UPDATE ON THE NEED FOR FEDERAL EMERGENCY MANAGEMENT AGENCY SUPPORT FOR THE REVIEW OF CERTAIN NEW REACTOR LICENSING ACTIONS

Dear Dr. Casey:

This letter provides an update to the February 26, 2018, letter from the U.S. Nuclear Regulatory Commission (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18008A289), which served as written notice that support under the Memorandum of Understanding Between the Department of Homeland Security/Federal Emergency Management Agency and Nuclear Regulatory Commission Regarding Radiological Emergency Response, Planning and Preparedness (ADAMS Accession No. ML15344A371), for the technical review of proposed offsite radiological emergency preparedness (REP) plans and preparedness was no longer required at this time for the new reactor licensing actions listed below.

Specifically, this listing has been updated to reflect the termination of the combined license (COL) for the Levy Nuclear Plant, Units 1 and 2 on April 26, 2018, and the Commissions issuance of a COL for Turkey Point, Units 6 and 7 on April 12, 2018.

Assessment of a new reactor user fee by the Federal Emergency Management Agency (FEMA) under Title 44, "Emergency Management and Assistance," of the Code of Federal Regulations (44 CFR) Part 353 for new reactor licensing actions that have been completed, or formally terminated or withdrawn, should be suspended until further notification from the NRC.

1. Completed COL Actions

a. COLs issued, but no decision on construction at this time:

• Enrico Fermi Nuclear Plant, Unit 3: COL issued on May 1, 2015 (ADAMS Accession No. ML15138A151).

• South Texas Project, Units 3 and 4: COLs issued on February 12, 2016 (ADAMS Accession Nos. ML16033A020 and ML16033A047).

• William States Lee Ill Nuclear Station, Units 1 and 2: COLs issued on December 19, 2016 (ADAMS Accession Nos. ML16333A329 and ML16333A331).

• North Anna Power Station, Unit 3: COL issued on June 8, 2017 (ADAMS

Dr. M. Casey Accession No. ML17128A497).

• Turkey Point, Units 6 and 7: COL issued on April 12, 2018 (ADAMS Accession No. ML18058A461).

b. COL issued, but subsequently terminated:

• Levy Nuclear Plant; Units 1 and 2: COLs issued on October 26, 2016 (ADAMS Accession Nos. ML12265A029 and ML12265A042). At the request of licensee, by letter dated January 25, 2018 (ADAMS Accession No. ML18029A117), the COL was terminated on April 26, 2018 (ADAMS Accession No. ML18107A111).

c. COL issued, but construction terminated:

• Virgil C. Summer Nuclear Station, Units 2 and 3: COLs issued on March 30, 2012 (ADAMS Accession Nos. ML14100A092 and ML14100A101).

o Notification of Termination of Project Construction dated August 17, 2017 (ADAMS Accession No. ML17229B487).

2. COL Applications Withdrawn or Suspended Prior to Issuance

• Bell Bend Nuclear Power Plant: Applicant's request to withdraw discussed in letter dated August 30, 2016 (ADAMS Accession No. ML16252A202).

• Bellefonte Nuclear Station, Units 3 and 4: Applicant's request to withdraw is in letter dated March 28, 2016 (ADAMS Accession No. ML16088A258).

• Callaway Plant, Unit 2: Applicant's request to withdraw is in letter dated August 12, 2015 (ADAMS Accession No. ML15265A524).

• Calvert Cliffs, Unit 3: Applicant's request to withdraw is in letter dated June 8, 2015 (ADAMS Accession No. ML15160A570).

• Comanche Peak, Units 3 and 4: Applicant's request to suspend safety review discussed in letter dated November 17, 2013 (ADAMS Accession No. ML13316A369).

• Grand Gulf, Unit 3: Applicant's request to withdraw is in letter dated February 9, 2015 (ADAMS Accession No. ML15040A078).

• Nine Mile Point, Unit 3: Applicant's request to withdraw is in letter dated November 26, 2013 (ADAMS Accession No. ML13333A287).

• River Bend Station, Unit 3: Applicant's request to withdraw discussed in letter dated December 4, 2015 (ADAMS Accession No. ML15338A298).

• Shearon Harris, Units 2 and 3: Applicant's request to suspend safety review discussed in letter dated May 2, 2013 (ADAMS Accession No. ML13123A344).

• Victoria County Station, Units 1 and 2: Applicant's request to withdraw is in letter dated June 11, 2010 (ADAMS Accession No. ML101740233).

3. Early Site Permits (ESPs)

a. ESP issued, but no decision on COL application:

• Clinton ESP Site: Issued March 15, 2007 (ADAMS Accession No. ML070670140).

• Grand Gulf ESP Site: Issued April 5, 2007 (ADAMS Accession No. ML070780457).

• Victoria County Station Site: Applicant's request to withdraw is in letter dated October 3, 2012 (ADAMS Accession Number No. ML12241A303).

At this time, technical support by FEMA continues to be required for the review of offsite REP plans and preparedness for the new reactor licensing actions listed below.

• Vogtle Electric Generating Plant, Units 3 and 4: COLs issued on February 10, 2012 (Current licenses available at ADAMS Accession Nos. ML14100A106 and ML14100A135).

2. ESP Applications currently under review

• Tennessee Valley Authority, Clinch River Nuclear Site: Application submitted on May 12, 2016. NRC accepted the application for docketing and detailed technical review on January 5, 2017 (ADAMS Accession No. ML16355A162).
