Dear Mr. Rodgers:
o This is in reply to your request, dated February 14, 1968 and supplemental letter dated April 18, 1968, for-an exemption from the provisions of section 50.10(b), 10 CFR Part 50 of the Commission's rules, pursuant to Section 50.12 of the rules, to permit the performance of certain work at the site of the Crystal River Unit 3 Nuclear Generating Plant prior to the ' issuance of a

construction permit by the Commission.
o You state that construction of the tendon access and inspection
~
gallery, which will be located below the main containment mat, must be authorized before you can proceed with certain other pre-construction work such as pouring the concrete leveling mat below the base slab in the reactor building, erection of forms and the loose placement of reinforcement steel for the reactor building base slab. You further state that scheduling of the construction of the gallery is important to avoid a 10-week delay in the start of construction after issuance of a construction permit.
In your supplemental letter you state that installation of the Crystal River Unit 3 by April 1972 is vital to the power requirements for Florida Power Corporation.
We have carefully reviewed your request described in your February 14th and April 18th letters, for an exemption under the provisions of Section 50.10(b) and the reasons set forth in support thereof, and have concluded that the granting of the proposed exemption is rtheri cd bj,1=, --ill not caden;;c lifc cr grega t, o r tL

9 Mr. J. T. Rodgers Accordingly, the Commission hereby authorizes you to construct the tendon access gallery for Unit 3 at the Crystal River Site, as requested in your letters of February 14, 1968 and April 18, 1968, prior to the issuance of a construction permit.
I wish to emphasize that the granting of this exemption shall have no bearing upon the subsequent granting or denial of a construction 1
permit for the proposed Crystal River Unit 3 Nuclear Generating Plant, and any work performed pursuant to this exemption shall be performed entirely at the risk of Florida Power Corporation.
Fur-thermore, the granting of this exemption does not constitute an approval of the type or adequacy of the method of its installation.
