ENCLOSURE 1 AMENDMENT NO. 256 TO LICENSE NO. DPR-72 DUKE ENERGY FLORIDA, LLC CRYSTAL RIVER UNIT 3 NUCLEAR GENERATING PLANT DOCKET NO. 50-302
DUKE ENERGY FLORIDA, LLC DOCKET NO. 50-302 CRYSTAL RIVER UNIT 3 NUCLEAR GENERATING PLANT AMENDMENT TO FACILITY OPERATING LICENSE Amendment No. 256 License No. DPR-72

The Nuclear Regulatory Commission (the Commission) has found that:
A.
The application for amendment to the Crystal River Unit 3 Nuclear Generating Plant (the facility) Facility Operating License No. DPR-72 filed by Duke Energy Florida, LLC, (the licensee), dated May 24, 2016, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I; B.
The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C.
There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations; D.
The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E.
The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

Accordingly, the license is hereby amended as indicated in the attachment to this license amendment, and paragraph 2.D. of Facility Operating License No. DPR-72 is amended to read as follows:
Physical Security The licensee shall fully implement and maintain in effect all provisions of the Commission-approved physical security, training and qualification, and safeguards contingency plans including amendments made pursuant to 10 CFR 72.212(b)(9) and to the authority of 10 CFR 50.90 and 10 CFR 50.54(p). The combined set of plans, which contain Safeguards Information protected under 10 CFR 73.21, is entitled: "Independent Spent Fuel Storage Installation Security Plan, Training and Qualification Plan, and Safeguards Contingency Plan, Revision 0, submitted by letter dated July 5, 2017.

Accordingly, by Amendment No. 256, License No. DPR-72 is hereby amended to approve the proposed Independent Spent Fuel Storage Installation Security Plan, Training and Qualification Plan, and Safeguards Contingency Plan, as set forth in the licensees application dated July 5, 2017, and evaluated in the NRC staffs safety evaluation dated February 14, 2018. The license amendment is effective as of the date Duke Energy Florida, LLC submits written notification that all spent nuclear fuel has been transferred from the spent fuel pool to the ISFSI, and shall be implemented within 120 days.
