Action Statements THE MEPRS SHALL:

3.1 As needed for clarification, complete the Document Summary and Review Log Sheet (Appendix 1) for documents which are to be sent out for review.

Note in the document summary the reason for its preparation/revision and any reference/support materials used.

3.2 Provide the document for final review in accordance with NC.NA-AP.ZZ-0001 (Q), and Appendix 2 of this procedure.

3.3 Review and approve all typographical and editorial revisions (See NC.NA-AP.ZZ-0001 (Q), for guidance).

These revisions will indicate on the Signature Sheet, the last revision number reviewed and,approved by the responsible General Manager ( s ). -

Station Operations.

3.4 Submit to the Director -

GM-QA & Nuclear Safety Review for review and approval, revisions to the Emergency Plan, except for editorial only revisions.

3.5 Submit to Director -

QA & Nuclear Safety Review and SORC, for review and approval, new documents or revised documents that require a 10CFR50.59 safety evaluation OR involve a potential decrease in the effectiveness of the Emergency Plan per 10CFR50.54{Q).

3.6 Maintain a current and historical file of Plan/EPIP/ECG r~visions.

3.7 Assign an Emergency Preparedness Staff member as appropriate to perform 10CFR50.59 applicability reviews and peer reviews and if applicable to complete required safety evaluation IAW NC.NA-AP.ZZ-0059(Q).

3.8 Initiate document distribution according to EPIP 1002, Distribution of Plan/EPIP/ECG.

NOTE Plan Attachments do not require review since they are not implemented by PSE&G personnel.

STATION QUALIFIED REVIEWER 3.9 Complete SQR Review form and return to MRS (see Appendix 3).

3.10 Sign-off SQR Review on signature sheet.

This sign-off indicates that the procedure/revision is technically correct and does not compromise nuclear safety.

1. 2 NBU-EP The Chief Nuclear Officer & President - Nuclear Business Unit has the overall responsibility for the development and updating of emergency planning and coor~ination of the plans with other response organizations.

The organization for coordination and di-rection of emergency planning matters is shown in Figure 17-1.

The Manager - Radiological Safety has been delegated the authority to approve the Emergency Plan and Implementing Procedures for adequacy and consistency.

He is assigned the responsibility for ensuring that the Emergency Plan and Implementing Procedures are appropriately interfaced with the plans, procedures, and training of offsite support agencies as required to maintain suitable timely notifications and development of protective action recorr.mendations.

Review and Approval of Emergency Preparedness Documents As appropriate, the applicable Station Operations Review Committee (SORC) reviews emergency plans and procedures as they relate to nuclear safety in accordance with Technical Specifications.

The General Manager of Station Operations approves plans and procedures applicable to his/her station in accordance with Technical Specifications.

The review and approval of the Emergency Plan, Implementing Procedures, Event Classification Guide, and Emergency Preparedness Administrative Procedures will be done in accordance with Table 17-1.

A list of each section or procedure is maintained in front of the Emergency Plan and Emergency Plan Implementing Procedures indicating the latest revision number and effective date.

Distribution All revisions are distributed by the Document Distribution Group in accordance with Nuclear Department Administrative Procedures.

Automatic Review The Emergency Plan and associated documents are reviewed at least once each year.

As part of the r2view, the Event Classification Guide is reviewed with the state and local governments.

The Emergency Plan a~d associated documents are updated and procedures are improved, based upon training exercises/drills, and changes onsite or in the environs.

Quality Assurance/Nuclear Safety Review.

Management directive~ provide instructions for ;valuation and correction of audit findings, training, readiness testing, and emergency equipment.

The results of the review and actions taken are forwarded to the Station General Managers, the Manager -

Radiological Safety, and the reviewers.

The records of these reviews are retained for five (5) years.

Maintenance of Documents The persons holding controlled copies of the Emergency Plan and associated documents are responsible for their maintenance, which consists of promptly incorporating all revisions and additions and replacing any lost or damaged portions.

Replacements for any pages are supplied upon request.

Each such distribution shall be accompanied by instructions for insertion into the document indicating which pages are to be replaced, deleted or added.

A certification that this updating has been done is also included which is signed by the document holder and returned to the Document Distribution Group.

These receipts are recorded by the Document Distribution Group.

A file of master copies of each revision of each Emergency Plan is retained by the Manager -

Radiological Safety.

Since your nuclear facility is located in Region I, the Brookhaven Area Office is charged with the responsibility for providing radiological assistance in the event of an emergency.

Such assistance can be requested at all times by calling (516) 282-2200 and asking for radiological assistance, indicating the nature of the incident, the location, and which authorities have been notified so that we can coordinate our response with them.

The Department of Energy

{DOE) will respond to requests for radiological assistance from licensees, Federal, State, and local agencies, private organizations, or individuals involved in or cognizant of an incident believed to involve source, by-product, or special nuclear materials as defined by the Atomic Energy Act of 1954, as amended, or other ionizing radiation sources.

Unless the DOE or a DOE contractor is responsible for the activity, ionizing radiation source, radioactive material involved, or the rendering of assistance to control the immediate hazards to health and safety, radiological emergency assistance will be terminated as soon as the emergency situation is under control.

Therefore, responsibility for post-incident recovery, including further action for the protection of individuals and the public health and safety,

'should be assumed by the appropriate responsible Federal, State, or local government, or private authority as soon as the emergency conditions are stabilized.

The potential for a release of radioactive materials that could seriously effect the public health and safety was minimized with the implementation of regulations for the design, construction, and operation of nuclear power plants.

To further minimize such hazards, federal, state, and local governments were required to develop emergency contingency plans.

101.2 As per agreements between the U.S. Coast Guard and the States of Delaware and New Jersey, the U. S. Coast Guard will provide assistance for the protection of public health, safety and welfare from radiological hazards as a result of a radiological incident.

This plan does not relieve state and local governments of their responsibility to plan for responding to a radiological emergency, but is designed to support their efforts.

102 PURPOSE AND OBJECTIVES 102.1 This plan addresses Coast Guard response actions and preparedness for radiological emergencies from nuclear power plants in the COTP Philadelphia area of responsibility.

Coast Guard response activities will be restricted to areas on or adjacent to the navigable waters of the United States.

