ENCLOSURE 1 NOTICE OF VIOLATION Virginia Electric and Power.Company Surry Units l*and 2 Docket Nos. 50-280, 50-281 License Nos. DPR-32, DPR-37 During the Nuclear Regulatory Corrmission (NRC) inspection conducted on November 1 through 30, 1991, a violation of NRC requirements was identified.

In accordance with the- "Genera 1 Statement of Po 1 icy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1991), the violation is listed below:

Technical Specification 3.8.A requires that containment integrity, as defined in Technical Specification Section 1.0, be maintained unless the reactor is in the cold shutdown condition.

Technical Specification 1.H.1 requires, in part, that all non-automatic containment isolation valves be locked closed and under administrative control.. _.-

Contrary to the above, the main steam trip va.lves' bypass valves, 1/2-MS-"84, l/2-MS-116, and l/2-MS-155 are non-automatic containment isolation valves that were not locked closed or under administrative control when open.

Th1s condition has existed for an indefinite period of time with Units 1 and 2 in the intermediate shutdown, hot shutdown, or critical conditions.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Virginia Electric and Power Company is hereby required to submit a written statement or explanation to the U.S.

Nuclear Regulatory Corrmission, ATTN: Docu~ent Control Desk, Washington, D.C.

20555 with a copy to the Regional Administrator, Region II, a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

This reply should be clearly marked as a "Reply to a Notice of Violation" and should -fnclude for each violation:

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the licehse should not be modified, 9201280075 911230 PDR ADOCK 05000280 G
