SECY 79-283, EXPORT OF CERTAIN MINOR QUANTITIES OF NUCLEAR MATERIAL Purcose:

To inform the Commission of needed changes in Enclosure A of the subject paper.

Discussion:

SECY 79-283, dated April 20, 1979, forwarded for Commis-sion approval a notice of rule making containing amend-ments to 10 CFR Part 110 that would simplify licensing requirements for export of certain quantities of nuclear material which do not have significance from a nuclear proliferation standpoint.

Included in the notice of rulemakingwastheaddjtionofUgandatothelistof embargced countries in s 110.28 and an explanation in the statement of considerations that this action was taken as required by Public Law 95-435.

That law, among other things, amended Section 4 of the Export Administra-tion Act of 1969 to prohibit the export to Uganda of any article, material, or supply, including technical data or other information, other than cereal grains and addi-tional food products, by any person subject to the juris-diction of the United States, until the President deter-mines and certifies to the Congress that the Government of Uganda is no longer committing a consistent pattern of gross violations of human rights.

The President made such a deternination and certifica-tion on May 15, 1979, published in the Federai Register on May 17,1979 (44 F.R. 28773, attached as an Appendix).

If the Ccmmission approves the notice of rule making, I propose to change the notice of rule making by deleting the third paragraph on page 5 of the notice of rule making and deleting Uganda fran the list of embargoed

' Secretary of Commerce Pursuant to the authority vested in me by Section 5 of Public Law 95-435, I hereby determine and certify that:

The Government of Uganda is no longer committing a consistent pattern of gross violations of human rights.

The Secretary of State is requested to report this determination to the Con-gress on my behalf, as required by law. The Secretaries of Treasury and Commerce are requested to take the appropriate steps permitting the immedi-ate resumption of imports from and exports to Uganda.

This determination shall be published in the Federal Register.
