This will advise you as to the Commission's f 'nal action regarding my Novem-l ber 16, 1979 dental of your requests that I it sue an order to show cause to l

Public Service Company of New Hampshire (PSNH) why the construction permits for the Seabrook Station should not be suspended or revoked on the basis of l

the asserted lack of PSNH's financial qualifications.

I By order issued December 21,1979 (Enclosure A) the Commission extended to l

January 31, 1980 the time within which it might act to review that denial.

As a result of " supervening events" to the denial, the staff was requested I

in a memorandum dated December 27, 1979 from the Secretary (Enclosure B) to assess questions raised by these " supervening events" and "other more recent pertinent information." The staff was also requested to report to the~ Commission its assessment of the significance of these events and whether this assessment indicated that the Director's decision should be modi fied.

In response to this request, I forwarded to the Commission an information paper dated January 18, 1980, under designation SECY-A-79-91 A (Enclosure C). This paper supplements my November 16,197910 CFR 2.206 denial and concludes that the staff does not believe that a different or modified result is appropriate from that reached in the earlier decision.

On January 31, 1980, the Commission issued another order extending the time within which it may review the Director's denial until February 7, 1980 (Enclosure D).

On February 6,1980, a memorandum (Enclosure E) was transmitted from Samuel J. Chilk, Secretary, to Leonard Bickwit, Jr., General Counsel, and William J. Dircks, Acting Executive Director for Operations, which advised that the Commission (with four Commissioners approving and Commissioner Hendrie disqualifying himself from participation) had decided against h
