Occucational Radiation Protection 3.
EPA has informed the staff that the EPA proposed " Federal Radiation Protection Guidance for Occupational Radiation Exposure" will be published in the Federal Register for public comment on January 23, 1981. Joint EPA /NRC/ OSHA hearings will be announced for Washington, D.C.; Chicago; Illinois, Houston, Texas, and San Francisco, California. Dates, times and addresses for the hearings will be announced in a later Federal Register Notice, but are expected to be held early in April.

'443-5975) 4 Report to Congress On January 19, 1981, EPA concurred on the joint NRC/ EPA " Report to the Congress of the United States of America on the Feasibility of Eoidemiolooic Investigations of the Health Effects of Low-level Ionizing Radiation". The transmittal letters to the President of the Senate and to the Speaker of the House of Representatives were signed by the EPA Administrator. OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending January 23 1981 Radiological Contingency Plannir.g Orders We have prepared but have held up the issuance of radiological contingency planning orders to 60 fuel cycle and major materials licensees to allow the Commission time to review the orders before they are sent out. The orders require the preparation and submittal of information needed to assure that adequate onsite planning is made to protect against and to respond to nuclear accidents.
Initiation of Contract Work on Fuel Cycle Regulations Staff members of Battelle Pacific Northwest Laboratories will be working with NMSS for about a week, starting on January 27, 1981, to review docket files and discuss license application review practices. This will be the initial step under their contract for improving the regulatory base for selected facilities associated with the front end of the fuel cycle.
L US/ Australian Bilateral Agreement A new US/ Australian Bilateral Agreement was put into force on January 16, 1981.
In preparation for the implementation, the NRC provided data to.the State Department on anticipated exports of Australian origin nuclear material during the first quarter of CY 81. We are also preparing an updated report-from the Nuclear Materials Management and Safeguards System (NHMSS)- showing the amounts and location of all Australian origin nuclear material in the U.S. as of December 31, 1980.
Benchmarking of Comouter Codes and Licensing Assistance The proposed competitive procurement, " Benchmarking of Computer Codes and Licensing Assistance," continues to be reviewed by the Commission. Following receipt by the Commission on December 16, 1980, the procurement was subjectad to review and comment by B. D. Liaw, P. Riehm, L. D. Y. Ong, C. Troutman, and L.B. Marsh.- NMSS staff have addressed these comments and resolved nearly all of them with the individuals involved. Unfortunately, accumulated delays which have occurred since writing the Statement of Work in May 1980 have placed actual. placement of the work in FY81 in jeopardy, 9

ITEMS OF IHTEREST OFFICE OF INTERNATIONAL PROGRAMS WEEK ENDING JANUARY 23, 1981 NEA Statenent on Nucler Power Plant Siting The Organization for Economic Cooperation and Development issued a press release on January 9 making available to the oublic the " Statement Concerning the Licens-ing Aspects of Nuclear Power Plant Siting" which was developed last summer follow-ing a special meeting of the NEA/CSNI members to be briefed on the proposed revisions to NRC's siting criteria and for the non-U.S. members to discuss their concerns regarding increased U.S. enchasis on remote siting. Public release of the statement required approval of the NEA Steering Committee, which met in November 1980.

Renewal Arrangement Drafted IP this week drafted an information exchange Arrangement to be proposed to the Brazilian Conissao Nacional de Energia Nuclear (CNEN). The present NRC-CNEN Arrangement is due to exoire May 8, 1981.
Foreign Visits to NRC On Monday, Mr. Y. Yamanouchi, an Attorney and Member of the Siting Criteria Sub-committee of the Japan Nuclear Safety Commission, Mr. T. Sakurae, Deputy Director of the Legal Division of the Shikoku Electric Power Company, Mr. Watanabe of the Overseas Electrical Research Institute, and Mr. H. Hirayama, of the Japanese Science and Technology Agency (STA, NRC's regulatory counterpart), met with R. G. Page, SG; Director, NMSS; and other SG representatives from the Physical Security Licensing Branch, the Material Control and Accounting Development Branch, and the Material Control and Accounting Licensing Branch, to discuss U.S. security philosophy and protective measures for nuclear power plants and fuel fabrication facilities, including MC&A.
On Wednesday and Thursday Dr. Hannes Gert Edelhauser of the German Federal Ministry of the Interior (BMI), and Drs. Christian Streffer, Georg Ingbert 6:ns, Otto Huber and Detlef Fritz Gumprecht, all members of the FRG Radiological Drotection Connission (SSK), met with F. Congel and E. Branagan from the Radio-logical Assessment Branch of NRR; P. Stoddard of the Effluent Treatnent Systems Branch of NRR; L. Soffer of the Siting Analysis Branch of NRR; Brian K. Grines, S. Ranos, E. On Thursday Mr. Ernest Gilby of the U.K. met with Mr. Robert Minogue, RES Director, and with other RES representatives to discuss (1) the status and plans for the U.K. Public Inquiry on Use of the PWR; (2) the current situation with regard to CSNI and the proposed IAEA Advisory Group on Thermal Reactor Safety Research; and (3) the general IEA collabor,ative agreement.
Exoort of Nuclear Technology On January 21 IP received from DOE for NRC review a proposed nuclear technology export request (under 10 CFR Part 810) involving Westinghouse and its French licensee Framatome. The proposal would permit Framatome to export PWR technology to third countries without U.S. review. DOE has requested expeditious action on the request and a Commission action paper will be forwarded shortly with a proposed NRC response.

