The Nuclear Regulatory Comission (the Comission) has found that:

A.

The application for amendment by The University of California at Eerkeley (the licensee) dated December 30, 1974, as supplemented by filings dated February 18 and December 21, 1976; August 15, 1977; and February 26, April 3, and May 14, 1979, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I; B.

The facility will operate in confomity with the application, the provisions of the Act, and the rules and regulations of the Commission; C.

Tnere is reasonable assurance (1) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Comission's regulations; D.

The licensee is technically and financially qualified to engage in the activities authorized by this operating license in accordance with the rules and regulations of the Commission; E.

The licensee is a nonprofit educational institution and will use the facility for the conduct of educational activities, and has satisfied the applicable provisions of 10 CFR Part 140, " Financial Protection Requirements and Idemnity Agreements," of the Commission's regulations; F.

The issuance of this amendment will not be inimical to the comon defense and security or to the health and safety of the public; G.

The issuance of this amendment is in accordance with 10 CFR Part 51 of the Comission's regulations and all applicable requirements have been satisfied; and 7910350 kcd.h f

The receipt, possession and use of the byproduct and special nuclear materials as authorized by this license will be in accordance with the Commission's regulations in 10 CFR Parts 30 and 70, including 10 CFR Sections 30.33, 70.23 and 70.31.

2.

Facility Operating License No. R-101 is hereb" amended in its entirety y

to read:

A.

This license applies to the heterogeneous pool-type TRIGA Mark III type nuclear reactor (the reactor),

owned by The Regents of The University of California (the licensee). located on its campus at Berkeley, California, and described in the application for license dated May 27, 1964, and subsequent am ndments and supplements thereto, including the application for renew 21 dated December 30,1974, and supplements thereto dated February 18 and December 21, 1976; August 15, 1977; and February 26, April 3, and May 14, 1979 (the application).

B.

Subject to the conditions and requirements incorporated herein. the Commission hereby licenses The Regents of The University of California in Berkeley, California:

1.

Pursuant to Section 104 c of the Act and Title 10, CFR, Chapter I, Part 50, " Licensing of Production and Utilization Facilities" to possess, use, and operate the reactor as a utilization facility at the designated location in Berkeley, California, in accordance with the procedures and limitations set forth in this license.

2.

Pursuant to the Act and 10 CFR Part 70, "Special Nuclear Material,"

to receive, possess, and use up to 7.4 kilograms of contained uranium 235, in a homogeneous mixture of uranium--zirconium hydride, enriched to less than 20 percent and up to 240 grams of plutonium 239 in the form of sealed Pu-Be neutron sources (5 - 1 curie Pu-Be sources,1 - 10 curie Pu-Be source), both in connection with operation of the reactor.

3.

Pursuant to the Act and Title 10, Chapter I, Part 30, " Rules of General Applicability to Licensing of Byproduct Material", to receive, possess and use the following sealed neutron sources for reactor startup:

1) a 10 curie sealed polonium 210-beryllium neutron source, 2) up to a 5 curie sealed antimony 124-beryllium neutron source; and 3) a 2 curie sealed americium 241-beryllium neutron source, and to possess, but not to separate, such byproduct material as may be produced by operation of the reac.3r.

C.

This license shall be deemed to contain and is subject to the conditions specified in the following Commission regulations in 10 CFR Chapter I:

Part 20, Section 30.34 of Part 30, Sections 50.54 and 50.59 of Part 50, and Section 70.32 of Part 70; and is subject to all applicable provisions of the Act and to the rul es, regulations, and orders of the Commission now or hereafter in effect; aad is subject to the additional conditions specified or incorporated below:

Maximum Power Level The licensee is authorized to operate the reactor at steady state power levels up to a maximum of 1000 kilowatts (thermal).

2.

Technical Scecifications The Technical Specifications contained in Appendix A attached hereto are hereby incorporated in this license. The licensee shall operate the reactor in accordance with the Technical Specifications.

D.

The licensee shall maintain in effect and fu]ly im'iement all provisions of the NRC-approved physical security plan, incl.ing amendments and changes made pursuant to the authority of 10 CFR.0.54(p). The approved security plan consists of the document withheld from public disclosure pursuant to 10 CFR 2.790(d), entitled " Security Plan for The University of California at Berkeley TRIGA Mark III Reactor Facility", dated September 18, 1974, and Revision 1 dated December 20, 1976.

E.

This amended license is effective as of the date of issuance and shall expire at midnight, February 3, 2005.
