'This letter refers to the routine NRC Region ! Inspection conducted on October
10-13 1989, at the Calvert Cliffs Nuclear Power Plant, Units 1 and 2, Lusby,
Maryla,nd, which identified two violations of NRC requirements, one each in the
,
areas of transportation and solid radwaste.
The report of the inspection was

sent to you on October 20, 1989. On November 1, 1989 an Enforcement Conference
was held with you and other, members of your staff to discuss these violations,
their causes, their repetitive nature, and your corrective actions.
,
These violations are described in the enclosed Notice of Violation. One
)
violation involved two spent resin shipments being sent to the Barnwell, South
'
Carolina Low-level Radioactive Waste Disposal Facility with improper
,
manifests. The other violation involved your continued use of radioactive
!
waste scaling factors which were not correlated with actual plant
,
measurements.
Of concern to the NRC is the fact that similar violations were

were inadequa)te to prevent a recurrence.

The violations are classified as Severity Level IV in accordance with the
" General Statement of Policy and Procedure for Enforcement Actions", (10 CFR 2, Appendix C), (Enforcement Policy) (1989).
Since these violations were
repetitive the enforcement conference was conducted to emphasize that
whenever Violations are similar effective corrective actions must be taken to
prevent recurrence.
You should recognize that any similar violations in the
future may result in escalated enforcement action including the issuance of a
civil penalty.

You are required to respond to this letter and in preparing your response, you
should follow the instructions in Appendix A.
In addition to responding to the
!
specific items of the enclosed Notice of Violation, the NRC requests that you
also respond to the following NRC concerns raised during the inspection and
subsequent Enforcement Conference.

1.
Your management system apparently was not adequate to ensure that
corrective actions for previously identified items, particularly in the
radioactive waste shipment and waste analysis areas were implemented
completely in a timely fashion. Therefore, you are requested to describe
the actions taken or planned with respect to your " corrective action"
,
system to ensure that any items requiring resolution or correction,
whether identified by the NRC, your staff or contractors, are evaluated,
resolved and verified in a timely manner.

There was an apparent lack of independent review of procedures, hipping

activities and corrective actions in the radwaste processing, dress the
'

and transportation areas.
Therefore, you are requested to ad
actions planned to ensure that appropriate independent reviews of these
areas are completed.
3.
You are requested to provide the iron-55 scaling factors utilized prior
,
to November,1989, and compare those results to the iron-55 scaling
factor based upon the June, 1989, scaling factor analysis,
in

addition, please provide an analysis of the effect of the new iron 55
scaling factor on radioactive waste shipments made in 1988 and 1989,
including transportation and waste classification.
The information requested in items 1-3 above should be provided at the same
time as your response to the Notice of Violation and should detail the dates
of completion or schedule for completion of each action,
further, you are
requested to inform us when you have completed and verified to be complete the
corrective actions resulting from these violations and your actions in
response to items 1 and 2 above.
,
The responses directed by this letter and the accompanying Notice are not
subject to the clearance procedures of the Office of Management and Budget as
required by the Paperwork Reduction Act of 1980, PL 96-511.
