APPENDIX A NOTICE OF VIOLATION License do. SOP-1585-4 Docket No. 55-3930 Based on the results of an NRC inspection conducted on March 3-21, 1980, it appears that one of your activities was not conducted in full compliance with conditions of your senior operator's license as indicated below.

Senior Operator License No. SOP-1585-4 states in part that, "In directing the licensed activi".ies of licensed operators and in manipulating the controls of the above facility...the licensee shall observe the operating procedures and other conditions specified in the facility license which authorizes operation of the-facility..."

Technical Specifications 3.7.C.1 requires that secondary containment integrity be maintained whenever irradiated fuel movement is in progress.

Technical Specification 6.8. A states in part:

" Written procedures and administrative policies shall be established, implemented ar.d maintained that meet or exceed the requirements and recommendations of Sections 5.1 and 5.3 of ANSI N18.7-1972 and Appendix A of USNRC Regulator, Guide 1.33..."

Pilgrim Nuclear Power Station. (PNPS) Procedure 4.3, " Fuel Handling", Revision

- 18,. requires that prior to commencement of fuel handling operations, a meeting of the Operations Review Committee (ORC) shall be convened to review existing plant conditions to ensure that all requirements are met and further fuel movement may not begin until the "on-duty" Watch Engineer receives approval from the ORC.

Contrary to the above, on March 8,1980, when on duty as the licensed senior reactor operator on the reactor building refueling floor, you initiated refueling activities without verifying secondary containment integrity confor-mance to Technical Specification 3.7.C.1 and without verifying conformance with the requirements of PNPS Procedure 4.3.

Your noncompliance with the require-ment of your license was a principal factor in the movement of irradiated fuel within the spent fuel pool without secondary containment being established.

This'is a violation.

This Notice of Violation is sent to you pursuant to the provisions of Section 2.201 of the.NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations.

You are hereby required to submit to this office within twenty-five days of the date of this notice, a written statement or explanation

.in reply, ~ including for each item of noncompliance:

(1) admission or denial of

-the. alleged item of noncompliance; (2) the reasons for the item of noncompliance if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further items of noncompliance; and (5) the date when full compliance will be achieved.