102.2 This plan also outlines response actions by agencies of the federal, state and local governments within the Captain of the Port (COTP) Philadelphia area of responsibility to ensure a coordinated Coast Guard response.

103 BACKGROUND There are four nuclear power plants in operation in the COTP, Philadelphia zone:

Oyster Creek Nuclear Generating Station located in Ocean County, NJ and Salem I, Salem II and Hope Creek Nuclear Generating Stations located on Artificial Island, Salem County, NJ.

103.1 Oyster Creek Nuclear Generating Station is operated by General Public Utilities (GPU)-Nuclear Corporation.

It is located on a 1,416 acre plot in both Lacey and Ocean townships, Ocean County, NJ The facility is approximately 38 miles north of Atlantic City, NJ and 55 mile east of Philadelphia, PA.

The facility is situated in a broad lowland and tidal marsh area of the New Jersey coast and is flanked on ~he cu~~ ~~ Q~rneqat Bay.

Within the Emergency Planning Zone (EPZ), a 10 miles radius around a nuclear facilities, there are over 5000 rental slips and 6000 private docks.

During a summer weekend up to 600 vessels NBU-EP Rev.7

and pleasure boats operate in the EPZ and 3000 vessels in Garnegat 63y and offshore.

PLAN A'l'T. 2-1. 3 Pg. 6 of 3 0 103.2 Hope Creek Nuclear, Salem I and Salem II Generating Stations are situated on a low-lying coastal plain featuring extensive marsh and meadowlands at the southern tip of Artificial Island in Lower Alloways Creek Twp, Salem County, NJ.

They are owned and operated by the Public Service Electric and Gas (PSE&G)

Co~pany.

The stations are roughly midway between Wilmington and Dover, Delaware approximately 20 miles north and south of the site, respectively.

Philadelphia is approximately 32 miles NNE of site.

Most of the land within five counties surrounding the site is undeveloped (48%) or is used for agriculture (42%).

104 SCOPE 104.1 The area of primary concern during a radiological emergency is the EPZ.

People within this zone may be subjected to whole body external exposure to gamma radiation or inhalation of a radioactive plume.

This zone is further divided into Emergency Response Protection Area (ERPAs) or Emergency Planning Areas (EPA) by state and local planners.

104.2 To protect the public during a radiological emergency, sheltering and evacuation of the public and isolation of ingestion pathways and source actions are available to emergency response authorities.

(a) General Sheltering:

Entire population is notified to stay indoors and secure ventilation systems to protect against exposure to radioactive plume-incidents of short duration.

(b) General Evacuation:

Most extreme protective action, involving the relocation of the entire population in affected areas.

105 EMERGENCY CLASSIFICATION LEVEL 105.1 Four progressive emergency classification levels have been established by the Nuclear Regulatory Commission (NRC) to aid in preparing for and responding to radiological incidents.

Whenever an initiating condition for any of the four action levels exists, it is the responsibility of the facility operator to provide prompt notificatioh to local, state and federal authorities.

The following is a list of the four emergency classifcation levels:

Any releases are expected to be limited to small fractions cf the Environmental Protection Agency (EPA) protective action guiceline exposure levels.

Coast Guard notification and preparations will be made at this level.

Generally, no Coast Guard response will be required unless the situation indicates further escalation.

For the Salem I, Salem II and Hope Creek power plants on Artificial Island, consideration must be paid to the transit time for commercial vessels that are or will transit those ranges of the Delaware River within the EPZ.

c) Site Area Emergency:

Events are in progress or have occurred which involve actual or likely major failures of plant functions needed for protection of the public.

Releases are not expected to exceed EPA protection action guideline exposure levels except near the site boundary.

A Coast Guard response would most likely occur at this level.

d) General Emergency:

Events are in the process or have occurred which involve actual or imminent substantial core degradation or melting with potential for loss of containment integrity.

Release can be reasonably expected to exceed EPA protection action guidelines exposure levels off site for more than the immediate site area.

106 GENERAL RESPONSIBILITIES 106.1 As set forth in the New Jersey and Delaware state emergency response plans, the New Jersey State Police Superintendent is the OSC for an emergency at Oyster Cree Nuclear Generating Station and the Delaware State Police Sups~intsndent is the OSC for an emergency at Salem I, Salem II and the Hope Creek Nuclear Generating Stations.

In addition, it is the responsibility of each county to provide resources such as personnel and equipment in an emergency response incident.

The health and property of the public and the emergency workers are the primary concerns.

The states will provide space in their Emergency Operations Center (EOC) for a Coast Guard liaison officer.

106.2 The states of New Jersey and Delaware have the responsibility in recommending protective actions to prevent or minimize radiation exposure to the populations in their respective states.

In addition, the states will provide technical guidance and evaluations to responders.

Resource assistance such as personnel, equipment and supplies may be provided if local resources are not sufficient to cope with the effec~s of the emergency.

106.4 FecerLll agency responsibilities are as follows:

a)

The Federal Emergency Management Agency (FEMA):

Responsible for all off site nuclear emergency planning and response.

This agency is charged with establishing policy for and coordinating all civil emergency planning and assistance functions for federal agencies.

b) The U. S. Nuclear Regulatory Commission (NRC):

Responsible for verifying that appropriate emergency plans have been implemented and for conducting investigative activities associated with a radiological emergency.

c) The U. S. Department of Energy (DOE):

Responsible for providing emergency operations to assist state and local governments in protecting the health and safety of individuals, the public, and environment in the event of a radiological emergency.

This agency provides for the use of available federal resources.

d) The U. S. Coast Guard (USCG):

Responsibilities include SAR coordinator and primary federal law enforcement agency on the U. S. navigable waters.

COTP Philadelphia jurisdiction includes the Delaware River and its tributaries and the navigable waters in the vicinity of Barnegat Bay.

The Coast Guard will provide resources to assist state marine police in the effective implementation of protective response actions on the navigable waters in these areas.

The COTP has authority to direct the movement and operation of vessels within a designated safety zone pursuant to the Ports and Waterways Safety Act.

Coast Guard small boats will assist in the enforcement of safety zones.

