TEMPORARY WAIVER OF COMPLIANCE (TAC NOS. 71097/71098)

RE:

SALEM GENERATING STATION, UNIT NOS. 1 AND 2 By letter dated August 28, 1989, License Amendments Nos. 101 and 78 for Salem Generating Station Unit Nos. 1 and 2, respectively, were forwarded to Public Service Electric and Gas (PSE&G) for implementation within 45 days.

These amendments added Technical Specifications for the Reactor Vessel Head Vent (RVHV) System.

Surveillance Requirement 4.4.12.1 requires all manual isolation valves in the RVHV System to be locked open.

These valves, while*

verified open prior to the last startup from a refueling outage, have not been locked open.

In order to lock the valves open the reactor would have to be placed in Mode 3, Hot Standby.

The valves are physically behind a biological shield and radiation exposure considerations preclude locking the valves with the reactor critical.

By letter dated October 4, 1989, PSE&G requested relief from implementing Amendments 101 and 78 until prior to startup following the next plant shutdown to Mode 3, Hot Standby.

The NRC staff has concluded a preliminary review of your request and agrees that a plant shutdown to verify and lock open the valves is unnecessary.

The fact that the valves have been verified open provides some reasonable assurance that the vent path is available if needed.

Therefore, the implementation of Amendments 101 and 78, forwarded by letter dated August 28, 1989 and Correction Letter dated September 27, 1989, shall be delayed until the NRC staff can issue amendments with implementation to be prior to reactor startup following the next shutdown to Mode 3.

This Temporary ~laiver of Compliance shall be effective immediately and shall remain in effect until the amendments are issued or a plant shutdown to Mode 3 occurs.
