The purpose of this meeting was to discuss and take appropriate action on the items listed in the attached agenda.

The entire meeting was open to public attendance, with the exception of a portion that dealt with the selection of new Committee members.

There were no written statements nor requests for time to make oral statements from members of the public regarding the meeting.

This is Bill Kerr's last meeting as a Committee-member.

INPO has invited members of the Committee to a briefing at their headquarters in Atlanta on August 24, 1992.

Dr. Vernon Hodge was introduced as an ACRS staff engineer to be on rotational assignment from the Generic Communi-cations Branch of NRR for the months of August and September 1992.

II.

Inspections, Tests, Analyses, and Acceptance Criteria (ITAAC)

(Open)

Mr. Ward noted that a joint meeting of the Subcommittees on Decay

Heat Removal Systems/Advanced Boiling Water Reactors was held on August 5, 1992, to do a sample review of 5 of the 85 ITAACs.

This meeting provided an opportunity for the members to ask questions on the sample ITAACs.

NRC-NRR Presentations Dr. T. Murley noted the following points:

A draft ABWR FSAR will be issued in - one month. It will be incomplete; there are over 340 open items.

He urged the Committee to begin its review of this document in order to focus its concerns.

The scope and format of the ITAAC are acceptable to NRR.

A *review group, headed by Mr. J. Craig, will be set up to conduct a thorough Quality Assurance review of the ITAAC.

In response to questions from Messrs. Michelson and Ward, Dr. Murley said that he will insist that the ITAACs are complete before FDA issuance, even if this results in a slip in the schedule.

A Combined Operating License (COL) applicant will need to generate a "bridge document" in order to properly relate the Tier 1 and Tier 2 material to each other.

Such a document will be used to aid NRC inspection efforts.

Mr. T. Boyce, NRR, discussed the scope and status of the staff's review of the ABWR ITAAC.

He noted that the ITAAC development process is an iterative one between the staff and the industry.

Use of ITAAC implements several aspects of 10 CFR Part 52.

GE submitted the ITAAC in three stages, with the full submittal labelled Stage 3.

The staff has the Stage 2 submittal under review.

Comments on stage 2 will be included in the draJt FSER.

Review of Stage 3 will be discussed in separate correspondence.

There will be various types of ITAACs, e.g., systems (the type reviewed by the Combined Subcommittee), generic, COL, interface and DACs.

Mr. Ward said that the Cammi ttee needs to decide if it wishes to review some of the other types of ITAACs.

Messrs. Kerr and Ward questioned the staff regarding how it will be ensured that the reliability of systems and components assumed in the PRA will be verified in the Tier 1 documents.

The staff said*

that appropriate reliability will be ensured by the COL applicant with use of a reliability assurance program.

This issue was not addressed to the Committee's satisfaction.

GE Nuclear Energy Presentation Mr. T. James, GE, discussed the status of the ITAAC development effort.

He noted that the major effort facing GE and NRC is to educate the key players in the "ins and outs" of the Tier 1/Tier 2 process.

Mr. James discussed the details of the basis of GE's approach to preparation of the Tier 1 material.

He said that the design certification process is two-tiered and the top-level information is reserved for Tier 1.

The elements included in Tier 1 are:

design description,

DACs, and ITAACs.

Tier 1

material is structured on a system-by-system approach.

In response to Dr.

Shewmon, GE indicated that the various industry Codes (ASME, ANS, IEEE, etc.) will be referenced in a general sense to preclude their incorporation into Tier 1.

While agreement between NRC and GE has been reached on the basic scope and content of ITAACs many details are still open. Intensive NRC/GE interactions remain to close out this review.

The industry under NUMARC auspices is reviewing the ITAAC in parallel with the NRC review.

NUMARC has cited some items that require attention.

These include:

a need for more precise acceptance criteria, a reduction in the amount of Tier 1 material associated with non-safety systems, and a

strong desire to eliminate Generic ITAAC.

Mr. James noted that the above items have not yet been discussed with the staff.

Conclusions The Committee provided a report on this matter.

III. Supplement to Generic Letter 83-28, Required Actions Based on Generic Implications of Salem ATWS Events (Open)

Note: Mr. P. Boehnert was the Designated Federal Official for this portion of the meeting.