Small boats from USCG Station Barnegat are under the operational control of Commander, Coast Guard Group Cape May.

Small boats from Station Manesquan are under the operational control of Commander, Coast Guard Group Sandy Hook.

Their use during an emergency will be coordinated by COTP Philadelphia through these commands.

e) Other agencies will provide assistance including the Civil Defense Preparedness Agency, Department of Agriculture, National Oceanic and Atmospheric Administration, Department of Defense, Public Health Service, Federal Aviation Administration, and the National Aeronautics and Space Administration.

Preparedness measures have been taken for the Oys~e~ Creek, Hope Creek, and Salem I and Salem II Nuclear Generating S~ations to ensure adequate notification procedures, reliable communication systems, proper response coordination, and the availability of operational monitoring equipment.

202 Response Planning 202.l Effective and coordinated response is achieved by developing a response plan which meets the following objectives:

1.

Designate participating agencies and their areas of responsibility;

2.

Develop notification, activation, and response procedures; and

3.

Designate resources, such as personnel, equipment, etc.

to utilize in the response effort.

202.2 This plan covers areas within the COTP Philadelphia zone.

It is a support plan for New Jersey State Radiological Emergency Response plans for Oyster Creek, Salem I, Salem II, and Hope Creek Nuclear Generating Stations and the Delaware State plan for the Salem I, Salem II and Hope Creek Nuclear Generating Stations.

203 LOGISTICS 203.1 COTP Philadelphia will maintain telephone and radio communication with all affected Coast Guard units.

203.2 New Jersey Office of Emergency Management will supply the Coast Guard with dosimeters and radiological monitoring equipment.

202.3 Commanding Officer, Coast Guard MSO/Group Philadelphia, with the support of Commander, Coast Guard Group Cape May and Commander, Coast Guard Group Sandy Hook will assist state marine police to ensure waterside safety.

204 EXERCISES AND DRILLS 2C1.!

rnTP Philadelphia will coordinate Coast Guard participation i~ annual exercises conducted by the nuclear facility operators, loca~ and state authorities.

Th~se periodic exercises will generate feedback to ensure the adequacy of response plans and the coordination of response organizations.

COTP Philadelphia will provide a liaison officer to the Emergency Operations Center located at the New Jersey State Police Headquarters in West Trenton, and to the Emergency Operations Center, Delaware City, Delaware, as appropriate.

301_2 Coast Guard liaison officers will aid the flow of information and the coordination of response actions of the Coast Guard with the state and local governments.

The response actions will range from telephone communications to establishing a safety zone_

If necessary, the Coast Guard will work with state marine police units to assist in the evacuation of shoreline areas.

302 NOTIFICATION AND RESPONSE PROCEDURES 302.1 NOTIFICATION OF AN UNUSUAL EVENT Unusual events are in process or have occurred which indicate a potential degradation of the level of safety of a nuclear plant.

No release of radioactive material requiring off-site response or monitoring is expected.

The Coast Guard will not be notified at this level.

302.2 ALERT STAGE (a)

The COTP Philadelphia will be notified in the event of a radiological emergency at the alert or emergency classification level by authorized representatives of either the Governor of New Jersey or Delaware.

Emergency personnel at the Oyster Creek, Salem I, Salem II or Hope Creek Nuclear Generating Stations will provide notification to the COTP Philadelphia in the event the States cannot be contacted.

The checklist found in Annex II will be used by the COTP to receive the report.

With consultation from the States of New Jersey and Delaware, the COTP Philadelphia may establish a safety zone at this time with the size of the safety zone dependent on the potential of a radiation release.

(b)

The safety zone will be enforced with vessels from Station Barnegat, Station Beach Haven and Station Manesquan for an incident at the Oyster Creek Station and MSO/Group Philadelphia and Group Cape May for incidents at the Salem I, Salem II and Hope C~eek Stations.

Vessel traffic will be restricted from entering the saf 0 ~y zone without permiss~nn fr0m the COTP Philadelphia.

Delaware and New Jersey marine police may provide additional vessels to assist in the enforcement of the safety operations_

~:1cidents at the Oyster Creek Generating Station, small boots fro:~ Coast Guard Station Beach Haven and Station Barnegat will enforce the safety zone at the Route 72 causeway bridge, which is loc:~ted at the southern extent of Manhawkin Bay.

Station Barriegat will enforce the safety zone at Barnegat Inlet and seaward to approximately 5 miles.

Station Manesquan small boats will enforce the northern end of the safety zone at Barnegat Island north to Route 37 causeway bridge.

NJ State Marine Police will evacuate boaters from all navigable waters, including inland waters, within the safety zone and will assist in the enforcement of the safety zone.

An estimated evacuation time of tr.e initial ten mile safety zone would be three hours in the winter months and twelve to eighteen hours in the summer months.

Anyone needing to seek medical help should refer to Annex V.

(d)

For incidents at the Salem I, Salem II and Hope Creek Generating Stations a safety zone will be established on the Delaware River preventing vessel traffic from entering the affected area.

Small boats from MSO/Group Philadelphia and Group Cape May will enforce the safety zone.

NJ and DE State Marine Police will evacuate boaters from effected navigable waters, including inland waters, within the safety zone and will assist in the enforcement of the safety zone.

An estimated evacuation time of the initial ten mile safety zone would be three hours in the winter months and six hours in the summer months.

Anyone needing to seek medical help should refer to Annex V.

(e) A notice to mariners will be transmitted by the Coast Guard on channel 16 initially and then on 22A to all mariners in the area, notifying them of the safety zone (Annex III).

This message will be rebroadcast once every (10) minutes for the first thirty (30) minutes and once every thirty minutes thereafter until cancelled.

Emergency Broadcast System (EBS) and NOAA Weather Radio System will be provided similar messages by the states' emergency management officials for broadcast over their systems.

If the safety zone is in the Delaware River or Bay, the COTP will advise Coast Guard Group Baltimore and Marine Safety Office Baltimore that vessels may not be permitted to enter or depart the C & D Canal from the Delaware River.

Group Baltimore may be requested to position a small boat at the western entrance to the C & D Canal to control vessel traffic.

(f) Notification of the safety zone will be made to the maritime community through the Maritime Exchange and through telephone notification to local marinas.

