SUBJECT:

STAFF COMMUNICATIONS WITH THE COMMISSION The Energy Reorganization Act of 1974, in creating the NRC established the Offices of Nuclear Reactor Regulation, Nuclear Material Safety & Safeguards, Nuclear Regulatory Research, and the Executive Director for Operations.

Section 209(b) of the Act provided that:

"The Executive Director shall perform such functions as -he Comissicn may direct, except that the Executive Director shill not licit the authority of the director of any component organi-zation provided in this Act to communicate with or reocrt directly to the Ccr.ission when such director of a component reganica-ion deems it necessary to carry out his responsibilities."

The Fiscal Year 1979 NRC Authorization Act (P.L.95-601) amended the above provision by addinc:

"'iotwithstanding the preceding sentence, each such d. rector shall keep the Executive Director fully and currently infomid concerning the content of all such direct comunications wit'.

In order tc ensure oro;er implementation of the amendment, the Comiss'en expects the directcrs of these offices, as well as the directors of other offices reporting to the Executive Director for Operations, to kees tha EDO fully and currently informed of substantive communications wit'i thE Comission on catters involving the agency.

To implement this legislation, the Comission has approved revisions t:

Manual Chapters OlC3, 0123, 0124, and 0125, Organization and Functicas of the Offices of the Executive Director for Operations, Office of Nuc~. ear Reactor Regulation, Office of Nuclear Material Safety & Safeguards, and the Office of Nuclear Regulatory Research, respectively.
