Public Service Electric and Gas Company Salem Generating Station NOTICE OF VIOLATION Docket Nos. 50-272; 50-311 License Nos. DPR-70; DPR-75 EA 88-41 During an inspection conducted on December.21, 1987 by a representative of the State of Washington, Department of Social and Health Services, of a shipment of radioactive waste sent from the Salem facility in Hancocks Bridge, New Jersey, on December 16, 1987, and during an in-office review of information provided by the State, a violation of NRC requirements was identified.

In accordance with the 11General Statement of Policy and Procedure for NRC Enforcement

Actions, 11 10 CFR Part 2, Appendix C (NRC Enforcement Policy) (1987), the violation is set forth below.

10 CFR ll.47(d) requires that radiation levels external to a package of radioactive material not exceed 2 millirems per hour i'n any normally occupied positions of the transport vehicle, unless it is a private transport vehicle and certain other conditions are satisfied.

Contrary to the above, on December 16, 1987, an exclusive-use vehicle (which was not a private transport vehicle) containing a shipment (No.

87-61) of low specific activity radioactive waste left the Salem facility, and upon receipt of the shipment at the U.S. Ecology burial site in Richland, Washington on December 21, 1987, the radiation levels in the slee~er portion of the cab of the exclusive-use vehicle were between 3.0 and 4.5 millirems per hour.

This is a Severity Level IV violation (Supplement V).

Pursuant to the provisions of 10 CFR 2.201, Public Service Electric and Gas Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, DC, 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice.

This reply should be clearly marked as a 11 Reply to a Notice of Violation 11 and should include for each violation:

(1) the reason for the violation if admitted, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the *response time.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cau~e why the license