(g) Placement of personnel on scene for enforcement of the safety zone will be-dependent on assurances of a safe working environment.

NBU-EP STATEMENT OF AGREEMENT AND CONDITIONS OF NOTIFICATION ARTIFICIAL ISLAND GENERATING STATIONS

?LAN ATT. 2-1.4 Pg. 2 of 8 Public Service Electric and Gas Company (hereafter called PSE&G) will provide notification to the state of New Jersey, Division of State Police, Office of Emergency Management (hereafter called OEM) and the State of New

Jersey, Department of Environmental Protection, Bureau of Nuclear Engineering (hereafter called BNE) in accordance with the conditions discussed below:

I. NOTIFICATION ME~HODS/LOCATION All notification calls will be made to the communica.tions Center of the New Jersey State Police in West Trenton, N*ew Jersey. The primary means of communications will be the Artificial Island Nuclear Emergency Telecommunications system to the extension assigned to the Communications Bureau/OEM Operations Room. Normal commercial communications will be utilized as the secondary means of communications.

The OEM and BNE will coordinate internal procedures for ensuring that the appropriate cognizant officials of the OEM and BNE are subsequently notified by the New Jersey state Police Communications Bureau.

II. NOTIFICATIONS TO BE PERFORMED A.

Notification of any event declared as one of the Emergency Classes specified in either the Salem Generating Station or Hope creek Generating station Emergency Plans (or Artificial Island Emergency Plan when it supersedes existing plans) will be provided within fifteen (15) minutes of the declaration.of that event.

B.

With the exception of paragraph II. c below, a notification of any event declared in accordance with the guidelines contained in Title 10, Code of Federal Regulation (CFR), Chapter 50, Paragraph 50.72 (b),

"Non-emergency events" will be provided within the first working day following the declaration of the event.

PLAN ATT. 2-1.4 Pg. 3 of 8 For events classified in accordance with Title 10 CFR, Chapter 50, Paragraph 50.72 (b) (2) (vi), which are not declared as an Emergency Class (as specified in Paragraph II A above) notification will be provided within four (4) hours of the declaration of the event, or prior to the issuance of a news release.

III. CLARIFICATION OF CONDITIONS OF NOTIFICATIONS A.

It shall be understood that the notification requirement for any one event will be fulf ill~d if that notification is performed in accordance with II A above.

B.

Follow-up notifications and communications for those events handled in accordance with II A above shall be conducted as specified in the appropriate emergency plan and emergency plan procedures.

c.

Follow-up information for any event notification made in accordance with Paragraphs II B or II c above shall be requested through either the Manager -

Licensing &

Regulation, Nuclear Department, PSE&G, or the Emergency Preparedness Manager, Nuclear Department, PSE&G.

D.

"Next Working Day", will be the next regularly** schedule PSE&G work day (8:00 a.m. -

4:30 p.m.) immediately following the event. This specifically excludes weekends and PSE&G company holidays.

E.

A copy of each Licensee Event Report (or supplementary Licensee Event Report "associated with the event notification") will be provided to the BNE for all follow-up activities reported to the NRC. All substantive LER questions on behalf of the BNE shall be directed in writing to the Manager -

Licensing &

Regulation, Nuclear Department, PSE&G.

IV. FINAL IMPLEMENTATION This agreement shall be effective on the date of the last signature on the document.

MEMORANDUM OF UNDERSTANDING BETWEEN NEW JERSEY DIVISION OF STATE POLICE NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION AND PUBLIC SERVICE ELECTRIC & GAS COMPANY TO PROVIDE FOR THE IMPLEMENTATION OF THE STATE OF NEW JERSEY RADIOLOGIC.l\\.L RESPONSE PLAN FOR NUCLEAR POWER PLANT PURPOSE:

Gas Company (the Utility) will notify the State Government of New Jersey (Commissioner of the N.J.

Department of Environmental Protection and Superintendent of the N.J.

Division of State Police) in the event of an accident which has the potential for radioactive exposure or contamination of members of the public of their property.

Proper and timely flow of information throughout the duration of any such accident is essential in order for the Government of the State of New Jersey to discharge its obligation to maintain public health and safety by implementing protective actions as described in the State of New Jersey Radiological Emergency Response Plan for Nuclear Power Plants (NJRERP) or its successors.

II.

DEFINITIONS:

To minimize the possibility of conununications breakdown, the definitions listed in the State of New Jersey Radiological Emergency Response Plan for Nuclear Power Plants ( NJRERP) shall apply throughout this Memorandum of Understanding.

III. AGREEMENT:

The following terms shall be binding upon the state and the Utility:

A.

The Utility and state shall cooperate at all times in developing, review.ing, and modifying protective action plans for accidents which endanger the public.

B.

The state and Utility shall join in at least one annual exercise.

The Utility shall provide and maintain a

This telephone is located in the Shift Supervisor 1 s Office, the onsite Technical Support Center and the offsite Emergency Operations Facility, which will have the sole purpose of maintaining communications with State Government in the event of a suspected or confirmed accident endangering the public.

The state will provide a telephone with an unlisted number in the office of the New Jersey state Department of Environmental Pliotection, Bureau of Nuclear Engineering (BNE).

These telephone numbers will be exchanged by the state and the Utility.

Both the State and the Utility further agree not to divulge the unlisted numbers to any other party.

D.

The Utility shall install and maintain, at each reactor site; wind speed and direction Indicators to provide information for implementing protective actions.

E.

The Utility shall notify the State as soon as possible but no later than fifteen minutes after the declaration of any ~incident defined in their utility's emergency plan as an unusual event, alert, site area Emergency or general emergency.

In addition to the above conditions, the Utility will notify the state of plant conditions which will generate public, government, or media concern about plant safety.

At minimum, the state will receive notification as stipulated in the appended Statement of Agreement and Conditions of Notification -

Artificial Island Generating stations.

The content of this section shall not be construed to

  • imply regulatory authority supplanting or *in addition to the Nuclear Regulatory Commission's (NPC) regulatory authority.

F.

The Utility will provide the State with information needed to protect the public as soon as it is available.

G.