Mr. c. Wylie, Chairman of the Control and Electrical Power Systems Subcommittee, introduced this topic to the Committee.

He noted that Generic Letter (GL) 83-28 was issued following the failure of reactor trip breakers (RTBs) to open on demand at the Salem plant.

The GL requested that licensees implement a set of long-term corrective actions, including:

(1)

Institution of hardware modifications to ensure automatic actuation of the shunt trip mechanism in conjunction with the undervoltage trip relay for any automatic reactor trip signal.

(2)

Establishment of a comprehensive program of preventative maintenance and surveillance to ensure reliable RTB operation.

In addition, licensees were requested to perform two additional actions (Items 4.2.3 and 4.2.4 of the GL), i.e., conduct life-testing of the RTBs, and periodically replace the breakers and components in accordance with their demonstrated life.

The industry has opposed the implementation of Items 4.2.3 and 4.2.4, arguing that these proposals are unnecessary given the maintenance and surveillance programs put in place pursuant to Actions (1) and (2) of the GL.

The staff in effect agrees with the industry and proposes to issue a Supplement 1 to GL 83-28 that would delete the 4.2.3 and 4.2.4 Action Items.

Mr. Wylie said that Mr. c. Morris (Electrical Systems Branch, NRR) has filed a Differing Professional Opinion (DPO) objecting to the staff's proposed action concerning this GL Supplement.

The Control and Electrical Power Systems Subcommittee met on August 4, 1992 to review botn the proposed GL Supplement and discuss with Mr. Morris his concerns in this regard.

NRC-NRR Presentation Mr.

c.

Berlinger discussed the details of the proposed GL Supplement.

He noted the information cited above and said that the staff's review of the operational experience data from 1986 through early-1991 (NPRDS and LERs) gives indication that the actions taken pursuant to GL 83-28 have been effective in improving the reliability of the RTBs (reliability has gone from 3 to 4 failures per demand).

Also, the modifications resulting from implementation of the ATWS Rule (10 CFR 50.62) has further-reduced the risk resulting from RTB failure. Therefore, the staff proposes to issue Supplement 1 to GL 83-28 deleting the requirements for both life cycle testing of the RTBs and periodic replacement based on the results of the life testing.

In response to questions from Mr. Carroll, Mr. Rossi indicated that the Salem ATWS event probably wouldn't have occurred if licensees had both made the modifications to the shunt trip mechanisms and tested and maintained the RTBs pursuant to the requirements subsequently issued in GL 83-28.

The staff believes that these actions effectively fixed the problem.

Mr. Berlinger noted that the proposed Supplement was issued for public comment and that the public comment period has just closed.

Two comments were received to date:

one from Union Electric (Callaway) in favor of the staff's action, one from OCRE (Ohio Citizens for Responsible Energy) expressing opposition.

Comments from Mr. Morris on his Differing Professional Opinion Mr. Morris provided the Committee with comments on his Differing Professional Opinion.

He noted the following points during his discussion:

He believes that there is a need for hard data in lieu of engineering judgment concerning the reliability of the RTBs.

He is skeptical of the judgment of others in this regard.

The Commission had given him a "mandate" to peruse this matter with the licensees.

He provided recommendations for establishment of a life testing program for RTBs in his extensive written comments to NRC management on this issue.

The NPRDS data shows only one failure of an RTB to open on demand.

He believes this data is suspect.

During Committee discussion with Mr. Morris, the following points were noted:

In response to Dr. Shewmon, Mr. Morris said that the current test program calls for tests of the RTBs on a monthly basis. If a breaker fails a test it is repaired or replaced.

Dr. Lewis indicated that the staff has not established a definitive criterion for acceptable breaker reliability; he also said that the staff should evaluate cases of failure of RTBs to close on demand as this provides additional information on their reliability.

In response to Mr. Lindblad, Mr. Morris said that he had made a proposal to the Research Off ice that they consider this matter as a research project.

RES did not act on this proposal.

Mr. Morris did not formally petition RES in this regard.

Mr. Morris described attributes that he thought should constitute an acceptable life cycle test program.

In response to Mr. Michelson, Mr. Morris estimated that such a program would cost on the order of $2.0M.

Mr. Rossi indicated that following this meeting, the staff intends to notify the Commission of its intent to issue the GL Supplement in the near future.

