SECY-A-79-91B-DIRECTOR'SD'iNII. OF -2.206 RELIEE -SEASR00K, FINANCIAL QUALIFICATIONS (CON 92NT CALENDAR ITEM)*
This is to advise you that the Commission (with four Commissioners approving an'd Comissioner Hendrie disqualifying himself from participation) has decided against exercising its authority to review sua sponte the denial by the Director, Nuclear Reactor Regulation (NRR), of petitions related to the financial qualifications of the Seabrook licensee.
In response to a directive from the
-l Comission, dated December 27, 1979, the staff has supplemented the orig.inal Director's denial, dated November 16, 1979, with further information and analysis, in SECY-A-79-91A, dated January 18, 1980.
Those two documents, taken together, should be regarded as constituting the Director'c decision.
It is requested that the Director, NRR, recast SECY-A-79-91A into a suitable format to be served on the licensee, petitioner and others in Ine same manner as the original denial.
This constitutes final Commission action on this matter.
The Office of the General Counsel was informed of this action by telephone on February 5, 1980.
