Knapp, Chief, Radiation Support Section, FFLMSB SUBJECT: RECOM'iENDATION FOR t%NAGEMENT ENFORCEMENT CONFERENCE WITH FHILADELPHIA ELECTRIC COMPANY Recently, we received for concurrence Combined Inspection Report Nos.' 50-277/80-33 ~ and 50-275/80-26 (a resident inspector's report covering the period November 8-13,1990) The second citation in Appendix A deals with a well documented instance of failure to comply with the Technical Specification 6.11 requirement to adhere to radiation protection procedures. In this instance,-three individuals disregarded posted instructions and crossed through a rope barrier into a high radiation area. Although the proposed letter to the licensee does not identify this as a recurrent item, this is in fact, the case. The attached -Form RSS 5, which is not a complete record, shows that the licensee has been cited in this area at least four times previously in 1980. - - - The proposed letter does point out that, " Item A of Appendix B has been identified during previous inspections." Two prevous instances are listed, apparently involving failures to follow security procedures. - Both the T.S. 6.11 noncompliance and the security noncompliance are identified as Severity Level IV violations. This is certainly appropriate in the case of the T.S. 6.11 item. , '- I believe the record of the inspection reports clearly demonstrates unacceptable , licensee performance in the radiation health and . safety crea and that an - escalated level of Region I action to prevent recurrence is called for. ) I recomend that Regica I calls PECo' management in for an immediate enforcement I conference to specifically identify the continued findings of employee failure to l follow health physics procedural requirements which are important to radiation ! health and safety as: . j 1. A matter of serious concern to the NRC. i ' 2. A matter for which definitive action to prevent recurrence is mandatory.
3. A matter which is being identified to PECo in the context of Section IV.B(2) of the proposed General Staterrent of Policy and Procedure for Enforcement ! i Action. This section reads " Civil Penalties are generally imposed in the folicwing situations ...
