Gentlemen:

This letter refers to the September 15-18, 1980, routine inspection conducted by

Mr. R. A. Caldwell of NRC's Region IV Office. The activities inspected were

those that are authorized under NRC License No. DPR-46.

It further refers to

the discussion that he had with your staff concerning his findings at the

conclusion of the inspection.

The inspection related to your program and activities designed to protect

against industrial sabotage and to safeguard special nuclear material. The

inspection was based on the applicable provisions of Title 10, Part 50, of

the Code of Federal Regulations, entitled, " Licensing of Production and

Utilization Facilities," within Part 73 entitled, " Physical Protection of

Plants and Materials," and the specific r2quirements of NRC License No. DPR-46.

The inspection consisted of selective examinations of procedures and records,

personnel interviews, and observations by the inspector.

Within the scope of this inspection, an apparent item of noncompliance relative

to the frequency of review of your security plan was identified. However, in

view of an apparent conflict between the "words and meaning" of 10 CFR Part 73.55

and the applicable words of your security plan, this matter will not be treated

as an item of noncompliance.

Instead, resolution has been accomplished in

accordance with our Immediate Action Letter to you, dated October 9, 1980

as discussed in the Details Section of the attached report.

The documentation of findings of your security procedures for safeguarding

special nuclear materials and your facility's security procedures are exempt

from disclosure.

This exemption is covered within Title 10 CFR, Part 2,

Section 2.790(d), entitled, " Rules of Practice for Domestic Licensing
