SUMMARY

OF KEY EVENTS WEEX ENDING MARCH 14, 1980 Division of Security On March 13, 1980, a letter from Patricia Norry, Deputy Director, Office of Administration, forwarded a copy of the recently approved 10 CFR Parts 25 and 95(dealino with access authorization for licensee personne) to approximately twenty facilities.

United Nuclear Corcoration, Wood River Junction Because of current restrictions on connercial waste burial operations;.

United Nuclear Corporation may not be able to meet the date set for final decommissioning of their fuel recovery plant. License SNM-7777 was conditioned in January,1979 to require decontamination and decommissioning of the lagoons by July 1,1982 due to containment problems with process wastes stored in lagoons on the site.

Visit to Nonoower Reactor Sites Safeguards representatives visited nonpower reactor locations at the General Electric facility, Vallecitos, California, UCLA, Los Angeles, California, and General Atomics, LaJolla, California. The visit was cart of an overall NRC effort to determine whether these nonpower reactors should be classified as Category I and thus required to protect their SSNM according to the interim requirements in the Safeguards Upgrade Rule.

Soent Fuel Shioments Aporoval was given to Transnuclear, Inc., and Edlow International to continue using Portsmouth, Virginia, for importe of spent fuel.

Neither the licensees nor the staff were able to identify a practical alternative to the port of Portsmouth.

Several local governments and authorities in New York, North Carolina and South Carolina have recenity enacted ordinances or resolutions regarding spent fuel shipments.

DIVISION OF RULES AND RECORDS 0FFICE OF ADMINISTRATION The Executive Directcv for Operations has issued a minor amendment to the Notice of ty:tems of Records which establishes a new system of records entitled Document Control System, NRC-29.

The purpose of the new system is to enable the agency to maintain document control for all docurents originated by or received by the NRC and to serve as an information source for these documents.

The system incorporates existing system NRC-26, and when the new system NRC-29 becones effective, existing NRC-26 will be deleted. The Executive Director for Operations has also issued a final amendment to 10 CFR Part 9 which exempts from certain requirements of the Privacy Act portions of the new NRC-29.

The exemptions are intended to prevent access to records that contain infornation specifically authorized under Executive Order (E.0.12065) to be kept secret in the interest of the national security and foreign policy.

During the week of March 10, 1980, 6 individuals were approved for NRC employment prior to the completion of the required investigation and report under Section 145b of the Atomic Energy Act of 1954, as amended, under the authority delegated to the Executive Director for Operations by the Commission. During this same period, 21 requests from various NRC offices and divisions were received by PERSEC to initiate such processings.

Foint Beach Unit 1 This unit is currentiy dcwn for the steam ganerator tube inspection required by Co.7.T.ission staff order.

Preliminary evaluation of the inspection results indicate 18 tubes in SGA and 24 tubes in SG3 had eddy current indications.

All but one of these indications were below the top of the tube sheet in the crevice region.

The staff expects to recuire tubes to be pulled for evaluation prior to allcwing Unit 1 to restart.

fior*.h Anna Unit 1 Following a reactor trip on February 20, 1980 intermittent high frequency noise signals were indicated on the plant's Loose Parts Monitoring System (LPMS). On February 22, 1980 the plant was allowed to proceed with power operations based upon an increased frequency of monitoring for loose parts.

The intermittent noise signals continued to occur until February 27, 1980.

Since then no noise signal alarms have been indicated on the plant LPMS.

On March 6,1980 an NRR acoustic monitoring team inspected the LFMS, pro-cedures and plant personnel using the LPMS. The NRR team found the licensee's use of the LPMS to be acceptable and, based on the February 22, 1980 increased frequency of monitoring for loose parts, recem ended no restrictions on continued power operation. The origin of the intermittent high frequency noise has not yet been determined. The licensee is continuing to analyze for the origin of the noise.

The consnission established a 15 day period during which public co: cents on the assessment would be accepted. April 8,1980, has been set as the target date for presenting an update of the EA with response to ccenents to the Consnission.

On March 20, 1980, the license intends to conduct a casualty drill at TMi-2 requiring implementation of the Frergency Plan.

The licensee comitted to the NRC to conduct these types. of drills on a quarte.-ly basis.

Offsite notification during the drill are anticipated.

The NRC/TMI Technical Support Steff monitored the January 1980 drills. The staff will be looking for the ccrrection of a ma.iority of tne saterial and personnel problems identified during those drills.

On Friday, March 14, 1980. J. T. Collins partleipated in a town seting in Goldsboro, along with representatives of PA-DER. PENA.

Public Meeting Soonsored by the NIH Committee on Federal Research into the Biological Effects of Ionizing Radiation: On March 10 and ll,1980 a public meeting, sponsoref by the Committee on Federal Research into the Biological Effects of Ic,nizing Radiation, was held at NIH in Bethesda.

Presented on March 10 were papers on issues addressing subjects related to radiation research and puolic concern, and on March 11, papers on discussion of scientific issues were presented.

NRC is represented on the sponsoring Connittee by R. Budnitz, RES. Members of the NRC staff attended and participated in various portions of the meeting.

OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Endino March 14, 1980 United Nuclear Corcoration, Wood River Junction United Nuclear Corporation (UNC) operates a uranium fuel recovery plant at Wood River Junction, Rhode Island, licensed under SNM-777, Docket 70-820.

Because of containment problems with the process wastes stored in lagoons on the site, License SNM-777 was conditioned in January,1979 to require decontamination and decomissioning of the lagoons by July 1,1982. We have been notified, by UNC in a letter dated February 19, 1980, that they may not be able to meet the date set for final decommissioning because of current restrictions on commercial waste burial operations.

prooosed Standard - Nuclear Criticality Control of Soecial Actinide Elements A review was made of a draft for a proposed standard on " Nuclear Criticality-Centrol of Special Actinide Elements." The draft was sent for ballot by members of Subcomittee 8 of the American Nuclear Society on Fissionable Materials Outside Reactors. There has been little published data in the past that accurately identifies safe handling quantities of special actinides.

Future applications of certain of the actinide elements could lead to their production in large quantities.

High level wastes from a fuel reprocessing plant will contain large quantities of special actinide elements. ' The propcsed' standard wbuld establish a conservative base for the evaluation of the nuclear criticality safety operations that involve these elements.

Value/Imcact Model for MC&A Uccrade Rule Safegcards staff members participated in a joint NRC-LLL systems analysis team en a plant visit of the B&W Lynchburg facility. They gathered data for the de-velopment of a representative facility model tc be used in performing value impact analyses of various regulatory alternatives for the MC&A Upgrade Rule.

The model development is being performed by LLL under FY 1980 Research funding.

Visit to Nonrower Reactor Sites Safeguards representatives visited nonpower reactor locations at the General Electric facility, Vallecitos, California, UCLA, Los Angeles, California, and General Atemics, Ladolla, California, during the period February 25-29, 1980.

The purpose of the visit was to assess the sites as part of an overall NRC effort to determine whether these nonpower reactors should be classified as Category I and thus required to protect their SSNM according to the interim requircments in the Safeguards Upgrade Rule.

Scent Fuel Shioments Approval has been given to Transnuclear, Inc., and Edlow International to continue using Portsmouth, Virginia, for imports of spent fuel.

Neither the licensees nor the staff were able to identify a practical alternative to the port of Portsmouth.

Several local governments and authorities have recently enacted ordinances or resolutions regarding spent fuel shipments, e.g., Geneva, New York, Skyler County, New York, Mt. Holly, North Carolina, Charleston County, South Carolina, and the North Carolina State Ports Authority.

The New York ordinances have made it necessary to change a route already approved by the NRC for shipments of scent fuel moving from Chalk River, Canada to Savannah River.

The fit. a 'ly resolution was passed socn after the routes to be used for moving spe-fuel frem Oconee Station to McGuire Station were released for public discicsure.

Portland General Electric Company (Trojan) - On March 12, 1980, the Comission received a check in the amount of $5,000 from the subject licensee in partial payment for the proposed civil penalty of $13,000 issued on February 15, 1980. The licensee withheld payment for one alleged item of noncompliance in which he disagreed with the proposed civil penalty and for another alleged item of noncompliance in which he disagreed with the findings of the staff. The licensee's response is under review.

On March 10, 1980, an Order Imposing Civil Penalties in the amount of

After consideration of the licensee's response, the IE Staff concluded that the items of noncompliance did occur and no adequate reasons were given by the licensee for mitigation or remission of the proposed penalties.

