I would like you to ado two items to Enclosure A, the PDblic Infonnation Circular:
First, describe what we must release and why (probably due to the provisionsinP.L.96-295).
Second, what are we releasing because we want to and why.
In Enclosure B, rqy letter to the Governor, I would appreciate a revision that would explain what is the purpose of the letter and whether we want a response.
If possible, estimate when we will be requesting the Governor's comments on the notification requirements and please explain what is a " pre-release copy." I believe the Governor would infer we are sending him a copy of a report that is not yet released to the public.
That, I gather, would not be correct.

' The following changes are to be incorporated into Enclosure "A" of SECY-80-245C effective.0ctober 2,1980:
1.
The Preface to Enclosure "A" is amended by replacing the first paragraph with the following paragraph (while the second paragraph remains the same):
This circular has been prepared in response to' numerous requests for infonnation regarding routes used for the shipment of irradiated reactor (spent) fuel and to meet the requirements of Public Law 96-295. The Nuclear Regulatory Commission staff must approve such routes' prior to their first use, in accordance with the regulatory provisions of 10 CFR Part 73.37. Tne NRC believes that the design and construction of the casks used to ship the spent fuel provide adequate protection of the public health and safety against accidents.
Ther'efore, transporting appropriately packaged spent fuel over existing rail systeme and via any highway system designed to bear the weight is safe without specific NRC approval of the route. However, to provide additional protection against actual or attempted acts of sabotaget NRC requires advance route approval. Thus the additional safeguards regulations contained in 10 CFR Part 73.37 were aimed exclusively at protection against radioactive dispersal caused by malevolent acts by persons.
