Gentlemen:
Subject: Combined Inspection Nos. 50-277/80-08 and 50-278/80-07
This refers to the routine inspection conducted by Mr. Curtis J. Cowgill of
this office on April 1-30, 1980, at Peach Bottom Atomic Power Station, Units 2
and 3, Delta, Pennsylvania of activities authorized by NRC License Nos. DPR-44
and DPR-56 and to the discussions of our findings held by Mr. Cowgill with
Mr. W. T. Ullrich of your staff at the conclusion of the inspection.
Areas examined during this inspection are described in the Office of Inspection
and Enforcement Inspection Report which is enclosed with this letter.
Within
these areas, the inspection consisted of selective examinations of procedures
and representative records, interviews with personnel, and observations by the
inspector.
Our inspector also verified the steps you have taken to correct the item of non-
compliance brought to your attention as Item 'C' in a letter dated September 27,
1979. We have no further questions regarding your action at this time.
Based on the results of this inspection, it appears that certain of your activi-
ties were not conducted in full compliance with NRC requirements, as set forth
in the Notice of Violation, enclosed herewith as Appendix A.
This item of
noncompliance has been categorized into the levels as described in our corre-
spondence to you dated December 31, 1974.
This notice is sent to you pursuant
to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2,
Title 10, Code of Federal Regulations.
Section 2.201 requires you to submit to
this office, within twenty (20) days of your receipt cf Sis notice, a written
statement or explanation in reply including:
(1) corre:etive steps which have
been taken by you and the results achieved; (2) corrective steps which will be
taken to avoid further items of noncompliance; and (3) the date when full compli-
ance will be achieved.
Item B in the enclosed Notice of Violation is for failure to adhere to Radia-
tion Work Permit (RWP) requirements for reading an RWP, signing in on the RWP,
and for providing data upon exiting the RWP area. That item is recurrent to

a previous Notice of Violation, enclosed with our letter of November 14, 1979,
which cited eleven failures to provide data on exiting RWP areas between
September 18, 1979 and September 20, 1979, and failure of two individuals to
sign in on an RWP and provide required date upon entering an RWP area on
September 24-25, 1979.
Item B is also recurrent to another previous Notice of
Violation, enclosed with our letter of February 8,1980, which cited a November 8,
1979 failure to sign in on an RWP and provide required data upon entering an
RWP Area.
In response to the previous citations, your December 4,1979 letter
stated that the individuals involved had been instructed to use correct RWP
procedures and that training on RWP compliance was being upgraded, and your
March 21, 1980 letter stated that personnal had been reminded of the importance
of adherence to RWP procedures and that the need for procedure changes would be
evaluated.
Since this specific violation has again recurred, it appears that
your corrective actions have not been effective.
Recurrent items of noncompli-
ance are given additional weight in the consideration and selection of enforce-
ment action.
Therefore, in your reeponse to this letter, you should give parti-
cular attention to the actions taken to ensure that failure to adhere to RWP
requirements does not racur agair.
In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2,
Title 10, Code of Federal Regulations, a copy of this letter and the enclosures
will be placed in the NRC's Public Document Room.
If this report contains any
information that you (or your contractorl believe to be proprietary, it is
necessary that you make a written application within 20 days to this office to
withhold such information from public disclosure.
Any such application must be
accompanied by an affidavit executed by the owner of the information, which iden-
tifies the document or part sought to be withheld, and which contains a statement
of reasons which addresses with specificity the items which will be considered by
the Commission as listed in subparagraph (b)(4) of Section 2.790.
The informa-
tion sought to be withheld shall be incorporated as far as possible into a sepa-
rate part of the affidavit.
If we do not hear from you in this regard within
the specified period, the report will be placed in the Public Document Room.
