This refers to your letter dated October 16, 1980, in response to our

letter dated September 29, 1980.

Thank you for the explanations documented in your letter concerning the

items of noncompliance which we cited. Our specific coments on your

responses are presented below.

With respect to item A, the fact that this item was identified by a Radiation

Protection Technician independent of the NRC inspector's activities is irrele-

vant in view of the fact that the inspector identified the item independent

of any licensee activities and prior to the discovery by any licensee personnel.

In addition, the inspector notified the Health Physics office prior to going to

the Radiation Protection Supervisor's office to discuss the item.

With respect to item B, your statement that this item was promptly identified

by station personnel independent of NRC inspection activities is in error.

In

fact, the individual involved was acccmpanied to the Health Physics office

adjacent to the monitoring and change area by the NRC inspector.

At that

time, the NRC inspector notified radiation protection personnel of the potential

spread of contamination and the circumstances discussed in item A.

In addition, your reference to SECY-80-139H, " Policy Session Item" is inappro-

priate.

Federal Register, Volume 45, No. 196, " Proposed General Statement

of Policy and Procedure for Enforcement Actions," issued for coment on

October 7, 1980, published the NRC's proposed general statement of policy

concerning the new enforcement criteria and categories. These new enforcement

criteria and categories will become effective for routine Region I inspections

starting after November 16, 1980. The issue date of the Federal Register

notice was subsequent to the completion of IE Inspection No. 80-28 (August 29,

1980); therefore, items A and B, discussed above, Wm categorized into the

levels as described in our correspondence to yo" ut% December 31, 1974.
