U.S. Nuclear Regulatory Commission Public Meeting Summary January 30, 2019

Title:

Public Meeting to Discuss Proposed Rulemaking to Align the Regulations in 10 CFR Parts 50 and 52, to Address Updates to the Licensing Processes, and Lessons Learned for Future New Reactor Applications Meeting Identifier: 20181280 Date of Meeting: January 15, 2019 Location: NRC One White Flint North, Commission Hearing Room, 11555 Rockville Pike, Rockville, MD Type of Meeting: Category 3 Purpose of the Meeting:

The purpose of the meeting was to discuss the scope of a rulemaking proposed by the U.S.

Nuclear Regulatory Commission (NRC) that will align the licensing processes in Title 10 of the Code of Federal Regulations (10 CFR) Parts 50 and 52 and to address lessons learned from recent new reactor licensing reviews and to provide participants an opportunity to ask questions and provide comments about those elements that they believe should be considered as part of the rulemaking.

General Details:

Prior to the meeting, NRC staff reached out to three non-governmental organizations (NGOs), five industry organizations, and eighteen representatives from industry to notify them of the meeting, and to request participation. The NRC staff also reached out to the States and federally recognized Tribal nations via a State and Tribal Communication (STC) letter STC-18-073 (ML18331A391). The meeting was noticed on the NRC public website.

The meeting was scheduled from 8:30 a.m. - 3:30 p.m.; however, the meeting adjourned at 11:30 a.m. after the conclusion of the question and answer period. The meeting was co-facilitated by Mr. George Smith, an NRC in-house facilitator.

Approximately 85 people participated in the meeting. This included 48 people who were present during the meeting. There were 36 people participating in the meeting remotely using a teleconference line and or webinar. A list of attendees is provided as an attachment to this meeting summary.

Summary of NRC Presentation:

Mr. Frederick Brown, Director of NRCs Office of New Reactors (NRO) provided opening remarks. Mr. Jim ODriscoll, Project Manager, Division of Rulemaking, Office of Nuclear Materials Safety and Safeguards provided an overview of the rulemaking process and schedule. Ms. Patricia Vokoun, Project Manager, in NROs Division of Licensing, Siting, and Environmental Analysis (DLSE), provided a discussion on the background of the activity, and need for the alignment of Parts 50 and 52. Mr. Joseph Colaccino, of NRO DLSE discussed items under consideration that resulted from lessons learned from the new reactor licensing reviews. Mr. Colaccino also discussed several changes under consideration for the rulemaking that may be considered transformational changes. The NRC staff then opened the meeting for questions and comments from the public. After conclusion of the question/comment session, the NRC staff summarized next steps and concluded the meeting.

Public Participation Themes:

Remarks were shared by industry stakeholders that had registered in advance of the public meeting. Mr. Michael Tschiltz, of the Nuclear Energy Institute (NEI) led an industry panel discussion on a list of suggested changes for consideration (ADAMS Accession No. ML19014A000).

At the conclusion of the remarks provided by the NEI panel, the NRC staff asked if there were any members of the public who desired to provide other prepared remarks. No additional prepared remarks were offered. The NRC staff then opened up the discussion for a general question and answer session on the discussion, followed by a facilitated question and answer session. Several participants were engaged and provided feedback including industry stakeholders and other NRC staff.

The stakeholders communicated that they appreciated the information presented by the NRC staff, the opportunity to discuss their respective comments on the rulemaking efforts, and the NRC staffs responses to the comments and questions.

Action Items/Next Steps:

  • The NRC staff will determine the scope of issues that will be considered for this rulemaking, communicate a path forward to the Commission with regard to the staffs recommended scope, and develop the draft regulatory basis.
