Dear Mr. Matos:

We have reviewed the proposed revisions to the Georgia regulations Chapter 391-3-17, received by our office on June 12, 2019. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and Regulation Amendment Tracking System Identification Numbers (RATS ID) 2013-2, 2018-1 and 2018-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on July 12, 2019.

As a result of our review, we have 27 comments related to compatibility, and one editorial comment that are identified in the enclosure. Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that the Georgia regulations meet the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final Georgia regulations. However, we have determined that if your proposed regulations were adopted, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when the proposed regulations are adopted and published as final regulations, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet summarizes our knowledge of the status of other Georgia regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. GA needs to change .02(5)(f) to read:

Any person who receives, possesses, uses, or transfers source material in accordance with the general license granted in subparagraph (b) of this section is exempt from the provisions of 391 17-.03 and 391-3-17-.07 to the extent that such receipt, possession, use, and transfer are within the terms of this general license, except that such person shall comply with the provisions of 391-3-17-.03(7)(b) and 391-3-17-.03(13)(a) to the extent necessary to meet the provisions of subparagraphs (c)(2) and (e) of this section. However, this exemption does not apply to any person who also holds a specific license issued under this chapter.

GA needs to make the above change in order to meet the Compatibility Category B designation assigned to 10 CFR 40.22(d).

2 391-3 40.55(c) 2013-2 B Conditions of licenses to initially

.02(5)(m) transfer source material for use under the small quantities of source material general license:

quality control, labeling, safety instructions, and records and reports GA needs to rewrite .02(5)(m) to read Each person licensed under 391 17-.02(5)(h) shall provide the information specified in this paragraph to each person to whom source material is transferred for use under 391-3-17-.02(5)(b). This information must be transferred before the source material is transferred for the first time in each calendar year to the particular Enclosure 1

3 391-3 40.55(d) 2013-2 B Conditions of licenses to initially

.02(5)(k) transfer source material for use under the small quantities of source material general license:

quality control, labeling, safety instructions, and records and reports GA needs to rewrite the last sentence of .02(5)(k)3. to read If no transfers have been made to general licensees in a particular Agreement State or falling under the jurisdiction of the NRC, during the reporting period, this information shall be reported to the NRC or responsible Agreement State agency upon request of the agency or the NRC.

GA needs to make the above change in order to meet the Compatibility Category B designation assigned to 10 CFR 40.55(d).

4 391-3 35.2 2018-1 B Definitions

.05(2)(xx) and (yy) GA has an incorrect reference in the definition of Associate Radiation Safety Officer. GA needs to revise 391-3-17-.05(2)(xx)1. to read: Meets the requirements in Rule .05(22) and

.05(27); and.

.05(19)

GA omits an equivalent regulation to 10 CFR 35.40(b)(6) from 391-3 .05(19).

GA needs to add language equivalent to 10 CFR 35.40(b)(6) to .05(19) in order to meet the Compatibility Category H&S designation assigned to 10 CFR 35.40.

6 391-3 35.50 2018-1 B Training for Radiation Safety

.05(22) Officer and Associate Radiation Safety Officer GAs regulation 391-3-17-.05(22) is not essentially identical to 10 CFR 35.50. Specifically GA needs to restructure its regulation to match the new structure of 10 CFR 35.50 and change the references to match. As an example .05(22)(a) should not point to the requirement for a written attestation but instead point to the training described in .05(22)(e). The written attestation required by paragraph .05(22)(d) is only required for individuals qualifying under

.05(22)(b).

GA needs to rewrite 391-3-17-.05(22) as indicated above in order to meet the Compatibility Category B designation assigned to 10 CFR 3

7 391-3 35.51 2018-1 B Training for an authorized medical

.05(23) physicist.

GAs regulation 391-3-17-.05(23) is not essentially identical to 10 CFR 35.51.

Specifically GA needs to change the reference in .05(23)(a) to only point to the requirement for the training described in .05(23)(c). The written attestation required by paragraph

.05(23)(b)(2) is only required for individuals qualifying under

.05(23)(b).

GA also needs to remove the references to .05(23)(a)1. and 2. from

.05(23)(b)2.

GA needs to rewrite 391-3-17-.05(23) as indicated above in order to meet the Compatibility Category B designation assigned to 10 CFR 35.51.

8 391-3 35.55 2018-1 B Training for an authorized nuclear

.05(24) pharmacist.

GA needs to remove and who meets the requirements in .05(24)(b)2. from

Additionally, GA omits except the Radiation Safety Officers and authorized medical physicists identified in this paragraph must meet the training requirements in § 35.50(d) or § 35.51(c), as appropriate, for any material or uses for which they were not authorized prior to this date. from the end of 391-3-17-.05(26)(a).

GA needs to rewrite 391-3 .05(26)(b) to incorporate 10 CFR 35.57(b)(1) and incorporate the language in 35.57(b)(2)(i)-(iv).

GA needs to make the above changes in order to meet the Compatibility Category B designation assigned to 10 CFR 35.57.

10 391-3 35.190 2018-1 B Training for uptake, dilution, and

.05(43) excretion studies GA needs to remove the reference to
