FORT ST VRAIN FIRE PROTECTION SCHEDULE The staff has evaluated your letter dated June 16, 1989; in particular, those i
sectiont dealing with fire protection modifications required by 10 CFR Part 50, Appendir R.
Section 10 CFR 50.48, " Fire Protection," and Appendix R to 10 CFR Part 50, " Fire Protection Program for Nuclear Power Facilities Operating Prior to January 1,1979," set forth certain protection features required to satisfy the General Design Criterion related to fire protection (10 CFR Fart 50, Appendix A, Criterion 3). Section 10 CFR 50.48 contains a complete discussion of the schedular requirements licensees are to follow in implementing Appendix R to 10 CFR Part 50.
10 CFR 50.48(c)(2) requires that licensees complete all modifications required f
to satisfy Ap)endix R. and not requiring prior R C approval or plant shutdown, within 9 montu after tSe effective dato of 50.48 end Appendix R, which was

rebruary 17, 1980. However, you requested exemption from portions of Appendix R applicable to Fort St. Vrain and on May 18, 1988, the NRC approved that exemption and the actions you proposed to take in order to achieve the same degree of
-i safety as required by the regulations. Th9 exemption did request relief from the schedule required by 50.48(c)(2), but because you could not implement the modifications you proposed in your exemption request until the staff approved it ar.d issued a safety evaluation (SE) on your proposals, the staff considers that the time for implementing the modifications began to run from the time the date of issuance of the SE. Accordingly, these modifications should have been completed by February 10,1989.

The staff has received from Public Service Company of Colorado a number of comit-ments concerning fire protection modifications.
By letter dated April 29, 1987, you comitted to complete the emergency lighting system by August 26, 1987 and the fire detection system by May 15, 1987.
By-letter dated August 21, 1987, you j
modified this comitment to complete' emergency lighting by January 15, 1988, and fire detection by february 1,1988.
By letter dated January 15,1988, you modified this comitment to complete emergency lighting by March 1,1988.
By letter dated July 8,1988, you reported that emorgency lighting and fire detection were physically complete.
However, by letter dated January 20, 1989, i
you proposed a new completion schedule for emergency lighting hnd fire detection of June 30, 1989.
By your letter dated June 16, 1989, you again modified this proposal and comitted to complete emergency lighting by October 1,1989, and fire detection by August 15, 1989. Additionally, you comitted to complete all fire protection modifications by October 31, 1989.
