2 PAGE i OF viii Preface This subcategory report is one of a series of reports prepared for the Employee Concerns Special Program (ECSP) of the Tennessee Valley Authority (TVA).

The ECSP and the organization which carried out the program, the Employee Concerns Task Group (ECTG), were established by TVA's Manager of Nuclear Power to evaluate and report on those Office of Nuclear Power (ONP) employee concerns filed before February 1, 1986.

Concerns filed after that date are handled by the ongoing ONP Employee Concerns Program (ECP).

The ECSP addressed over 5800 employee concerns.

Each of the concerns was a

formal, written description of a circumstance or circumstances that an employee thought was unsafe, unjust, inefficient, or inappropriate.

The mission of the Employee Concerns Special Program was to thoroughly investigate all issues presented in the concerns and to report the results of those investigations in a form accessible to ONP employees, the

NRC, and the general public.

The results of these investigations are communicated by four levels of ECSP reports:

element, subcategory,
category, and final.

Element reports, the lowest reporting level, will be published only for those concerns directly affecting the restart of Sequoyah Nuclear Plant's reactor unit 2.

An element consists of one or more closely related issues.

An issue is a potential problem identified by ECTG during the evaluation process as having been raised in one or more concerns.

For efficient handling what appeared to be similar concerns were grouped into elements early in the program, but issue definitions emerged from the evaluation process itself.

Consequently, some elements did include only one issue, but often the ECTG evaluation found more than one issue per element.

Subcategory reports summarize the evaluation of a number of'lements.

However, the subcategory report does more than collect element level evaluations.

The subcategory level overview of element findings leads to an integration of information that cannot take place at the element level.

This integration of information reveals the extent to which problems overlap more than one element and will therefore require corrective action for underlying causes not fully apparent at the element level.

To make the subcategory reports easier to understand, three items have been placed at the front of each report:

a preface, a glossary of the terminology unique to ECSP reports, and a list of acronyms (terms formed from the first letters of a series of words).

Additionally, at the end of each subcategory report the reader will find at least two attachments.

The first is a Subcategory Summary Table that includes the following information:

the concern

number, a brief statement of the concern, and a designation of nuclear safety-related concerns.

The second attachment is a listing of the concerns included in each issue evaluated in the subcategory.

PAGE ii OF viii The subcategories are themselves summarized in a series of eight category reports.

Each category report reviews the major findings and collective significance of the subcategory reports in one of the following areas:

management and personnel relations industrial safety construction material control operations quality assurance/quality control welding engineering A separate report on employee concerns dealing with specific contentions of intimidation, harassment, and wrongdoing will be released by the TVA Office of the Inspector General.

Just as the subcategory reports integrate the information collected at the element level, the category reports integrate the information assembled in all the subcategory reports within the category, addressing particularly the underlying causes of those problems that run across more than one subcategory.

A final report will integrate and assess the information collected by all of the lower level reports prepared for the

ECSP, including the Inspector General's report.

For more detail on the methods by which ECTG employee concerns were evaluated and reported, consult the Tennessee Valley Authority Employee Concerns Task Group Program Manual.

The Manual spells out the program's objectives,

scope, organization, and responsibilities.

It also specifies the procedures that were followed in the investigation, reporting, and closeout of the issues raised by employee concerns.

OF 14 1.0 CHARACTERIZATION OF ISSUES 1.1 Introduction The Miscellaneous subcategory consists of those concerns related to management and personnel that could not be assigned to any other management and personnel subcategory, Because of the wide variety of the concerns addressed, the format of this report deviates somewhat from the customary structure.

The evaluator has reviewed all the information available on the concerns in this subcategory.

The information pertinent to the evaluation of the issues has been considered and incorporated in this report.

Because each concern has been evaluated as a separate

issue, the characterizations,
causes, and corrective actions for each issue are presented with the findings on that issue in section 4.0.

This approach was taken to minimize the fragmentation that would result if each issue was discussed in each section, 1.2 Descri tion of Issues The Miscellaneous subcategory includes 48 individual concerns.

Thirty-four (34) of these concerns expressed general opinions which were evaluated as separate issues.

Fourteen concerns did not clearly express a concern; just what the employee felt was unsafe,

unjust, or inefficient could not be determined.

Consequently, these concerns could not be evaluated due to insufficient information.

To locate the issue in which a particular concern is evaluated, consult the following attachments:

Attachment A, Subcategory'ummary Table Attachment B, List of Concerns by Issue All Management and Personnel Category concerns having a technical component (including all concerns designated Nuclear Safety-Related) are shared with the appropriate technical category for investigation and resolution of that technical component.

Report(s) sharing a concern with this report are identified in the entry for that concern on Attachment A.

3,0 EVALUATION PROCESS The evaluation for this subcategory was conducted in accordance with the "Evaluation Plan for the Employee Concerns Task Group" and the "Evaluation Plan for the Management and Personnel Group" and the "Miscellaneous Subcategory Evaluation Plan."

A review was conducted of all available files associated with the individual concerns, including Office of Employee Relations and Nuclear Safety Review Staff (NSRS) information.

Previous investigation reports of nine concerns evaluated by line management were reviewed and the information was used in the preparation of this report.

Interviews were held with members of the other six Category Evaluation Groups (CEGs) of the Employee Concerns Task Group (ECTG) regarding the miscellaneous concerns that may be related to their areas of evaluation.

Discussions were also held with other evaluators within the Management and Personnel Group to discuss the concerns that may be related to their subcategory subject matter.

Where possible the appropriate criteria were determined and the concerns were examined against the criteria.

The results of those examinations (or explanations as to why such an examination was impossible) are presented in section 4.0.

4.0 FINDINGS 4.1 Issue 71201 Waste of Time and Pa er The Concerned Individual (CI) contends that it is an unnecessary waste of time and paper to copy every Nuclear Dis atch or any other publication for every employee on site (at present 3000 copies of each).

These copies are discarded throughout the site and must be continuously picked up.

Much paper is used for the Nuclear Dis atch and similar publications.

However, one of the major commitments of the new Office of Nuclear Power (ONP) management is effective communication between management and employees.

The Nuclear Dis atch is one important tool for bringing about this improved communication, While wide distribution of the Nuclear Dis atch may seem wasteful, it is a cost effective means of achieving better communication.

Therefore, this issue is not factually accurate.

OF 14 4.2 Issue 71202 TVA U er Mana ement The CI contends that Tennessee Valley Authority (TVA) upper management appears to be in a state of confusion.

The TVA Board of Directors, recognizing a need to add stability and leadership to TVA's nuclear

program, has contracted with a new ONP manager.

It is the intent of the new ONP manager to provide stability and effectiveness and restore employee confidence.

This issue is a statement of opinion and can not be verified as factually accurate.

(Interested readers are referred to Subcategory Report 70800, "Morale" and the ONP Nuclear Performance Plan.)

4.3 Issue 71203 Tele hone Wireta in The CI contends that telephones are being "bugged" by TVA.

One instance of phone "bugging" at the Watts Bar Site was investigated by the Office of the Inspector General (OIG) and found to be valid, Personnel action was taken against the employees involved in the unauthorized act.

No further evidence of phone "bugging" was identified by this investigation.

If employees have information about any other concerns of this type, they are encouraged to contact the OIG.

4.4 Issue 71204 - Ra id Chan es in NRC Re ulations The CI contends that rapid changesin Nuclear Regulatory Commission (NRC) regulations required repeated modifications to plant systems.

NRC regulations are changing less frequently than in the past, It is the interpretation of regulations by both TVA and the NRC that leads to system modifications.

The NRC also informs utilities of potential problem areas encountered at any facility which might affect safety standards at other plants.

Many changes were initiated as a result of accidents in the industry.

This issue is factually accurate but is not a problem requiring, corrective action by the Office of Nuclear Power.

4.5 Issue 71205 - Harassment b

IRS The CI contends that TVA allows IRS to take money from workers on this project without due process of law.

OF 14 The Internal Revenue Code establishes TVA's Tax withholding obligation.

As a Federal agency with significant tax-funded

programs, TVA must support the laws and agencies responsible for managing and enforcing, the nation's tax laws.

Therefore, this issue is not factually accurate.

4.6 Issue 71206 - Weldin Re uglification Test The CI contends that he/she was forced to take the welding requalification test, though CI did not want to.

A decision was made by ONP management that, in certain areas, all employees involved with welding would be recertified.

This issue is factually accurate but is not a problem requiring corrective action.

(Also see Welding Category reports on recertification efforts).

4.7 Issue 71207 S ent Nuclear Fuel The CI contends that the nuclear industry has not made adequate provisions to handle and process spent nuclear fuel.

The problem of nuclear spent fuel management is certainly not plant or site-specific, It is also a problem that has been recognized for several years and has required considerable expense and replanning by the nuclear industry as various Federal programs and policies have changed directions; but it is perhaps closer to solution, with the passage of legislation in 1982 to develop a geologically safe repository.

Until the Department of Energy (DOE) accepts spent fuel for disposal, utilities are responsible for storing it.

The NRC has determined that utilities can safely store spent fuel onsite for 50 years or more.

TVA's current plan is to make full use of its capacity for storage inplant in spent fuel pools.

This method will be augmented by onsite dry storage in large metal casks, if necessary.

Therefore, this issue is not factually accurate.

4.8 Issue 71208-Nuclear Safet at WBN The concern that raised this issue was only a comment on nuclear safety at WBN "I don't trust this one."

One of the primary objectives of the employee concerns efforts at WBN is to validate the safety of the plant and to bolster employee confidence in that safety, This issue could not be verified as factually accurate,

OF 14 4.9 Issue 71209 - Location of WBN The CI contends that the WBN plant should not have been built beside Watts Bar Dam.

Indepth engineering and geological studies were mandatory before a

decision could be made on the location of WBN.

Those studies concluded that WBN would not endanger the safety of the Watts Bar Dam.

Nor was the location oi the dam found to be a hazard to the safe operation of WBN.

Therefore, this issue is not factually

accurate, 4.10 Issue 71210 - Plot A ainst Section Su ervisor This issue was raised by a CI who overheard two individuals (names known) plotting to plant a bottle of liquor in the section supervisor's

{name known) desk in an effort to have him terminated.

CI discussed the incident with a co-worker (name known) on June 7, 1985, and desired the Employee

Response

Team (ERT) to make a confidential record of the expression of the

incident, should the individuals carry out their plans.

This issue could not be verified as factually accurate;

however, as a precaution, the concern has been permanently recorded in the data base files of the Employee Concern Program System

{ECPS) and the files of the

NRC, who obtained copies of all WBN employee concerns collected by Quality Technology Company (QTC).

This documentation will provide evidence should such a plot be discovered.

4.11 Issue 71211 - Forei n Material Purchases The CI contends that TVA should not order materials from foreign countries but should support U.S. manufacturers.

An example given was the purchase of heat exchangers from Belgium.

Sometimes we receive bids offering foreign materials.

In these cases we are subject to the provisions of the Buy American Act.

This act requires that TVA make its p'urchases from domestic suppliers rather than foreign suppliers, except in those cases where the domestic supplier's bid or offered price is unreasonable or the award to him would be inconsistent with the public

TVA determines whether a domestic supplier's bid is unreasonable as compared with the bid of a foreign supplier by applying the provisions of Executive Order 10582.

In cases where foreign purchases are made under these provisions, significant savings for the users of TVA power result.

Therefore, this issue is not factually accurate.

4.12 Issue 71212 - Leave Time Without Documentation The CI contends that an employee took a large amount of leave time without completing the required documentation.

Without proper evidence, this concern could not be verified as factual.

However, if an individual has knowledge of an employee abusing TVA leave privileges, the individual should notify the employee's supervisor and let the supervisor take the appropriate action.

4.13 Issue 71213 - Warehouse Gate Shack The CI raising this issue stated there should be a shack at the main warehouse gate.

Present procedure requires drivers to stop at

gate, walk over 100 feet to the warehouse, sign in, walk back to the vehicle, wait for the individual assigned to the gate to open it, and then drive through.

This procedure is reversed when leaving.

CI stated that this is not very cost effective.

This issue was verified as factual but it was previously resolved in June 1986 with the construction and operation of a gatehouse at the main warehouse gate.

4.14 Issue 71214 - TVA Em lo ee Persecution The CI alleges that "TVA will use any pretext to persecute employees."

This type of perception on the part of some TVA employees is what led to the development of the Employee Concerns Program.

There are several avenues employees can take if they feel they are being unjustly treated; redress can be sought from line supervision, the grievance

process, the office of the Equal Employment Opportunity Staff, Inspector General, and Employee Concerns Program.

Because this issue was based on an opinion, it could not be verified as factually accurate.

OF 14 4.15 Issue 71215 - Retention of uglified 0 erations Personnel The CI contends

that, instead of making every effort to retain qualified Operations personnel, TVA cooperates with and encourages other utilities who want to hire away TVA Operations personnel by providing facilities for recruiters to interview the TVA employees.

This issue is factually accurate, but is not a problem.

The only time TVA has provided space for recruiters is when TVA was having a

large reduction in force and was trying, to assist employees needing placement outside TVA.

4.16 Issue 71216 - Instrumentation En ineerin Accountabilit The CI contends that Instrumentation Engineering is not held responsible for mistakes they cause.

Examples given were (1) Instrumentation lines with incorrect slope were approved by Engineering.

(These are now being addressed by Nonconforming, Condition Reports

[NCRs).) (2) The Engineering deletion of stainless steel cleanline requirements for unit 1, even though this is a Quality Control (QC) requirement.

This issue is factually

accurate, but corrective action was previously initiated.

ONP has realized it has deficiencies as it relates to managerial accountability and responsibility.

Some managers are being replaced and others are receiving training and specific directions.

The Construction Subcategory Report 17300 is addressing the technical aspects of this issue.

4.17 Issue 71217 TVA Procedures Unclear and Nons ecific The CI raising this issue feels TVA procedures are too unclear and nonspecific.

This issue is factual and presents a problem for which corrective action has

been, or is being, taken as a result of a prior evaluation.

ONP began to rewrite their procedures in April 1986 to improve

clarity, Other TVA policies and procedures are also being reviewed for need and clarity.

Office of General Counsel The CI raising this issue contends that the Office of Goneral Counsel does not represent all employees as they are supposed to doe This issue cannot be verified as factual because of a lack of information.

4.19 Issue 71219 -

EGE,G and the Weldin Task Grou The CI raising this issue contends that EGSG will help NSRS cover-up the real problems in the welding program by using a

"management friendly" approach.

As of March 1986, the EGSG contract that was established through a

DOE interagency agreement was changed from being administered by NSRS to being administered by the WBN ECTG.

The audit process established for the program should deter or discover any attempts to cover-up.

Therefore, this issue could not be verified as factually accurate.

4.20 Issue 71220 Theft of Government Pro ert The CI contends that theft of government property is possible at WBN.

Theft of government property is possible at TVA (and most other businesses).

There are inventory and security systems in place to control theft.

As in the public sector, these systems are not always effective.

New methods are always being tested; but the primary deterrent continues to be careful observation by employees and Public Safety Service (PSS).

The CI did not specify how theft is possible; therefore, this issue could not be verified as factual.

4.21 Issue 71221

A Mana ement Pressure on Auditor The CI raising this issue feels an auditor was pressured by Quality Assurance (QA) management to not write deviations, which the immediate supervisor would not process in any event.

CI also alleged that QA management reguires closure of deviations before corrective action i.s complete.

The Nuclear Procedures System will provide a means of implementing the Manager of ONP's policy on this matter, This issue could not be verified as factual due to insufficient information.

(Quality Assurance Subcategory Report 80100 also addresses an issue concerning a

4.27 Issue 71227 - Investi ation of Previous Concerns The CI raising this issue alleges that previous concerns (001 to 055) documented in his file were presented previously to NSRS but no investigations have been initiated.

All concerns collected by QTC are included for evaluation by the WBN Employee Concerns Task Group (ECTG) that began the Employee Concerns Special Program on February 1, 1986.

Reports on these concerns will become available as subcategory reports are finalized.

If employees have knowledge of anyone misusing TVA telephones, they should report the misuser to the Telecommunications Staff of the Division of Property and Services or to the Office of the Inspector General.

4.30 Issue 71230 - Su ervision of Pi e Loadin and Unloadin This issue is based on a complaint that an expeditor of material cannot move pipe until a general foreman can watch loading and unloading of the pipe.

This allegedly creates a schedule impact due to the busy schedule of a general foreman.

This procedure was established in support of safety.

A large piece of pipe rolled off a truck onto a man, injuring his leg.

Since

then, general foremen are required to oversee all unloading of pipe to ensure safety is practiced.

Therefore, this issue is factually accurate but is not a problem.

4.31 Issue 71231 TVA Meldin Pro ram The CI raising this issue stated that, if TVA had an adequate welding program, then the welders would not have lost two or three weeks time.

The "lost time" referred to was due to a stop work order and welders were, in effect,

'dogged off'.

CI also stated that quality of nonsafety-related systems is not as good as quality of safety-related systems.

TVA strives to achieve specified levels of quality in construction, The criteria for QA and non-QA items and systems are judged differently.

However, more rigid standards are set for QA program applications where safety may be affected.

These QA items are potentially more hazardous in the event of a natural disaster or other design basis event; thus, stricter controls are necessary, Therefore, his issue is factual, but it does not present a problem.

4.33 Issue 71233 - Oral Examination Assistance The CI contends that TVA should provide assistance to otherwise knowledgeable employees who have difficulty responding before oral examination boards which must be passed for promotion qualification.

The Assistant Shift Engineer Exam (coal fired plant) was specifically referenced.

This issue is beyond the scope of the WBN Employee Concerns Special Program and therefore cannot be verified as factual.

However, informal (practice) oral exams are given at the plants to help prepare the employees for the formal exam, If any employee has trouble during the informal exam, the employee has time to work on weaknesses before the formal exam.

4.34 Issue 71234 - Bellefonte Com letion The CI raising this issue states that "TVA should finish the nuclear plant that is built the safest so far and has complied with the procedures.

The community's feeling should be considered,"

The TVA Board and ONP management have made clear their commitment to quality construction and the safe operation of all TVA's nuclear power plants.

Because of this commitment, oversight and inspection procedures have been implemented which should leave no question regarding safety of the plants currently under construction or the operating safety of existing plants when they go back online, We recognize that the Bellefonte project has demonstrated a high level of performance and those managers and employees associated with its design and construction are to be complimented.