The Utility shall furnish the state with two (2) copies of its facility Em~rgency Plan and amendments thereto as they are issued.

The state shall furnish the Utility with (2) copies of its NJRERP and amendments thereto as they are issued.

H.

The Utility has the right and, in a case in which the Bureau of Nuclear Engineering personnel are unavailable, the duty to recommend protective action to the state of New -!ersey.

The notification shall be made by the Utility by telephone to New Jersey state Police by a format agreed to by both the Utility and the state.

Technical information essential for evaluation and management of the accident shall be given to designated NJ DEP Bureau of Nuclear Engineering personnel.

J.

An accident shall be deemed to have terminated when, in the judgement of the State, there is no longer* need for consideration of further protective actions as defined in the NJRERP.

K.

Throughout the emergency, the Utility will work closely with and coordinate all media news releases relating to the status of the plant with the Governor's Office, and the State Police, the State Department of Environmental Protection, and the Nuclear Regulatory Commission.

The Utility will bear the responsibility for news releases relating to the status of the plant until the Governor declares a

formal State of Emergency.

With the declaration of formal state of Emergency, all news releases will be made jointly by the Governor of his representative and the Utility after agreement is reached on content.

All news releases issued by the Utility during an emergency, prior to a declaration of a formal state of emergency will be immediately hand delivered to state representatives at the.Emergency News Center and will be passed by telefacsimile to the State EOC and the BNE headquarters.

All state releases will be hand delivered to PSE&G representative at the Emergency News Center and passed by telefacsimile to the Public Information Department at Artificial Island.

L.

This Memorandum of Understanding supersedes and voids all previous Memoranda of Understanding between the State Department of Environmental Protection, the Division of State Police and the Utility for the purpose of providing protection to the public in the event of accident threatening public life or property.

M.

This agreement shall be effective immediately upon execution of the p~rties hereto.

AND STATE OF DELAWARE DEPARTMENT OF PUBLIC SAFETY DELAWARE EMERGENCY MANAGEMENT AGENCY Plan Att.2-1.5 Pg. l of 10 TO PROVIDE FOR THE IMPLEMENTATION OF PROTECTIVE ACTIONS ON BEHALF OF THE GENERAL PUBLIC IN THE EVENT OF AN ACCIDENT WHEREAS, Public Setvice Electric and Gas Company (herein referred to as PSE&G) is authorized to operate nuclear facilities in Lower Alloways Creek Township, New Jersey (herein referred to as PSE&G operated nuclear generating fadlities) under licenses granted by the U.S. Nuclear Regulatory Commission (NRC); and WHEREAS, the N RC requires that the level of onsite and offsite emergency preparedness provides reasonable assurance that adequate protective measures can and will be taken in the event of a radiological emergency; and WHEREAS, a portion of the State of Delaware is included m the emergency planning zone for PSE&G operated nuclear generating facilities; and WHEREAS, the Federal Emergency Management Agency (FEMA) must make findings and determinations as to whether the State of Delaware Radiological Emergency Plan is adequate and capable of being implemented; and WHEREAS, the State of Delaware has requested funding pursuant to 20 Del. C.

§3104 for activities and equipment associated with its development and maintenance of a Radiological Emergency Plan which satisfies NRC and FEMA rules, regulations, and requirements for radiological emergency preparedness as they pertain to PSE&G operated nuclear generating facilities; THEREFORE, the parties hereto in consideration of the COVENANTS set forth herein agree as follows:

PSE&G agrees, pursuant to 20 Del. C. §3104 in accordance with the provisions of this Memorandum of Understanding, to fund activities and equipment associated with the developme~t and maintenance of a Rev.7

Plan Att.2-1.5 Pg. 2 of 10 Radiological Emergency Plan for the State of Delaware in support of the PSE&G operated nuclear generating facilities; In consideration of this funding, the Director of the Delaware Emergency Management Agency (herein referred to as DEMA Director), Department of Public Safety, State of Delaware, pursuant to 20 Del. C. §3104 shall be responsible for maintaining in full effect at all ti~es relevant to this agreement the provisions of the Delaware Radiological Emergency Plan and supporting documents for the PSE&G operated nuclear generating facilities;

For the purpose of this Memorandum of Understanding, the fiscal year shall be from July 1st to June 30th; Sixty (60) days prior to the beginning of each fiscal year, the DEMA Director shall submit a budget to PSE&G for activities and equipment associated with the Delaware Radiological Emergency Plan for the PSE&G operated nuclear generating facilities which are not otherwise funded through appropriations available to the Delaware Emergency Management Agency. Under no circumstances will PSE&G provide funding for activities or equipment for which funding from other sources is available;

Thirty (30) days prior to the beginning of a fiscal year, PSE&G shall notify the DEMA Director of the acceptability and approval of those. budget items for which PSE&G will provide funding; 5.

Funds shall be provided by PSE&G for those accepted and approved budget items; The DEMA Director shall be responsible for insuring that funding provided is used exclusively for PSE&G approved budget items; The DEMA Director shall maintain a detailed account of all expenditures of PSE&G provided funds in accordance with generally accepted accounting principles; PSE&G reserves the right to audit and/or require accounting for all goods and services for which it has provided funding; The DEMA Director shall supply an accounting of actual, as opposed to estimated, expenses for which PSE&G provided funding on a quarterly basis to PSE&G Chief Nuclear Officer and President, Nuclear Business Unit; At the conclusion of each fiscal year, unexpended budget funds shall be reported to PSE&G. Emergency Action Levels Unusual Event - Unusual Events, as used for emergency planning purposes, characterize off-normal plant conditions that may not in themselves be particularly significant from an emergency prepared:ne-ss standpoint, but could reasonably have the potential to increase in significance if proper action is not taken or if circumstances beyond the control of the operating staff render the situation more serious from a safety standpoint. No uncontrolled releases of radioactive materials requiring offsite response or monitoring are expected unless further degradation of safety systems occur. For all of these situations the State will be notified as soon as the event has been declared [within fifteen (15) minutes]..

