CONFORMING AMENDMENTS TO TITLE 10 CODE OF FEDEAL REGULATIONS FOR URANIUM ENRICHMENT REGULATION Following are further comments for your consideration on the proposed rulemaking package for amending the regulations for uranium enrichment licensing. These comments have been coordinated with Joanna Becker, Office of the General Counsel, and Lois Telford, Division of Security.
1.
FR notice, page 3, first paragraph, last sentence.
Revise this sentence to read "... such as controlling the export of specially designed or prepared uranium enrichment equipment and preservation..."
2.
FR notice, page 4, first full paragraph.
Revise the two sentences to read " Uranium enrichment facilities remain production facilities for chapters other than Chapter 10 " Atomic Energy Licenses" and Chapter 16
" Judicial Review and Administrative Procedure" of the Act. Therefore, there is no change for purposes of controlling the export of specially designed or prepared uranium enrichment equipment and the preservation of...."
Also, refer to the May 24 memorandum from the Office of Governmental and Public Affairs and disregard comment number 2 to add the words "or import."

This paragraph should be revised to read as follows:

" Production facility" means any nuclear reactor or plant specially designed or used to produce special nuclear material through the irradiation of source material or special nuclear material, the separation of isotopes or the chemical reprocessing of irradiated source or special nuclear material. As used in this part, production facility includes a uranium enrichment facility.
(The revision adds the last sentence which is the same last sentence of proposed $150.3.)

FR notice, page 29, paragraph 32.
Paragraph 32.should-be deleted.
Adding uranium enrichment facility to 9110.9 was proposed for the purpose of clarifying that a uranium enrichment facility is under NRC's import licensing authority. The revision is unnecessary, however, because we have proposed (Number 4) that this clarification be indicated in the definition of production facility.
We concur if these comments are addressed in the rulemaking package.
