SUBJECT:

SECY 79-82, STAFF COMMUNICATIONS WITH THE COMMISSION, DATED FEBRUsRY 1, 1979, AND SECY MEMORANDUM, MARCH 21, 1979, REGARDING DISCUSSIONS OF THIS SUSJECT WITH THE COMMISSION, MARCH-15, 1979 Attached are a revised memorandum proposed for signature by the Chairnan, and revisions of the Manual Chapters for the EDO, NRR, HMSS and RES, pro-viding fc-the implementation of the amendment of the ERA of 1974 by the 1979 Authorization Act, dealing with the requirement for Office Directors to keep the Executive Director for Operations informed of direct communica-tions with the Commission.

Your March 21 memorandum advised that action on this matter would be deferred pending Turtt.er discussion by the Comission of general organizational catters and a review of existing delegations of authority.

The latter subject is under study by OPE, and I have provided OPE separately a copy of this memorandum for their consideration.

I do not believe, however, that it is necessary to await the outcome of the study of delegations by the Commission to croceed with the implementation of the provisions of the FY-1979 Authcrization legislation and would rectamend Commission action on the attached.

Please note that I am withdrawing'the proposed Manual Chapter 0202, " Staff Communications with the Commission", attached to SECY 79-82.

I believe the attached memorandum and Manual Chapter revisions will suffice.

Other revisions to these Manual Chapters to update and to reflect additional delegations that have been made will be separately forwarded for Commission approval.

SUBJECT:

STAFF COMMUNICATIONS WITH THE COMMISSION The Energy Reorganization Act of 1974, in creating the NRC established the Offices of Nuclear Reactor Regulation, Nuclear Material Safety and Safeguards, Nuclear Regulatory Research, and the Executive Director for Operations.

Section 209(b) of the Act provided that:

"The Executive Director shall perform such functions as the Commission may direct, except that the Executive Director shall not limit the authority of the director of any ccmponent organi-zation provided in this Act to communicate with or report directly to the Commission when such director of a component organization deems it necessary to carry out his responsibilities."

The Fiscal Year 1979 NRC Authorization Act (P.L.95-601) amended the above provision by adding:

i "Notwithstanding the preceding sentence, each such director shall keep the Executive Director fully and currently informed concerning the content of all such direct communications with the Commission."

In order to ensure proper implementation of the amendment, the Commission expects the directors of these offices, as well as the directors of other of perations, to keep DUPLICATE DOCUMENT the EDO ful nications with the Entire document previously Comnissisn entered into system under:
