23, 1980 We have received your letter dated April 14, 1980, and your check for $23,000 in response to our letter dated March 20, 1980 transmitting a Notice of Proposed Imposition of Civil Penalties for the repeated instances wherein.

there was unimpeded and uncontrolled access into vital areas of the Salem Nuclear Generating Station, Unit 1.

The Order Modifying License, Effective Immediately, accompanying our letter dated March 20, 1980 contained a modification to License No. DPR-70 that required, among other things, in Part III, A(l)(a), that you adopt and imple-ment written security procedures for the 11continuous visual surveillance of all interface doors leading.to vital areas in Unit 1 11

  • Your letter responding to the Order Modifying License, fails to indicate that any action was taken with regard to the requirement for continuous visual surveillance of all interface doors.

Instead, in your response to Part III, A(3) of the Order, which required that you provide a copy of the procedures implementing the continuous visual surveillance, you provided a copy of 11 Foot Patrol of Vital and Protective Area Interface Between Units No. 1 and No. 2, 11 and noted that a foot patrol of the interface at least once every two hours had been implemented on October 9, 1979.

The action specified in this procedure is not consistent with the provisions of Part III, A(l)(a) of the Order.

In view of this, we consider that you failed to comply with Part III, A(l)(a) of the Order.

A Notice of Violation addressing this matter is enclosed as Appendix A.

No response is required.

The common definition for 11continuous 11 is:

11extending or prolonged without interruption or cessation; unceasing". (Webster)

A reasonable person could not suggest that a patrol at two-hour intervals achieves "continuous" surveil-lance.

We believe it would be approriate for you to review your security plan and implementing procedures to assure that all terms of measure (e.g., time, distance, frequency and illumination) are clearly stated or specified, and that you are in full compliance.

The results of your review should be made available for inspection.

During a future Safeguards inspection, this matter will be reviewed with you in detail.

Due to (i) your apparent misunderstanding of the term "continuous", (ii) the currently moot character of your inadequate and inappropriate corrective actions, and (iii) the time which has elapsed since this series of events was precipitated, no additional penalties are now planned.

  • However, you should note that a review of the items of noncompliance which have been detected, and for which you have been cited during the past 31 months, coupled with your failure to comply with the March 20, 1980 Order, raises serious concerns about your appreciation of your Safeguards responsibili-ties.

I fully expect that you will dedicate the requisite interest and resources to reverse this *trend.

In accordance with Section 2.790(d) of the NRC 1s 11 Rules of Practice, 11 Part 2, Title 10, Code of Federal Regulations, documentation of findings of your control and accounting procedures for safeguarding special nuclear materials and your facility security measures for physical protection are deemed to be commercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12; therefore, the enclosure to your letter of April 14, 1980 will not be placed in the Public Document Room and will receive limited distribution.

No reply to this letter is required; however, should you have any questions concerning this matter, we will be pleased to discuss them with you.
