This refers to the telephone conversation between yourself and Mr. James M. Allan, Deputy Director, U.S. Nuclear Regulatory Commission, Region I, on May 3, 1979. The telephone conversation relates to the event which occurred on May 2,1979, and the present status of the Oyster Creek Nuclear Generating Station.
With regard to the matters discussed in the referenced conversation, we understand that the reactor will remain in a Cold Shutdown Condition in accordance with Title 10 of the Code of Federal Regulations, Part 50.36(c)(1) and your Technical Specifications, Section 6.7.1.
Further, in the event you conclude that a safety limit has not been exceeded, you intend to retain the reactor in the cold shutdown condition until NRC Region I agrees with your conclusion.