Diablo Canyon Nuclear Power Plant, Units 1 and 2 On March 12, 1980, the Appeal Board issued a Memorandum and Order (ALAB-583) i in which it rejected the request of the Governor of California to have the Appeal Board remand to the Licensing Board seismic matters for further 1

hearing.

The Appeal Board, however, accepted the Governor's brief as amicus curiae for consideration in connection with its review of the Licensing i

Board's decision relative to seismic matters.

Marble Hill Nuclear Generatino Station, Units 1 and 2 On March 13, 1980, the Comission issued a Memorandum and Order in which it denied a petition for a hearing on an order issued by the Director of the Office of Inspection and Enforcement which confimed the suspension of construction activity at Marble Hill.

In this Order, the Comission concluded that the Director's order confers standing on parties claiming injury from the suspension of construction but does not extend to parties asserting injury from failure to grant more extensive relief.

Furthermore, the Comission determined that there was no basis to grant a hearing as a matter of discretion. The Comission also requested the Director to brief the Comission prior to lifting the order suspending Marble Hill construction activities and to address in the briefing the issues raised by petitioners.

Midland Nuclear Power Plant, Units 1 and 2 On March 14, 1980, the Comission issued a notice of hearing in response to a request of Consumers Power Company for a hearing on an order issued by the Director of the Office of Inspection and Enforcement which prohibits Consumers Power Company from perfortning certain soil-related activities pending approval of amendments to the construction permits.

Atlantic Research Corporation On March 15, 1980, the Comission by majority vote issued a Decision in this enforcement matter involving the levying of a civil penalty against a radio-graphy licensee for violations of the license and NRC regulations. The issue involved in this Decision was the Appeal Board's reversal of the Administrative i

Law Judge's denial of the licensee's request for mitigation of the civil penalty of $8,600.

In its Decision the Comission ruled that civil penalties may be imposed under the Atomic Energy Act in the absence of a finding of malfeasance, j

nonfeasance or misfeasance on the cart of licensee management, or of a showing that the licensee failed to take pcompt corrective action.

Since the Appeal Board had found that the licensee h this case was not liable it had no ENCLOSURE G 9

2-occasion to consider the circumstances of the case which would justify mitigation of the amount of the penalty. Accordingly, the Consission vacated the Appeal Board's reversal and remanded the matter to the Appeal Board for further consideration solely on the issue of mitigation, Comissioner Kennedy dissented.

power reactor turbines. The F0E was to respond to a Parlimnentary inquiry on this the next day.

IP arranged for technical staff in DOR:NRR familiar with the problem to return the call.

Extension of NRC-HSE Arranaement IP was advised by cable March 13 that the British Health and Safety Executive, although anxious to renew the Information Exchange Arrangement with NRC, will need a little more time before signing the extension because of the unavail-ability of key staff who must approve the modifications. We have agreed to continue the exchange informally in the interim.

A license is being requested on an urgent basis because funds for procurement of the material must be spent before expiration of the current Japanese fiscal year on March 31, 1980. A staff paper on the proposed export will be forwarded shortly for Commission review.

IAEA Board of Governort Meeting Marvin Peterson from IP represented NRC at the March IAEA Board of Governors Meeting held in Vienna from March 4-6.

Preliminary findings on the review of the Ned Jersey plan were presented to the State on March 13 in West Trenton by Tom and FEMA members of RAC II.

On March 11, 1980, Tom Elsasser attended a meeting in Albany, New York between various State agencies, FEMA and the NRC to discuss items of significant concern to New York State regarding the entire issue of State radiological emergency response plan development.

Week Ending March 14, 1980g FY 1980 Reprogramming The reprogramming of prior-year unobligated funds was delivered.to NRC's five Congressional Committees on March 10 for their review and approval.

Budget Manual The budget manual (chapter 1301 of NRC's directive system) was approved by the Acting Executive Director for Operations.

The manual is now in final typing and should be distributed in the next 30 days.

FY 1981 Budget Additional questions were received from Senator Schmitt of the Senate Appropriations Committee.

These were distributed to the staff for appropriate answers which are due Monday, March 17.

The final galleys of the transcript (which includes inserts and Q6A's) of the February 26 Bevill hearings were received for proofing.
