Gentlemen:

Thank you for your letter af June 23, 1980, informing us of steps you have

taken to correct the item of noncompliance concerning activities under NRC

Operating License Nos. DPR-32, DPR-47 and DPR-55, brought to you attention

in our letter of May 23, 1980. We have reviewed your response to the item

of noncompliance and discussed it further with R. Gill of the Duke Power

Corporate Offices, and R. Bond of the Oconee Plant staff. The following

statement should summarize the clarification established, during that review

and discussion, of the reporting requirements applir,able in instances of

missed surveillance tests.

Any missed surveillance test of a system or component meeting one of the

"

three criteria listed in the June 23 letter is reportable regardless of the

results of subsequent testing, based on your definition of operability.

From the time that the surveillance becomes overdue, that untested component

or system is inoperable and must be reported as such under Technical Speci-

fication 6.6.2.1.b.(2).

However, this does not relieve you of the need to

comply with Technical Specification 6.6.2.1.b.(3), against which the subject

citation was written.

It is our intent to interpret your response to the item of noncompliance as

a commitment to comply with the reportability requirements as clarified above.

If you have any additional comments or questions regarding this problem, we

will be glad to discuss them with you.