OFFICE OF STATE PROGRAFS ITEMS OF INTEREST WEEK ENDING JANUARY 23, 1981 Eight representatives from 5 Agreement States will attend.a two week training course, Uranium Mill Licensing and Inspection, beginning January 26, 1981.
The course is coordinated by OSP and will include contributions by NMSS, IE, SD, ELD, Argonne National Laboratory, Texas, and EPA.
On January 12, 1981, Bill Menczer, Regional State Liaison Officer, Region III, was in Fort Sheridan, Illinois, to meet with the Directors of the Illinois Emergency Services and Disaster Agency (ESDA), the Wisconsin Divh ion of Emergency Government, the Iowa Office of Disaster Services, and the Federal Emergency Management Agency Plans and Preparedness Division to discuss upcoming offsite State exercises for the Zicn and Quad-Cities Power Plants.
Following the meeting, Mr. Menczer attended the Lake County Public Officials Conference on " Radiological Emergency Planning" sponsored by the Illinois ESDA and FEMA.
On January 15 and 16, 1981, Dean Kunihiro met with the FEMA Regional Assistance Committee (Region X) in Seattle, Washington to review comments on the Columbia County, Oregon and Oregon State emergency plans.
On Sunday, January 18, 1981, the California State Democratic Committee at its annual State convention voted to oppose the operation of the Diablo Canyon nuclear power plant.
Steve Salomon attended the conference, " Financing S tate and Local Governments in the 1980s," organized by the University of Illinois, the State of Illinois Department of Commerce and Community Affairs and Government Finance Study Commission, and the Farm Foundation, January 16-17 in Chicago.
The meeting was held to explore funding issues related to potential Agreement States and Lcw Level Waste States.
Nationally known economists and financial experts spoke.
Over 250 persons attended.

In connection with his vote for no review, Commissioner Gilinsky provided the following statement:
"I am not inclined to take review of the Director's decision in this case since he does not appear to have abused his discretion.
However, the Policy ~ Statement l
should be interpreted in a manner which will lead to l
sensible results.
In particular, the consideration of Class 9 accidents, in cases where the CP review has been cc=pleted, should come as early as possible so as to avoid the unnecessary expense of modifying what has already ;
been built.
In the long run, it would seem more beneficial l to all the parties, including the applicant, to consider

Class 9 accidents in a supplement to the CP review rather than to postpone such consideration to the OL review."
The Office of the General Counsel was informed of this action by telephone on January 19, 1981.

ACTION PLAN III.A.1.2 - EOF-Memo SECY to Dircks, dtd 1/21/81.
Subseqcent to the October 30, 1980 Commission meeting on the subject =atter, the staff responded by memorandum dated November 12, 1980 in which a number of options were delineated (Enclosure 1 of November 12, 1980 memorandum - a marked-up copy is enclosed).
Among the various options proposed for EOF',s, the Commission approves Option 2 (two facilities) for all reactor facilities licensed or to be licensed for operation.
The Commission also approves a modified option 4 (one facility and no protection factor) for all reactors if the EOF is located at or beyond 10 miles from the reactor with the provision that if the EOF is located beyond 20 miles, specific Commission approval is required *'and arrangements to locate the NRC staff closer to the reactor are provided.
The footnotes in to the. November 12 memorandum apply, as noted on the modified copy enclosed.
The TVA arrpngement for a centralized EOF is acceptable as a special case of Option 4, with the addition of some provisions near each site for the NRC site team.
These provisions need not be elaborate and would be satisfied by a trailer with connections to the TVA emergency communications network.

the Notice should state explicitly th'at the proposed NRC action on West Valley and GE Morrio does not imply that these are to become the national AFR storage facilities; and the Notice should address the possibility that DOE and New York State might become licensees for the West Valley facility, and the implications of such a possibility for financial protection and indemnity requirements.
Chairman Ahearne would have preferred that the staff revise and publish the FRN without referral back to the Commission.