Conclusion The Committee provided a report on this matter.

IV.

Emergency Planning and Preparedness (Open)

Note:

Mr. H. Alderman was the. Designated Federal Official for this portion of the meeting.

Introduction and Background Mr. M.

  • Jamgocian, RES, was the introductory speaker for this topic.

He said that the purpose of this task was to publish Revision 3 of Regulatory Guide (RG) 1.101 endorsing an alternative Emergency Action Level * (EAL) scheme to Appendix 1 of NUREG 0654.

The background of this revision to RG 1.101 is as follows:

RG 1.101 was published in 1980. This RG endorsed NUREG-0654.

NUREG-0654 prescribes initiating conditions for each emergency action level.

The development of Revision 3 to RG 1.101 is an industry initiative following about 11 years of experience.

Revision 3 was developed By NUMARC with significant input from the NRC. FEMA was also involved in this revision.

Important Aspects of NUMARC EAL Guidelines Mr. Hasselberg, NRR, discussed some of the important aspects *of the NUMARC guidelines. He said that NUREG-0654, Appendix 1, prescribed the initiating conditions for EAL*s. He noted that the utilities have a wide variety of EAL schemes. The NUMARC EAL Guidelines have been tested against the existing BWR/PWR EAL schemes and compared with NUREG-0654 Appendix 1. He felt that the NUMARC NESP-007 examples provide an acceptable alternative methodology to those listed in NUREG-0654 Appendix 1. Each example EAL has one or more recommended threshold values for BWR and/or PWR facilities.

The EAL thresholds utilize many of the same observable and quantifiable parameters now used in plant EOPs.

NUMARC EAL Scheme Mr.

Jamgocian said the NUMARC EAL scheme was an event-based classification system incorporating a fission product barrier challenge scheme or breach scheme. There are four major prefix designators:

  • Prefix A-Abnormal Radiological Conditions.
  • Prefix B-Hazardous Conditions~
  • Prefix s-System Malfunctions.
  • Pref ix F-Fission Product Barrier Challenges or Breaches The staff wishes to expedite publication of the final Regulatory Guide by September 1, 1992.

Conclusion The Committee provided a report on this matter.

V.

EPRI Reguirements for Evolutionary Light Water Reactors (Open)

Note:

Mr. Wylie, Chairman of the Subcommittee on Improved Light Water Reactors, noted that during a meeting of the Subcommittee on July 27, 1992, the NRC staff was the principal presenter, and EPRI representatives were present to answer questions and respond to previous ACRS concerns.

NRC Staff Presentations Mr.

Crutchfield,

NRR, stated that there are about 400 vendor/specific open items in. the FSER.

These items lack suf-ficient detail in the EPRI document but will be resolved during the review of specific ABWR or CE applications.

He said that the review of the EPRI documents have been worthwhile to identify many major policy issues. The EPRI document is not a certified document and it does not replace the staff's review of specific applications.

The document has no regulatory status. Significant staff resources, e.g., more than 30 FTEs during the 1986-1989 period were spent in reviewing the EPRI document.

Mr. Crutchfield stated that as the plant-specific issues are resolved during plant-specific application review, they will be forwarded to EPRI for possible incorporation into the EPRI Utility Requirements Document (URD).

Therefore, it is likely that an FSER supplement will be necessary.

Mr. J. Wilson, NRR, described the EPRI ALWR URD.

Severe accident protection requirements are being incorporated in the URD in accordance with the Commission's guidance.

He stated that the staff does not control the format and qontents of the URD.

The staff cannot use the document as it now exists as a basis for licensing future applications for design certification.

Mr. Wilson discussed open issues.

Vendor or utility specific open items must be satisfactorily addressed during the staff's review of specific applications.

Included are:

Items that were determined by EPRI to be outside the scope of the URD.

Items that were inadequately addressed by EPRI.

Items that could not be addressed generically.

The FSER identified 21 open policy issues, no confirmatory issues, and 410 vendor/utility-specific issues.

In response to questions from Dr. Shewmon concerning the open issue on leak-before-break (LBB), Mr. Brammer, NRR, stated that the issue is still open because plant-specific information, e.g., loads, stresses, and materials property information, was not provided.

