Your letter dated May 4,1973, transmitted proprietary Report MIL-9211E entitled "Justificativa for Use of Anodized Zirconium Alloy Tubing",
and requested that this report be withheld from public disclosure pursuant to 10 CFR 2.790(b). This report (by Culf United 2:uclear Fuels Corporation) supplied additional information in connection with your non-proprietary request of January 3,1973, for authority to operate Dresden Unit 1 with fuel Casignated Type II as replacenent fuel.
The reason for withholding of Report MIL-9211B was stated to be that its disclosure may jeopardize the competitive and ecotonic advantage of Culf United in that it could enable a competitive fuel supplier to assess current Gulf United design and manufacturing methods and calculational results, and to ernmir.a the test results which were obtained at the expense of Gulf United.
The regulatory staff has --ined the Gulf United report and pursuant to 2.790(b) of 10 CFR Part 2, has approved your request.