Alert - The Alert action level is the lowest level where some necessity for emergency planning offsite response may be anticipated. Even so, from the standpoint of Federal, State or Local authority such notification is advisory in nature for Alert level condition. This class includes physical occurrences within the plant which may require station staff emergency organization response. The initial assessment leading to this class should indicate that it is unlikely that an offsite hazard will be created. This class is associated with judgement that the emergency situation can be corrected and controlled by the plant staff. Any releases are expected to be limited to small fractions of the EPA Protective Action Guideline exposure levels.

For all of these sftuations, the State will be notified as soon as an event has been declared

[within fifteen (15) minutes]. Furthermore, the onsite Technical Support Center will be activated and the near-site Emergency Operations Facility may be activated.

Site Area Emergency - The Site Area Emergency action level reflects conditions where there is a clear potential for significant releases, such releases are likely, or they are occurring; but in all cases where a core meltdown situation is not indicated based on current information.

Any releases are not expected to exceed EPA Protective ~ction Guideline exposure levels except near site boundary.

General Emergency - The General Emergency action level reflects accident situations involving actual imminent substantial core degradation or melting with the potential for loss of containment integrity.

Releases can be reasonably expected to exceed EPA Protective Action -Guideline exposure levels offsite for more than the immediate site area.

For all of these situations, the New Castle and Kent County Communication Centers, DEMA and Delaware State Police Headquarters Communication Center will be notified as soon as an event has been declared [within fifteen (15) minutes].

Furthermore, the onsite Technical Support Center, and the near-site Emergency Operations Facility will be activated. The recommendation for any offsite action involving the public, sheltering out to a fixed distance, or evacuation out to a fixed distance will be communicated to the State at the earliest possible time following the declaration of a General Emergency.

Hope Creek Generating Station - A nuclear power reactor owned in part and operated by Public Service Electric and Gas Company situated within the State of New Jersey, and located within ten miles of the State of Delaware.

NETS - An installed telecommunications branch exchange owned and operated by the Utility for the purpose of emergency communications with the State, county and local governments and the Utility's emergency response facilities.

Offsite - All areas outside of the nuclear generating station's security perimeter.

Radiological Public Safety Accident - An incident which may include unwanted or unplanned movement of the fission product inventory leading to the discharge of fission products beyond facility poundaries above prescribed Rev.7

AGREEMENT The following terms shall be binding upon the State and the Utility:

The Utility and the State shall cooperate at all times in developing, reviewing, modifying and exercising protective action plans for radiological public safety accidents.

The State and Utility shall join in at least one annual coordinated exercise.

The Utility shall be responsible for coordinating such an annual exercise.

The Utility and the State shall annually review the REP. Each party reserves the right to suggest change at any time.

The Utility shall at all times provide and maintain dedicated telephones located in the shift supervisor's office, the onsite Technical Support Center and the near-site Emergency Operations Facility. The dedicated telephones, an emergency telephone circuit which is part of NETS, shall be for the purpose of maintaining communication with the State in the event of a confirmed or suspected radiological public safety accident. The Utility shall henceforth provide similar telephones, to be located in the offices of DEMA and the Delaware State Police Headquarters Communications Center. The dedicated telephones will be the primary means of communications.

Communications verification will be scheduled and initiated by the Utility.

These verifications will occur at least once each calendar month.

Throughout the entire duration of a radiological public safety accident, the DEMA Director and/or designees shall have access to J:.he near-site Emergency Operations Facility upon presentation of an authorized Delaware Emergency Worker Card. No more than four Delaw(lre personnel shall be present in the Emergency Operations Facility at any time except when requested by the DEMA Director and approved by the Utility's Site Support Manager and/or Emergency Response Manager.

The Utility shall furnish the State with two (2) copies of its Facility Emergency Plan Implementing Procedures and amendments thereto as they are issued. DEMA shall furnish the Utility with five (5) copies of its REP and amendments thereto as they are issued.

In the event of a radiological public safety accident, the Utility shall have the right and obligation to recommend protective actions.

It is the Utility's duty and obligation to notify the State [within fifteen (15) minutes), upon declaration of an event which is classified as Unusual Event, Alert, Site Area Emergency or General Emergency. In the e:vent of a rapidly escalating General Emergency, the Utility will promptly notify New Castle and Kent County Emergency Communications Centers, DEMA and Delaware State Police Headquarters Communications Center.

Initial notification shall be made by dedicated telephone to the Delaware State Police Headquarters Communications Center. Delaware State Police will notify DEMA.

The Utility shall assist and/or provide monitoring teams to detect and measure airborne radiation concentrations in the plume EPZ for the State of Delaware should the monitoring capability of the State of Delaware. be unable to respond in required time frames.

The Utility and the State shall cooperate at all times in the exchange of data relating to the analysis of water, milk, finfish/shellfish, vegetation and soil samples obtained from the ingestion pathway.

Message forms for initial and follow-up contact shall be agreed to by the State and Utility. These message forms shall be used for all required notifications.

The Utility shall provide a person to coordinate Utility information with the State for Alert, Site Area Emergency and Gen~ral Emergency events. This Rev.7

A radiological public safety accident shall be deemed to have terminated when, in the judgement of the State, there is no longer ~n immediate need for either consideration of further protective actions or surveillance related to protective actions.

To maintain public confidence and to avoid public apprehension, information shall be released to the public as soon as possible in a coordinated manner.

The State and the Utility shall exert best efforts to affect such coordination.

To ensure coordination, the Utility shall provide for a location at or near Salem/Hope Creek Nuclear Generating Stations where the State and Utility media representatives may, if appropriate, jointly issue their information releases. This condition in no way abridges the right of the Utility or State to release information to the public. The Utility and State agree to exert their best efforts to advise each other by telephone of any independent information release to the mass media prior to issuing such a release concerning a radiological public safety accident.

In keeping with this delineation of authority and responsibility, each party further agrees to restrict public statements to those areas for which each party is responsible. The Utility and State agree to hold cooperative annual meetings among personnel responsible for public contact.

The Utility shall provide a controlled copy of Salem and Hope Creek Nuclear Generating Stations Dose Projection Programs for ongoing comparison of Delaware's Dose Projection Model.

The Utility shall exert best efforts to incorporate into Facility Emergency Plan Implementing Procedures the requirements of this Memorandum of Understanding relating to Emergency Plan Exercises and review as referred to in Paragraphs B, C, and E; provision for establishing an emergency telephone and posting of initial communications message, as referred to in Paragraphs D and N.

