CONFORMIfiG AMENDMENTS TO TITLE 10 CODE OF FEDERAL REGULATIONS FOR URANIUM ENRICHMENT REGULATION We have reviewed the proposed rulemaking package for amending the regulations for uranium enrichment licensing as directed by Congress.
The following comments are provided for your consideration.
1.
Congnission paper, page 2, f;ote (b):
The citation of 10 CFR 51.22(c)(1) does not apply to Parts 40, 50, 51, and 70.
In order to apply the categorical exclusion for these Parts the reference needs to be expanded to include 10 CFR 51.22(c)(3}.
This would revise the citation to read "10 CFR 51.22(c)(1) and (3)." This citation should also be revised on page 5 of the Federal Reg _is_ter (FR) notice, Environmental Impact: Categorical Exclusion, line 2.
2.
FR notice, page 4, first full paragraph, line 4: Revise this line to read "the export or import of uranium enrichment equipment and the...."
3.
FR notice, page 12, s 40.33(a): Add the word "The" to the beginning of this section.
4.
FR notice, page 23, last sentence:
This sentence should be revised to read the same as the last sentence of proposed 9 40.33(a).
These two sections are describing the same hearing and should be worded the same to avoid any confusion.
We concur if these comments are addressed in the rulemaking package.
