ENCLOSURE 1

NOTICE OF VIOLATION Carolina Power and Light Company Shearon Harris Unit 1

Docket No. 50-400 License No.

NPF-63 During an NRC inspection conducted on April 3 - Hay 6,

1994, a violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C, the violation is listed below:

Technical Specification 6.8. I.a. requires written procedures to be established and implemented covering procedures outlined in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.

Regulatory Guide 1.33, Appendix A, paragraphs 1.d and 3, require procedures for procedure adherence and temporary change method and for filling and venting the following systems:

shutdown cooling, emergency core cooling, and chemical and volume control.

Administrative Procedure AP-100, Procedure Use and Adherence, Section 5.1.6.c.,

requires procedure changes to be initiated before continuing with a procedure which would result in an incorrect action or inappropriate response.

Contrary to the above, On April 16, 1994, operators were observed filling the shutdown

cooling, emergency core cooling, and chemical and volume control systems utilizing an internal memorandum instead of approved procedures.

On April 9, 1994, during acceptance testing of the new Siemens

breakers, technicians continued using procedures which referenced incorrect fuse sizes and an incorrect resistor value without initiating approved procedure changes.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit a written statement or explanation to the U. S.

Nuclear Regulatory Commission, ATTN:

Desk, Washington, D.

20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results

achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order or demand for information may be issued as to why the license should not be modified, V4OSm'o'war soO~oi ~