Delaware is responsible for packaging and assuring the proper packaging of radiological ~aste material from decontamination operations, as a result of a radiological accident at Salem/Hope Creek Nuclear Generating Stations, in.. accordance with the Federal procedures required for Low Specific Activity (LSA) waste as defined in Title 49, Code of Federal Regulations.

The Utility will arrange for transportation and disposal of LSA material.

V.

It is expressly understood that the State, by entering into this Memorandum of Understanding, assumes no responsibility or liability relating to the operation of the Salem or Hope Creek NucJear Generating Stations and that the Utility shall indemnify, defend and hold harmless the State from any claim, liabilities, loss or damage resulting from any action, causes of actions claims which shall be caused by or in any way result from or arise out of any act, omission or negligence of the Utility or its agents or employees.

W.

The terms of this Memorandum of Understanding shall apply to the Salem and Hope Creek Nuclear Generating Stations hereinabove defined.

x.

This Agreement shall be effective immediately upon signature of parties hereto.

Y.

This Memorandum of Understanding supersedes and voids all previous Memorandums of Understanding between the Utility and the State for the purpose of providing for the implementation of protective actions on behalf of the general public in the event of a radiological public safety accident.

The State of New Jersey Office of Emergency Management has established its basic plan for emergency operations in the State of New Jersey Emergency and Disaster Operations Plan.

Attachment D, the Radiological Emergency Response Plan, details emergency response to accidents at nuclear power facilities in New Jersey.

3.

The New Jersey Office of Emergency Management will provide prompt notification when a Site or General* Emergency is declared at Hope Creek or Salem Generating Stations.

4.

Continuous coordination, including timely updates on the status of an accident, between both States shall be accomplished in accordance with the respective emergency plans.

5.

The New Jersey Office of Emergency Management shall review annually Annex Q and provide written suggested revisions to the Maryland Emergency Management Agency.

The State of New Jersey has established its plan for response to nuclear power plant incidents in the "State of New Jersey Radiological Emergency Response Plan for Nuclear Power Plants."

The Pennsylvania Emergency Management Agency shall initiate and conduct appropriate and timely response to incident occurring at the Peach Bottom Atomic Power Station or Limerick Generating Station as detailed in Annex E, "Radiological Emergency Response to Nuclear Power Plant Incidents," to include notification of and coordination with the New Jersey Di.vision of State Police, Emergency Management Section.

5.

Since portions of.New Jersey are within the 50-mile ingestion exposure pathway emergency planning zones of the Peach Bottom Atomic Power Station and the Limerick Generating Station, the Pennsylvania Emergency Management Agency shall notify the New Jersey Division of State Police, F.mergency Management Section, upon occurrence of an Alert, Site Area Emergency or General Emergency at the aforementioned plants.

The Salem County Emergency Management Deputy Coordinator will act as the alternate to the Salem County Emergency l\\'lanagement Coordinator and will have the authority and responsibility to initiate prompt notification of the public should the Salem County Emergency Management Coordinator not be available.

Two telephone numbers are provided to contact the County Fire & Disaster Dispatchers with 769-2959, an unlisted number, as the primary number and 935-4505 as the back-up number. A dedicated telephone line is also provided between the Control Centers and PSE&G.

Salem County will participate in the implementation of the Emergency Plan for Salem and Hope Creek Generating Stations and will agree to:

This action does not relieve Public Service of its responsibility to notify the Delaware State Police and/or the Delaware Division of Emergency Planning and Operations in the event of a declaration of emergency at Salem and Hope creek Generating stations.

Section 5.

Public Service agrees to reimburse the County for all reasonable costs which are proximately caused by an emergency at the Salem or Hope creek Generating Station.

Such liability shall be in accordance with the Price-Anderson Act, as amended 42 u.s.c. 2210 fil; seq **

In this regard, Public Service hereby agrees to waive any immunity from public liability conferred by Federal or State law.

Section 6.

The County and Public service agree to cooperate with each other and all State and Federal agencies to provide for the safety and well-being of the citizens of New Castle County with regard to any emergencies arising at the Salem or Hope creek Generating Stations

MEMORANDUM OF UNDERSTANDING BETWEEN PUBLIC SERVICE ELECTRIC AND GAS COMPANY AND SOUTH JERSEY HEALTH CORPORATION PLAN ATT. 2-1. 12 Pg. 2 of 4 WHEREAS, Public Service Electri9 and Gas* company (herein referred to as PSE&G) is authorized to operate nuclear facili-ties on Artificial Island, Lower Alloways creek Township, New Jersey, (herein referred to as Artificial Island) under licenses granted by the U.S. Nuclear Regulatory Commission (NRC); and WHEREAS, PSE&G is required to maintain radiological emer-gency preparedness in accordance with their operating licenses and federal regulations of the NRC and the Federal Emergency Management Agency (herein referred to as FEMA) applicable to emergency preparedness; and WHEREAS, the NRC requires that the state of onsite and offsite emergency preparedness provide reasonable assurance that adequate protective measures can and will be ta~en in the event of a radiological emergency; and WHEREAS, South Jersey Health Corporation (herein referred to as SJHcj has agreed to provide emergency medical services at Memorial Hospital of Salem County (herein referred to as MHSC) in supper~ of PSE&G nuclear operations at Artificial Island; and NBU-EP Rev. 7

THEREFORE, the parties hereto ip consideration of the cove-nants set forth herein agree as follows:

PSE&G agrees, in accordance with the provisions of this Memorandum of Understanding, to reimburse activities associated with the development and maintenance of a Radio-logical Medical Emergency Plan for the MHSC in support of Artificial Island;

2.

In consideration of this funding, SJHC shall be responsible for maintaining in full effect at all times the provisions of a Radiological Medical Emergency Plan and implementing docu-ments for PSE&G operated nuclear generating facilities at Artificial Island:

Immediately contact an initial Westinghouse Contact (as identified in the ERP Roster in the order specified). The customer is periodically provided with an updated ERP Roster to identify key personnel and telephone numbers.

This notification will initiate the actions described in Section 2 of the Plan, and shown in Figure A-1.

