Inspection 50-333/81-21
This refers to the routine safety inspection conducted by ifr. J. Linville of
this office on September 1-30, 1981, at the J. A. FitzPatrick fluclear Power
Plant, Lyconing, New Yo-k, of activities authorized by NRC License No. DPR-59
and to the discussions of our findings held by ifr. Linville with yourself and
other nenbers of your staff at the conclusion of the inspection.
Areas examined during this inspection are described in the Office of Inspection
and Enforcement Inspection Report which is enclosed with this letter. Within
these areas, the inspection consisted of selective examinations of procedures
and representative records, interviews with personnel, and observations by the
inspector.
Based on the results of this inspection, it appears that one of your activities
was not conducted in full compliance with NRC requirements, as set forth in the
Notice of Violation, enclosed herewith as Appendix A.
This item of noncompliance
has been categorized into the levels described in the Federal Register Notice
(45 FR 66754) dated October 7, 1900.
You are required to respond to this letter
and in preparing your response, you should follow the instructions in Appendix
A.
In accordance with 10 CFR 2.790 of the Comission's regulations, a copy of this
letter and the enclosures will be placed in the NRC's Public Document Roon.
If
this report contains any infomation that you (or your contractors) believe to
notify this office by telephone within ten (10)) days from the date of thisbe ex
letter of your intention to file a request for withholding; and (b) submit
within 25 days from the date of this letter a written application to this office
to withhold such information. Consistentwithsection2.790(b)(1),anysuch
application must be acconpanied by an affidavit executed by the owner of the
infomation which identifies the document or part sought to be withheld, and
which contains a full statement of the reasons on the basis which it is clained
that the infomation should be withheld from public disclosure. This section
