In accordance with 10 CFR 70.38(j), this letter submits the Westinghouse Electric Company LLC (Westinghouse) application for termination of the Hematite Decommissioning Project (HDP) License SNM-00033. Westinghouse has completed all decommissioning activities specified in License Condition 15 (Reference 1 ).

APPLICATION FOR TERMINATION OF THE LICENSE 10 CFR 70.38(j)(l) states:

(j) As the final step in decommissioning, the licensee shall-(1) Certify the disposition of all licensed material, including accumulated wastes, by submitting a completed NRC Form 314 or equivalent information; and As documented in Reference 2, Westinghouse certifies that the Special Nuclear Material Inventory is zero and as such request the termination of the HDP assigned Reporting Identification Symbol (RIS) of "ZWQ" concurrent with termination of License SNM-00033.

By submittal of the DOE/NRC Form 741 for required waste shipments, and also as documented on NRC Form 540, Uniform Low-Level Radioactive Waste Manifest for each waste shipment conducted at the HDP, Westinghouse certifies that licensed material in the form of waste has been properly dispositioned in accordance with the Hematite Decommissioning Plan Chapter 12.0, Radioactive Waste Management Program.

To facilitate compliance with 10 CFR 70.59, Effluent monitoring reporting requirements, the HDP will continue implementation of the HDP Environmental and Effluent Monitoring Program through December 31, 2017. Upon the completion of environmental and effluent monitoring activities during the week of

Subsequently the radioactive sealed check sources, as authorized in License SNM-00033 (6.E and 6.F),

required to conduct the monitoring will be dispositioned by transfer to another NRC authorized Licensee or dispositioned as radioactive waste. Westinghouse expects to complete disposition of the radioactive sealed sources within the month of January 2018. Upon final disposition of the radioactive sealed check sources Westinghouse will provide written notification to the NRC of the final disposition.

During NRC Region III/Oak Ridge Associated Universities (ORAU) confirmatory survey activities during the week of October 16, 2017, Investigation Derived Waste (IDW) was generated during the core bore soil sampling operations. Preliminary radiological assessment of the IDW at the time of sampling did not indicate the presence of radioactive material. At that time Westinghouse agreed to store the IDW on-site until such time as NRC Region III provides documented sample analysis results that determine the appropriate disposition of the IDW. NRC Region III has communicated to HDP personnel that it expects to issue an inspection report regarding these confirmatory survey activities during the first quarter of 2018. At that time it is expected that Westinghouse will receive from NRC Region III the necessary sample analysis documentation that will allow Westinghouse to coordinate with NRC Region III regarding the appropriate disposition of the IDW. Upon final disposition of the IDW Westinghouse will provide written notification to the NRC of the final disposition of the IDW.

Upon final disposition of the sealed sources and IDW, Westinghouse will inform the NRC in writing.

10 CFR 70.380)(2) states:

(2) Conduct a radiation survey of the premises where the licensed activities were carried out and submit a report of the results of this survey, unless the licensee demonstrates in some other manner that the premises are suitable for release in accordance with the criteria for decommissioning in 10 CFR part 20, subpart E. The licensee shall, as appropriate-(i) Report levels of gamma radiation in units of millisieverts (microroentgen) per hour at one meter from surfaces, and report levels of radioactivity, including alpha and beta; in units of megabecquerels (disintegrations per minute or microcuries) per JOO square centimeters removable and fixed for surfaces, megabecquerels (microcuries) per milliliter for water, and becquerels (picocuries) per gram for solids such as soils or concrete; and (ii) Specify the survey instrument(s) used and certify that each instrument is properly calibrated and tested Westinghouse has completed the Final Status Survey for the Hematite Facility which demonstrates that the premises are suitable for unrestricted release in accordance with the criteria of 10 CFR 20.1402.

Reference 3 contains Final Status Survey Final Report (FSSFR) Volume 7, Chapter 1, Final Status Survey Final Report Summary which summarizes the results of the radiological surveys.

The Final Status Survey has been completed in accordance with the survey methodologies approved by the NRC as contained within the approved Hematite Decommissioning Plan and Associated Supporting Documents. The radiological surveys for each survey unit and reuse soil stockpile are provided in a survey area release record as submitted in the appropriate FSSFR Volume and Chapter.

Page 3 of3 Ourref: LTR-NRC-17-78 December 20, 2017 With the submittal of this application for termination of License SNM-00033 along with the preceding correspondence to the NRC containing decommissioning and Final Status Survey information that Westinghouse has provided the necessary information as provided in 10 CFR 70.38(k) for the NRC to determine that License SNM-00033 can be terminated.