Upon full activation, communication links and advisories will be established as shown on Figure A-2. The primary link will be between the site and the initial Westinghouse contact as described in Section 2.2.1 until the plan is fully activated.

After the plan is fully activated, the prime link is between the ERP Director and the Utility Recovery Manager. Support links will also be established with the Onsite Technical Support Center and the Site Emergency News Communications Center.

Advisory communications will be made, as appropriate with the U.S. NRC, (RRG),

Institute for Nuclear Power Operations Regulatory Response, NSA, other Westinghouse plants, Architect/Engineers, etc.

<"Contractor") will, upon request by Public Service Electric and Gas Company C"PSE&G"), provide appropriate emergency technical assistance in the unlikely event of an emergency at the Salem or Hope Creek Generating Stations ("Plant").

Emergency technical assistance. as used herein, ls defined as (i) any equipment or services provided to PSE&G the first three <3> days following, and as a result of, an Incident or accident at the Plant which requires activation of the Plant Emergency Plan or the Emergency Response Plan, dated 6/1/80, of Westinghouse Power Systems Busjness Unit, and Cli) any other equipment or services agreed by both parties to be classified as emergency technical assistance.

Because the emergency technical assistance may be developmental, untested, or first of a kind, THE EQUIPMENT PROVIDED OR SERVICE PERFORMED PURSUANT HERETO SHALL BE ON AN AS IS BASIS AND CONTRACTOR DISCLAIMS ALL WARRANTIES, WHETHER STATUTORY, EXPRESS OR IMPLIED <INCLUDING ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE> WITH RESPECT TO SUCH EQUIPMENT OR SERVICES.

Additionally, Contractor will not be held liable for any damage to, loss of or loss of use of, and PSE&G waives and shall require !ts insurer's to waive all rights of recovery for any damage to, loss of, or loss of use of any property and equipment at the Plant which may occur as a result of PSE&G's use of the emergency technical assistance, whether claims of PSE&G are based in contract, in tort <Including negligence and strict llablllty> or otherwise.

This emergency technical assistance will be provided exclusively under the terms and conditions of this. REGARDING USE OF CERTAIN AREAS OF CEDC AS A BACK UP EMERGENCY NEWS CENTER (ENC) IN THE EVENT THE NUCLEAR DEPARTMENT MUST EVACUATE ITS ENC IN SALEM PURPOSE The purpose of this memorandum of understanding (MOU) is to assure that certain areas of the Camden Electric Distribution Center, hereafter referred to as the CEDC, will serve as the Nuclear Department's Emergency News Center, hereafter referred to as the ENC, in the event the department's emergency response team must evacuate its primary ENC in Salem during an emergency on Artificial Island.

It is understood that access to the CEDC is assured seven days a week, 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> a day in the event of an emergency. Moreover, the Nuclear Department and CEDC reiterate mutual respect for the integrity of each others operations. In particular, the Nuclear Department recognizes and respects the need for the CEDC to continue to conduct normal operations even if it becomes necessary to activate the back up ENC.

AGREEMENT Facility and Equipment In the event of an evacuation to CEDC, the Assembly Room on the first floor will be divided into two sections, with one serving as the operations room for PSE&G emergency response personnel and State emergency management, environmental and health agencies, and the other used as a work and briefing area for news media. The Nuclear Department is permitted the use of CEDC tables and chairs in a quantity sufficient to accommodate approximately 1 SO to 200 persons.

Telephone lines will need to be installed in the Assembly Room. This will be arranged through PSE&G Information Technologies, and a proposed installation plan submitted to you for your approval in advance. The cost of installation, monthly telephone fee and usage cost during a drill or emergency will be borne by the Nuclear Department.

Evacuating ENC personnel will bring telephones, FAX machines and portable computers to the CEDC. It is our understanding that PSE&G emergency response personnel will AIEP Rev. 6

Memorandum of Understanding Nuclear Department and CEDC PLAN ATT. 2-1.18 Pg. 3 of 4 also be permitted to use CEDC's copy and FAX machines as needed, and Assembly Room audiovisual equipment. (Any additional wiring needed to support the operation of the back up ENC is the responsibility of the Nuclear Department.)

Parking for ENC personnel is limited to the employee parking lot located on the south side of the CEDC. The parking area in front of the CEDC may only be used for unloading equipment. Members of the news media will be permitted to park in the grass area on the east side of the CEDC along Rodman A venue. If the back up ENC is activated, the CEDC will make arrangements for portable toilets to be placed in this area for the press CEDC management agrees to notify Nuclear Communications of any major future changes made to the facility that impact on telephone lines, building access, parking, office equipment or any other vital aspect of ENC operations, so that necessary adjustments may be made.

Procedures In the event PSE&G activates its Nuclear ENC in Salem, either the ENC manager or operations supervisor will notify the Southern Division distribution service dispatcher of same and of the possibility that an evacuation to the back up ENC may become necessary.

If an evacuation becomes necessary, the dispatcher will be notified at the earliest possible time. The ENC manager or operations supervisor will also contact local and State Police so that additional security can be provided to the CEDC.

Upon notification that the back up ENC is to be activated, the Southern Division's distribution service dispatcher will make advance arrangements, including notification of CEDC personnel, breakdown/set up of Assembly Room, placement of directional signs, etc.

Drills The U.S. Nuclear Regulatory Commission requires commercial nuclear facilities to demonstrate the ability to effectively evacuate an ENC and resume operations in a back up ENC. This agreement acknowledges the need to conduct periodic drills in which the ENC is evacuated, and the back up ENC in the CEDC is activated. Permission is therefore granted to the Nuclear Department for this purpose.

A 12-month drill schedule will be provided to the CEDC maintenance manager by the Nuclear Communications Department each year in Jariuary. This schedule will indicate if a drill calling for an evacuation to the back up ENC is planned during that calendar year, and if so, when. (It is further agreed that a minimum of one month's notification of a drill will be provided to the CEDC maintenance manager.)

Security A security plan for the back up ENC will be developed subsequent to the signing of this agreement. The plan will include security personnel necessary to safeguard the CEDC facility while in use as back up ENC, emergency response personnel and members of the news media.
