Sylvia dated October 8,1980, responding to our letter and Notice of Violation dated September 15, 1980. We have reviewed your position that the cask and liner were properly labeled with a placard at the time of shipment. Our citation did not address the issue of vehicle " placarding" under 49 CFR 172.516, but instead the lack of " marking" under 49 CFR 173.392(c)(8). Further review of the information in your response, and our subsequent inquiries indicate that the liner was a sufficient container and shield for the LSA radioactive materials, even though this could not be determined at the time of the inspection. Therefore, based on the definitions of " Marking", "Outside Container", " Package", and " Freight Container" under 49 CFR 171.8, we now conclude that the marking of the liner was sufficient and that the cask, as used in this shipment was not required to display the " Radioactive-LSA" marking.
