REQUEST FOR EXEMPTION FROM 10 CFR 55.33 WRITTEN EXAMINATION AND OPERATING TEST REQUIREMENT FOR APPROVAL OF AN INITIAL APPLICATION On October 27, 1993, Region II of the U. S. Nuclear Regulatory Commission (NRC) received your application for a senior operator license at the Catawba Nuclear Station.
In the application dated October 27, 1993, you requested a waiver of the written examination and operating test requirements in Section 55.33(a)(2) of Title 10 of the Code of Federal Reaulationi (10 CFR 55.33(a)(2)), in accordance with the provisions of 10 CFR 55.47,
" Waiver of Examination and Test Requirement."
The senior operator license (S0P-20798) previously held by you for the Catawba Nuclear Station was terminated by letter from the facility licensee dated October 28, 1991, based on the licensee's determination that having ceased licensed duties, effective January 1, 1991, you no longer needed a license in order to perform your job. Therefore, you do not meet the requirement of 10 CFR 55.47(a)(1) to have had extensive actual operating experience within two years before the date of application. The NRC cannot waive this requirement because it is part of the regulation. However, 10 CFR Part 55.11 allows @ Commission to grant exemptions from the requirements of 10 CFR Part 55, either upon application by an interested individual or upon its own initiative, if it determines such exemptions are authorized by law, will not endanger life or property, and are otherwise in the public interest.
Even though you requested a waiver of a regulatory requirement, the staff considers your request as equivalent to an exemption request, in that you would have submitted the same information and would have requested the same resolution of your situation.
The NRC has considered the information supplied in your request, your extensive licensed operating experience at the Catawba Nuclear Station, the preparation and training in the operating procedures for the facility that you have received in support of your license reapplication, and the certification by an authorized representative of Catawba Nuclear Station regarding your past performance.
Specifically, the NRC has considered that:
1.
You successfully completed an NRC administered requalification examination in April 1991.
Your written score was 98.3 percent, you passed 100 percent of the JPMs, and you passed the simulator operating examination.

You were Instructor certified in January 1991.

You have maintained your instructor certification by attending operational proficiency lectures to remain current on plant modifications, procedure changes, and industry incidents and by participating in instructor in-plant observations (96 hours0.00111 days <br />0.0267 hours <br />1.587302e-4 weeks <br />3.6528e-5 months <br /> per-year).

You passed an annual instructor written examination in 1991 and 1992 with scores of 93 percent and 95 percent respectively. This included a Part A and Part B examination comparable to the written examination given to licensed operators.
5.
You have taken the lead responsibility for JPM development and administration since January 1992. Additionally, you have given training to instructors on administration of JPMs.
6.
You have been and are currently involved in licensed operator requalification training, instructing integrated pl. int operations in both classroom and simulator settings.
You have been responsible for the development, presentation, and evaluation of this training.
The NRC has determined that granting you an exemption from the written examination requirements of 10 CFR 55.33 will not endanger life or property and is otherwise in the public interest. Therefore, the NRC grants you an exemption from the written examination requirements delineated in 10 CFR 55.33(a)(2).
The NRC interprets 10 CFR 55.47(a)(1) to mean that an applicant should have had actual recent operating experience at the facility.
Since it has been almost three years since you have had actual operating experience, you will be required to take an operating test at your facility.
Region II will contact your facility to establish a date for administering the operating test to you.