Mr. Crutchfield stated that the LBB criteria have not been applied to BWR plants, and that a Commission decision on this matter is needed.

Dr. Shewmon responded that the LBB criteria was applied to

BWRs, but not to materials susceptible to stress corrosion cracking. Mr. Crutchfield agreed.

Mr. Wilson concluded that the EPRI ALWR URD for evolutionary plant designs specifies requirements that should result in a nuclear power plant that will have all the attributes required to ensure that there is no undue risk to the health and safety of the public or to the environment.

The staff intends to issue the final *sER in August 1992, and will issue a supplement at a later date.

EPRI Presentations Mr. Bockhold, EPRI, discussed the EPRI URD goals, conclusions, and requests.

The primary goal of the URD was to identify what the utilities wanted in the next generation of ALWRs, e.g., enhanced safety, extra design margin to improve operational flexibility, and design to facilitate maintenance and repair.

Strawson, EPRI, provided responses to the following ACRS concerns:

Cathodic protection -

The URD will be reworded to require early site surveys to determine cathodic protection needs.

MSIV operability -

The URD requires that MSIVs be of a type that has demonstrated the capability to close under pipe break conditions.

Redundancy for switchgear and battery rooms HVAC -

The URD will be revised so that:

1) a separate cooling and ventilation system will serve each electrical division, 2) the ventilation systems will be powered from the same electrical di vision they are serving, and 3) the ventilation systems will not be cross-connected between rooms of other divisions.

Compartment flooding - The URD has been revised in response to ACRS concerns relating to flooding due to pipe breaks in the auxiliary water systems piping.

Combustion turbine generator -

This matter has not yet been completely evaluated by the staff.

Reserve transformer - This matter is still being considered by EPRI.

  • conclusion The Committee issued a report on this matter.

VI.

Regulatory Requirements Marginal to Safety (Open)

Note:

Mr. M. D. Houston was the Designated Federal Official for this portion of the meeting.

Dr. Lewis, Chairman of the Regulatory Policies and Practices Subcommittee, noted that government regulations, including those of the NRC, are large and growing.

He stated that the NRC has had a program in place to identify those NRC regulations which could be relaxed without a negative impact on the health and safety of the public, and that the staff would brief the Committee on the results of this program.

NRC Staff Presentation Mr. W. Minners, RES, discussed the historical background and the planned staff actions in regard to the program to eliminate requirements marginal to safety and reduce the regulatory burden.

He presented, in general terms, the following staff's plan of action over the next three years:

1.

Initiate rulemaking in the following areas to reduce regulatory burden, without an adverse impact on safety, by

388th ACRS Minutes 10 making regulations less prescriptive and more performance oriented:

a.

Containment structure leakage testing procedures (10 CFR 50, Appendix J) *

b.

Fire protection features (10 CFR 50, Appendix R).

c.

Features for post-accident combustible gas control (10 CFR 50.44).

2.

Modify licenses in the following areas in which the NRC has proposed to relax or eliminate:

a.

Main steam Isolation Valve leak control systems.

b.

Allowable containment containment testing.

leakage rates utilized in

3.

Analyze the potential for burden reduction, without adverse impact on

safety, in the following areas (this was consistently suggested in the public comments):
a.

Quality assurance criteria (10 CFR Part 50, Appendix B).

b.

Environmental qualification of electrical equipment important to safety (10 CFR 50.49).

c.

Plant security requirements (10 CFR 73.55).

d.

Post-accident sampling systems (NUREG-0737 and Regulatory Guide 1.97).

Mr. Minners said that public workshops would be held in early 1993 for the three rulemakings in item 1 above.

In addition ~o those efforts described above, he noted the following areas as-being addressed:

a.

Modify 10 CFR 20 dose limits with regard to hot particles.

b.

Permitlicensee-administeredrequalificationexaminations under NRC oversight.

NUMARC Presentation Mr. W. Rasin, NUMARC, presented some brief remarks in support of the staff's program.

He indicated that some NRC activities may have inadvertently, and needlessly, contributed to undue burdens on licensees.

Therefore, the industry considers this program an

£ 388th ACRS Minutes 11 opportunity to achieve greater efficiency and productivity in the use of their resources.

He stated that regulations have served the industry well in protecting public health and safety but that, with a maturing technology, the regulations should be reconsidered.

