U.S. NUCLEAR REGULATORY COMMISSION REVIEW OF EXPORT LICENSE APPLICATION PXB227.00

Dear Mr. Pettigrew:

I am writing to update you on the status of your export license application (PXB227.00).

The application is currently under review by the U.S. Nuclear Regulatory Commission (NRC),

for the export of Category 2 quantities of americium-241 (Am-241), not to exceed 22.2 TBq, and cesium-137 (Cs-137), not to exceed 6.3 TBq; 2) below Category 2 quantities of cobalt-60 (Co-60), not to exceed 7.4 E-3 TBq and radium-226 (Ra-226), not to exceed 11.1 E-6 TBq; 3) cobalt-57, not to exceed 4.44 E-2 TBq; and hydrogen-3, not to exceed 6.48 TBq; and 4) potassium-40, as potassium chloride not to exceed 5 E-7 TBq. Title 10 of the Code of Federal Regulations (10 CFR) 110.40(d), states in part, if the Commission has not completed action on a license application within 60 days after receipt of the Executive Branch (EB) judgement, the NRC is required to inform the applicant in writing of the reason for the delay.

Because the application involves an embargoed destination, the regulatory review is complex, requiring reviews from several technical offices, as well as the Offices of Executive Director of Operations and Office of the General Counsel. The next review stage is the final review - which is the Commission review.

The NRC received the final EB judgment on June 5, 2019, but additional time is needed for NRC staff and management to complete its review of the export application.
