Skovholt, Assistant Director for Operating Reactors, L k'IIIU10LDII;G OF PROPRIETARY REPORT BY GULF UNITED NUCLEAR FU4LS CORPORATION By letter dated May 4, 1973, the Conssonwealth Edison Company transmitted a proprietary Report (MIL-92112) by Gulf United Nuclear Fuels Corporation entitled " Justification for Use of Anodi:cd Zizconium Alloy Tubing" and requested that the report be withheld i
pursuant to Section 2.790(b) of 10 CFR Part 2.
The report provides additional informatlon relating to Commonwealtu Edison's pending non-proprietary request dated January 3,1973, for authority to operate Dresden Unit 1 with a replacement fuel batch consisting ol' fuel designated as Type IX.
In Connnonwealth's letter dated May 4,1973, it is stated that "the information presented in Report MIL-9211B was at the expense of and for the ure of the Gulf United Nuclear Fuels Corporation.
Disclosure of this information to the general public could enable a reload fuel supplier in competition irith Gulf United Nuclear Fuels Corporation to essess current Gulf United design and manufacturing zaetheds and calculational results, to en=ine certain test results perfortaed by Gulf United at its own expense and may result in competitive and economic disadvantage to Culf United."
Af ter reviewing the proprietary report and the non-proprietary request dated January 3,1973, and attempting to achieve an effective balance between legitimate concerns for protection of Gulf United's co=petitive position and the right of the public to be fully apprised as to the operation of,Dresden Unit 1 and its related changes and safety issues, we have concluded that Co'=aonwealth E.dison Corpeny has cade a sufficient chowing that Gulf United's interest could be adversely cffected by disclosure of the information contained in the report. We clso have concluded that sufficient infarmation is contained in the non-propriett-';
1 letter dated January 3,1973, and in other non proprietcry docunents in the public record of Docket No. 50-10 to advise en interected cenbar of the public on the operation of Dresden Unit., use of Type IX fuel and applicable safety considerations.