Committee Action The Committee provided a report on this matter.

VII.

Session with the NRC Chairman (Open)

Chairman Selin thanked Dr. Kerr for his many years of service as an ACRS member and presented him with a letter from the Commission.

Chairman Selin mentioned his previous suggestion that in order for the Committee to be most helpful to the Commission, only a few topics should be kept on the table for periodic discussions with the Commission.

Conclusions This was a very brief meeting with Chairman Selin in order to provide a farewell to Dr. Kerr.

No other matters were discussed.

VIII.

ACRS Subcommittee Activities (Open)

Planning and Procedures Subcommittee Meeting on July 8, 1992 The minutes of the July 8,

1992 Planning and Procedures Subcommittee meeting were discussed.

There was general crgr~ement with the minutes of that meeting with the following comments:

The NRC research program has been reorganized and ACRS subcommittee assignments will have to be made to conform to the new research structure.

The members agreed that the Committee Chairman has the authority to make such changes in subcommittee assignments.

No comments were made on the assignments that have already been made.

Problems with operation of the amplification system in the ACRS conference room were discussed.

The BBS system is being updated by use of Wildcat, Revision 3.

Detailed instructions will be provided the members for the proper use of the system.

388th ACRS Minutes 12 Plans to get Dr. Wilkins on the BBS were discussed briefly.

The Committee agreed that the ACRS staff should do no "Monday morning editing" of ACRS reports, except for the following:

Correct factual errors only (e.g., dates, names, times, etc.).

Add the list of appropriate references that are referred to in the body of the letter/report.

Use of standardized format.

(Note: Additional discussion of this matter is planned during the September meeting.)

Appointment of ACRS members is discussed in Section 9 below.

Planning and Procedures Subcommittee Meeting on August 5, 1992 The minutes of the August 5, 1992 meeting of the Planning and Procedures Subcommittee were discussed.

There was general agreement with the minutes of the meeting with the following comments:

The newly instituted Cammi ttee procedure of discussing reports that are "urgent and must be completed during the meeting" on Thursday afternoon should be made a normal practice.

The procedure was used at this meeting and found to work well.

At the September 1992 meeting, the Committee should vote on changing the Preamble of the ACRS Bylaws to include either

("two-thirds") or ("unanimous") with regard to the following:

"Any provision of these Bylaws may be suspended for the purpose of a

particular action, by

("two-thirds")

("unanimous") vote of those members present and voting, who shall constitute a minimum of two-thirds of the membership of the Committee.

A motion to suspend the Bylaws shall take precedence over any other motion pending before the Committee."

Appointment of ACRS members is discussed in Section 9 below.

Computers in Nuclear Power Plant Operations Meeting on June 16, 1992 Dr. Lewis provided a report on the June 16, 1992 meeting of the Subcommittee on Computers in Nuclear Power Plant Operations, noting the following:

The staff's emphasis on electromagnetic interference under the general topic of environmental qualification may be

He suggested that the staff may have greatly overexaggerated the risk from interference, since it can usually be handled by actions such as grounding cabinets, etc.

He noted that the Subcommittee was not impressed with the "scope and buzzer display" demonstration on interference that was provided at the meeting.

He said that the proposed plan to "outlaw walkie-talkies" in portions of the plant during operations should likely not be followed.

He noted that work by the staff's consultant, Oak Ridge National Laboratory, with regard to this matter appeared to be well done.

He suggested that the Committee should consider writing a letter on this matter discussing the focus of the NRC' s

  • program.

Dr. Catton had the following comments with regard to the Commission briefing on the vendor test program for the AP600 design in September:

He discussed the response that the Committee had just received from the staff concerning the Committee's comments on the need for the use of the ROSA-IV test facility.

He does not feel that the staff has adequately looked at its needs for the.AP600 test program.

He had heard that the Commission would like to know the Committee's bases for its recommendations in its July 17, 1992 report, Integrated System and Separate Effects Testing in Support of the Westinghouse AP600 Plant Design Certification.

He felt that the ACRS cannot review the staff's research work regarding the AP600 design unless things change, since the Committee does not get the information needed to do a good review in a timely manner.

The staff should either keep the Committee informed on this matter or the Committee cannot review it.

