UPDATE ON THE NEED FOR FEDERAL EMERGENCY MANAGEMENT AGENCY SUPPORT FOR THE REVIEW OF CERTAIN NEW REACTOR LICENSING ACTIONS

Dear Dr. Casey:

This letter provides an update to the February 26, 2018, letter from the U.S. Nuclear Regulatory Commission (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18008A289), which served as written notice that support under the Memorandum of Understanding Between the Department of Homeland Security/Federal Emergency Management Agency and Nuclear Regulatory Commission Regarding Radiological Emergency Response, Planning and Preparedness (ADAMS Accession No. ML15344A371), for the technical review of proposed offsite radiological emergency preparedness (REP) plans and preparedness was no longer required at this time for the new reactor licensing actions listed below.

Specifically, this listing has been updated to reflect the termination of the combined license (COL) for the Levy Nuclear Plant, Units 1 and 2 on April 26, 2018, and the Commissions issuance of a COL for Turkey Point, Units 6 and 7 on April 12, 2018.

Assessment of a new reactor user fee by the Federal Emergency Management Agency (FEMA) under Title 44, "Emergency Management and Assistance," of the Code of Federal Regulations (44 CFR) Part 353 for new reactor licensing actions that have been completed, or formally terminated or withdrawn, should be suspended until further notification from the NRC.

  • Enrico Fermi Nuclear Plant, Unit 3: COL issued on May 1, 2015 (ADAMS Accession No. ML15138A151).

  • River Bend Station, Unit 3: Applicant's request to withdraw discussed in letter dated December 4, 2015 (ADAMS Accession No. ML15338A298).
  • Shearon Harris, Units 2 and 3: Applicant's request to suspend safety review discussed in letter dated May 2, 2013 (ADAMS Accession No. ML13123A344).

  • Vogtle Electric Generating Plant, Units 3 and 4: COLs issued on February 10, 2012 (Current licenses available at ADAMS Accession Nos. ML14100A106 and ML14100A135).
2. ESP Applications currently under review
  • Tennessee Valley Authority, Clinch River Nuclear Site: Application submitted on May 12, 2016. NRC accepted the application for docketing and detailed technical review on January 5, 2017 (ADAMS Accession No. ML16355A162).
