APPENDIX A NOTICE OF VIOLATION Public Service Electric and Gas Company Docket No. 50-272 Based on the results of an NRC inspection conducted on November 18 through December 15, 1979, and January 9,1980, it appears that one of your activities was not conducted in full compliance with the conditions of your NRC Facility License No.
DPR-70, as indicated below.
A.
Technical Specification 6.8.1 states, in part:
" Written procedures shall be established, implemented and maintained covering...the applicable procedures recommended in Appendix A of Regulatory Guide 1.33."
Regula-tory Guide 1.33, Paragraph A.3 includes, Equipment Control (e.g., Locking and Tagging).
Administrative Procedure (AP-2), " Station Organization", Section 5.14, states, in part, "The responsibilities of the Senior Shift Supervisor include:
... Performing the Safety Tagging Rules responsibilities in accordance with AP-15. "
Administrative Procedure (AP-15), " Tagging Rules", Section 6.0, states, in part, " Responsibility of the Shif t Supervisor... obtains a properly filled out tagging request form before proceeding to order apparatus cleared and tagged", " supervises the placement and removal of safety tag s.
Safety tags shall be attached to and removed from equipment only by designated operating personnel upon orders from the Shif t Supervisor..."
Operating Department Memo (0M-15), " Removal of Safety Related Equipment from an Operable Status", states, in part, "The Shift Supervisor / Senior Shif t Supervisor is ultimately responsible for the operable status of all equipaent, cocpliance with the Technical Specifications for actions required when equipment is inoperable."
Contrary to the above, on October 31, 1979, an individual, not authorized or familiar with Technical Specification requiiements and without the knowledge of the responsible Senior Shif t Super visor /Shif t Supervisor, approved a tagging request form that resulted in all thre' emergency diesel generators being tagged and locked out simultaneously.
This resulted in a voluntary entry into an action statement of Technical Specification 3.8.1.2.

As ycu are aware from' the " Criteria for Determining Enforcement Action," which was p rovided to NRC licensees by letter dated December 31, 1974, the enforcement actio1s available to the NRC include administrative actions in the form of written Notices of Violations, Civil Monetary Penalties, and Orders Pertaining to the Modification, Suspension or Revocation of the license.
After careful evaluation of the item set forth above and the enforcement history at the Salem facility, we conclude that a Notice cf Violation is the appropriate action at this time.

Appendix A This notice is sent to you pursuant to the provisions of Section 2.201 of the NRC's Rules of Practice, Part 2, Title 10, Code of Federal Regulations.
Section 2.201 requires you to submit to this office within twenty-five days of the date of this notice, a written statement or explanation in reply, including:
(1) admission or denial of the alleged items of noncompliance; (2) the reasons for the item of noncompliance, if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further noncompliance, and (5) the date when full compliance will be achieved.
