UPDATE ON THE NEED FOR FEDERAL EMERGENCY MANAGEMENT AGENCY SUPPORT FOR THE REVIEW OF CERTAIN NEW REACTOR LICENSING ACTIONS
Dear Dr. Casey:
This letter provides an update to the May 22, 2018, letter from the U.S. Nuclear Regulatory Commission (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18130A244), which served as written notice that support under the Memorandum of Understanding Between the Department of Homeland Security/Federal Emergency Management Agency and Nuclear Regulatory Commission Regarding Radiological Emergency Response, Planning and Preparedness (ADAMS Accession No. ML15344A371), for the technical review of proposed offsite radiological emergency preparedness (REP) plans and preparedness was no longer required at this time for the new reactor licensing actions listed below. Specifically, this listing has been updated to reflect the termination of the combined license (COL) for the South Texas Project, Units 3 and 4 on July 12, 2018.
Assessment of a new reactor user fee by the Federal Emergency Management Agency (FEMA) under Title 44, "Emergency Management and Assistance," of the Code of Federal Regulations (44 CFR) Part 353 for new reactor licensing actions that have been completed, or formally terminated or withdrawn, should be suspended until further notification from the NRC.
- 1. Completed COL Actions
- a. COLs issued, but no decision on construction at this time:
- Enrico Fermi Nuclear Plant, Unit 3: COL issued on May 1, 2015 (ADAMS Accession No. ML15138A151).
- William States Lee Ill Nuclear Station, Units 1 and 2: COLs issued on December 19, 2016 (ADAMS Accession Nos. ML16333A329 and ML16333A331).
- North Anna Power Station, Unit 3: COL issued on June 8, 2017 (ADAMS Accession No. ML17128A497).
- Turkey Point, Units 6 and 7: COL issued on April 12, 2018 (ADAMS Accession No. ML18058A461).
Dr. M. Casey b. COL issued, but subsequently terminated:
- Levy Nuclear Plant; Units 1 and 2: COLs issued on October 26, 2016 (ADAMS Accession Nos. ML12265A029 and ML12265A042). At the request of licensee, by letter dated January 25, 2018 (ADAMS Accession No. ML18029A117), the COL was terminated on April 26, 2018 (ADAMS Accession No. ML18107A111).
- South Texas Project, Units 3 and 4: COLs issued on February 12, 2016 (ADAMS Accession Nos. ML16033A020 and ML16033A047). At the request of licensee, by letter dated June 22, 2018 (ADAMS Accession No. ML18184A338), the COL was terminated on July 12, 2018 (ADAMS Accession No. ML18179A217).

- Grand Gulf ESP Site: Issued April 5, 2007 (ADAMS Accession No. ML070780457).
- PSEG Site: Issued May 5, 2016 (ADAMS Accession No. ML16084A798).

- Tennessee Valley Authority, Clinch River Nuclear Site: Application submitted on May 12, 2016. NRC accepted the application for docketing and detailed technical review on January 5, 2017 (ADAMS Accession No. ML16355A162).
