Notice of Violation and Additional Information - 10CFR50.54(f),. dated July 17, 1980. The referenced response was reviewed to determine if it was consistent with NRC's request for information and to assess if the licensee's planned reviews and schedule were appropriate. Participants in this review included Messrs. Bishop, Dodds, Haist, Haynes and Toth of the Region V staff. In addition, comments were received from J. Taylor, RCI,IE:HQ. The results of this review follow. Information Provided Consistent with NRC Request It was found that the licensee's response was consistent with NRC's request: The information requested is listed below along with a reference to the licensee's response where this matter is adequately addressed.
- 1. " Submit plan and schedule for completion of reviews of safety related work accomplished by contractors not having an approved NRC program."

Memo to the File. 2. The review should cover the following considerations: a. application of quality procedures and specifications to the
- work, b.
qualifications of personnel performing and inspecting work, c. receipt inspection requirements and reasons why deficiencies weren't detected, d. dispositions for nonconformance reports, design changes, field change requests, and information requests, completeness and accuracy of quality and test records. e. Suitable plans for assuring these considerations are provided in the reviews are covered in Attachment I of the licensee's response as follows: a. Sections E, 2.3.1 for records review and E, 2.5 for related hardware inspections. b. Sections E, 2.3.2 for records review and E, 2.5 for related hardware inspections. c. Section E, 2.4. d. Sections E, 2.3.3 for records review and E, 2.5 for related hardware inspe.tions. e. Sections E, 2.3.4 for records review and E, 2.5 for related hardware inspections. 3. Plan should include: - Rationale for selection of contractor items for review (covered in Attachment I, Section E, 2.1 and Attachment 2) - provision for reporting results to NRC (covered in Attachment I, Section E, 2.6.2) - provision for reporting to the NRC repairs or further action to be taken for deficient or questionable items (covered in Attachment I, E, 2.6.2 and page 3 of cover letter) - provisions to apply lessons learned to other WNP projects (covered in Attachment I, Sections B and E, 2.6.1) a r o
Memo to the File. 4. If an interim reply, give schedule for completion of response. (covered in page 3 of cover letter, Attachment I, Section D) Assessment of Plans for Reviews and Schedules - The farmation of task forces of knowledgeable engineering and manage-ment personnel to focus attention on the actions required and to divide the work into phases (short term, intermediate and continuing) is a logical and proper approach to managing the effort. - The authorities and responsibilities of the task forces are suitably defined and are consistent with the intent of those actions we believe are necessary foF~the licensee's development of a meaningful review and corrective action program for deficient construction contractors. - Concerns were expressed by Taylor and others regarding the amount of hardware inspections to be performed. It was believed the licensee may take a " paper oriented" approach for the review. 'ais concern was discussed by R. C. Haynes on different occasions with R. Ferguson, D. Renberger and R. Johnson of the licensee's organization. Taylor suggested a more firm commitment in line with Mil. Standard 105 may be appropriate. This suggestion was considered at length by Haynes and A. D. Toth and discussed by Toth with the licensee. It was found that the inspections required and the areas of NRC's concerns are not amenable to a broad commitment to the statistical approach of the Mil. Standard. Rather, upon further consideration, it was concluded that the approach outlined by the licensee in the response and exemplified by examples and charts in attachments' thereto provide reasonable assurance that the reviews will include substantive hardware' inspections. Further, this concern and caution against mere paper reviews were stated by the staff in the management meeting with WPPSS personnel on August 12, 1980 at the RV Office, and assurances were obtained from R. L. Ferguson, Managing Director, that hardware inspections vould be a critical part of the review effort. This concern should be lessened further in view of Mr. Toth's assignment as Resident Inspector at WNP-2 such that a timely and continuing examination of the licensee's review efforts and findings are provided. - Evidence to date of the licensee's actions to bring additional engineering talent to bear on the quality efforts at WNP-2, including the establishment of the Burns and Roe design force to the Richland area and assignment of key personnel to the effort, gives reasonable assurance that the review program will be meaningful, responsive to our concerns and will provide results which will be key to the NRC's determination of whether the facility is constructed in substantial conformance with the safety analysis report. s A
