This advises you that the Commission (by a 5-0 vote) has approved the following items in regard to the above subject.

As noted below, Commissioner Gilinsky also would have included a technical specification requiring a minimum number of shifts for operation of the plant in various modes.

1.

The policy statement (attached) on nuclear plant staff working hours should be issued to licensees.

2.

Regulatory Guida 1.33, currently in final stages of revision, should endorse the working hour provisions of Section 5.2.1.6, ANSI /ANS-3.2, taking exceptions as necessary where conflicts exist with the attached policy statement.

3.

A proposed revision to Item I. A.1.3 of NUREG-0737 sho id be provided to the Commission.

The revision shot d include the revised Regulatory Guide 1.33, provisions (as modified by the policy statement) on staff working hours.

4.

The Administrative section of all technical specifications should be revised to require:

A FRN should be prepared stating the background to the staff working hours issue and announcing the policy statement as well as the other actions described in this SRM.

6.

When the policy statement is issued', licensees should be informed by letter of the Commission action on SECY-81-440.

At the same time, licensees also should be advised of staff plans for implemt.ntation of the working hours prevision.

The Commission recognizes that a sufficient number of well rested and alert operators ara as important to safe plant operation as is the availability of the cafety related equipment required in the technical specifications.

Consequently, the NRC st'aff should review available options for control of operator overtime.

One option may be Commissioner Gilinsky's suggestion (attached) that the technical epecifications require a minimum number of shfits for different plant modes of operation.

The staff should report b1ck to the Commission with their recommendations on this subject.

POLICY ON FACTORS CAUSING FATIGUE OF OPERATING PERSONNEL AT NUCLEAR REACTORS Licensees of operating plants and applicants for operating licenses shall establish controls to prevent situations where fatigue could reduce the ability of operating personnel to keep the reactor in a safe condition.

The controls should focus on shift staffing and the use of overtime--key job-related factors that influence fatigue.

The objective of the controls would be to assure that, to the extent practicable, personnel are not assigned to shift duties while in a fatigued condition that could significantly reduce their mental alertness or their decision making capability.

The controls shall apply to the plant staff who perform safety-related functions (e.g.,

senior reactor operators, reactor operators, health physicists, auxiliary operators,'and key maintenance personnel).

Enough plant operating personnel should be employed to maintain adequate shift coverage without routine heavy use of overtime.

However, in the 9. vent that unforeseen problems require substantial amounts of overtine to be used, on a temporary basis, the following guidelines shall be followed:

A break of at least eight hours should be allowed between work periods (including shift turnover time),

The use of overtime should be considered on an individual basis and not for the entire staff on a shift.

Recognizing that very unusual circumstances may arise requiring deviation from the above guidelines, such deviation shall be authorized by the plant manager or his deputy, or higher levels of management.

The paramount consideration in such authorization shall be that significant reductions in the effectiveness of operating personnel would be highly unlikely.

In addition,' procedures are encouraged that would allow licensed operators at the controls to be periodically relieved and assigned to other duties away from the control board during their tour of duty.
