NOTICE OF VIOLATION

FEB 2 2 1988

(Combined Inspection Nos. 50-272/88-04 and 50-311/88-04)

This refers to a safety inspection conducted on December 21, 1987 by a repre-

sentative of the Department of Social and Health Services, State of Washington,

upon receipt of a shipment of solid radioactive waste from Salem to the U.S.

Ecology, Incorporated, burial site at Richland, Washington.

The info~mation

concerning this shipment was provided to the NRC by your staff and was reviewed

during a Region I in-office review on January 6-7, 1988.

The Region I

inspection report is* enclosed.

The violation, which is described in the enclosed Notice, involved radiation

levels of between 3.0 and 4.5 millirem per hour in the sleeper portion of

the cab of an exclusive use vehicle used to transport the shipment.

These

radiation levels are in excess of the regulatory limit of 2 millirem per

hour.

Although violations involving excessive radiation levels in the cab

of a transport vehicle are normally classified at Severity Level III, in

accordance with Section C.2 of Supplement V of the

11General Statement of

Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C,

(1987), the violation, in this case, is *classified at Severity Level IV based

on its low safety significance in that the radiation levels were only slightly

in excess of the limit and, more importantly, were confined to only certain areas

of the sleeper portion of the cab.

However, we emphasize that any similar

violation in the future may result in additional enforcement action.

You are required to respond to this letter and. should follow the instructions

specified in the enclosed Notice when preparing your response.

In your

response, you should document the cause of this violation as well as specific

actions taken and any additional actions you plan to prevent recurrence.

In

particular, you should describe what surveys were performed of the cab prior

to shipment and why these surveys were inadequate.

After reviewing your

response to this Notice, including your proposed corrective actions, the NRC

will determine whether further NRC enforcement action is necessary to ensure

compliance with NRC regulating requirements .
