SUBJECT:
WOOD SITE STUDY By letter dated August 15, 1975 (Enclosure 1), Wisconsin Electric Power Company (WEPC) tendered an application witn -the Comission for an 'early site review of the Wood Site.
In their submittal, WEPC indicated that they were not applying for a construction permit for the Wood Site, but were submitting the infor-mation in the context of the Comission's March 11, 1974 announcement of'the policy for reviewing future potential nuclear plant sites in advance of an application for a CP and also in the context of the Comission's proposed legislation for early siting approval.
An acceptance review was begun by NRR on October 1, 1975, using the same guide-lines as a CP application since no early site review guidelines were available.
In a letter to WEPC dated January 9, 1976 (Enclosure 2), the Acting Director (Boyd), Division of Reactor Licensing (DRL), indicated that the staff had completed the acceptance review of the application and concluded that the site addenda and environmental reports were not sufficiently complete to initiate a detailed early site review. DRL requested additional information in support of the application.
WEPC responded by letter on March 8,1976 (Enclosure 3), indicating that they were unwilling to provide the additional detailed data on the Wood Site presumably preferring to wait for more specific guidelines for early site review to be developed by the Comission. They requested a meeting to discuss the matter.
The meeting was never held.
On April 22, 1976, the Comission published in the Federal Register a statement of proposed policy and amendments to the regulations (Parts 2 and 50/ Appendix Q) to provide for early review of the suitability of potential sites for nuclear power facilities. The proposed policy and amendments were transmitted to WEPC by letter dated May 13, 1976, (Enclosure 4).
In reviewing the record, I can find no other correspondence after May 13, 1976 from WEPC ccncerning the Wood early site review application.
Discussions with representatives in NRR, indicates that they considered the aoplication a tendered application which was never docketed because of information deficiencies.
Since the application was never docketed, NRR does not consider it a formal application.

Files SI they have no further information concerning the status of the application.
Presumably, the application is no longer valid since it was not acceptable by NRR and WEPC never supplied the additional data requested by the Commission.
With respect to fees for the manpower expended on the application, no fees should be assessed for the Wood Site study because (1) at the time the early site review application was filed in 1975 there were no fees in Part 170 for early site reviews and (2) if the application were valid after March 23, 1978, (I can find no evidence that it is a valid application) we should consider the application as a 10 CFR 50, Appendix Q, filing since a CP application was never filed for the Wood Site.
The Amendment to 10 CFR 170 which became effective 3/23/78 provides that Appendix Q early site review applications on file prior to 3/23/78 are exempt from license fees.