He said that he intended to tell the Commission how difficult it has been to help the staff with regard to the Westinghouse AP600 test program review.

Future Item Concerning NRC Use of the International Nuclear Event Scale (Open)

The Committee agreed to drop this matter for future meeting consideration.

The members were asked to look at SECY-92-225 for further information.

Preparation of Other ACRS Reports and Memoranda (Open)

In addition to those matters discussed with representatives of the staff and industry during this meeting, the members discussed and completed the following reports and memoranda:

ACRS Plan for Reviewing the Application for Certification of the GE Advanced Boiling Water Reactor Design The Committee completed a report to the Executive Director for Operations as noted above.

388th ACRS Minutes 15 SECY-92-237, "Status Report on the Staff's Efforts to Prioritize and Schedule Generic Communications in Light of Ongoing Regulatory Activities" The Committee directed Raymond F. Fraley to send a memorandum to the Executive Director for Operations as noted above.

Proposed Policy Statement on Conversion to the Metric System The Committee completed a report to Chairman Selin as noted above.

The Following comments were made during the meeting:

EDO letter, dated June 10, 1992, responding to dated May 14, 1992, concerning Advanced Notice Rulemaking addressing severe accident plant criteria for future LWRs.

ACRS report of Proposed performance The Committee members expressed no problem with regard to the response given.

EDO letter, dated June 11, 1992, responding to ACRS report dated May 19, 1992, concerning Diesel Generator Reliability.

Members thought the response was inconclusive and suggested that the Committee take a "wait and see approach" with regard to what it might do.

The staff will be back to discuss this with the Committee after public comments are received and evaluated.

An ABWR Subcommittee meeting has been scheduled to discuss related matters.

The Committee agreed that the Severe Accidents Subcommittee should schedule a meeting to review the GE and BNL reports that are now available on steam explosions.

Also, the ACRS staff will provide the opportunity for members to view the video at the September ACRS meeting and to request individual copies of the tape.

The NRC staff should be told that they don't routinely have to discuss the chronology of events and read slides aloud when briefing the Committee. The Severe Accident Subcommittee should discuss the need for consideration of steam explosions in ABWR plants. (Mr. Houston has the follow-up on this matter.)

The operation of the amplification system in the ACRS conference room was discussed.

It was suggested that action is needed in order to avoid "cut-outs" when people are talking and to prevent adjustment of the system by unauthorized persons.

The BBS system is being updated by installing Wildcat, Revision 3, and detailed instructions will be provided the members for the proper use of the system.

The ACRS staff will continue its efforts to arrange for Dr. Wilkins computer to be

Following the scheduled discussion with Dr. Murley at its September meeting, the Committee *will decide whether it wishes to invite Mr. Specter, New York Power Authority, to a future meeting to provide comments on risk-based regulation and the risk impact of the NRC staff's diagnostic evaluation of the Fitzpatrick IPE results. (Dr. Savio has the follow-up on this matter.)

The Committee agreed to indefinitely postpone future discussion on insights gained from the Accident Sequence Precursor Work.

Dr. Kress noted that he was told by Dr. Theofanous that Finnish nuclear representatives have indicated that Finland might purchase two nuclear plants in. the future,'but that they are restricting their purchases to European (not U.S.) plants.

A reason given for not considering U.S. plants is that the U.S. plants do not measure up to the safety standards of the European plants. The members expressed an interest in finding out why the Finns might think that European reactors are safer than U. s. reactors. Dr. Kress agreed to follow up and develop

("unanimous") vote of those members present and voting, who shall constitute a minimum of two-thirds of the membership of the Committee.

A motion to suspend the Bylaws shall take precedence over any other motion pending before the Committee."

388th ACRS Minutes 22 The members agreed to a new ACRS meeting procedure, i.e.,

whenever the Committee has a letter that "must" be completed during a specific meeting, the cognizant member will present a draft letter on that matter to the Committee before close of business on the first day of the meeting, usually Thursday.

Then, first thing on Friday morning, a short session will be held to discuss the letter, with a soft vote to determine whether the draft is good enough for paragraph-by-paragraph consideration at the next reading.

Also, the ACRS staff will normally provide a list of those matters that require a letter at that meeting, to be discussed on the first day of the meeting.
